Abstract: This text, based on a research carried out at the Center for the Study of Trade Union and Labor Economics at the Economics Institute of UNICAMP, CESIT/UNICAMP, examines the process of changing in the understanding of outsourcing by the Superior Labor Court, expressed in 1993 in the revision of Statement 256 and Summary 331, revisited in 2000 to extend subsidiary liability to public entities that hire the third parties. Thus, we used: documents and interviews, sources that provided key elements for the analysis of the Labor Court role on this form of contract, as well as for the discussion about the potential this Institution has to regulate labor relations.

Abstract: Apesar dos indices atuais positivos do mercado de trabalho brasileiro, ampliam-se as formas precarias de contratacao da mao de obra, entre elas a terceirizacao, acirrando desigualdades e fragmentando a organizacao dos trabalhadores. Diferentemente de outros paises da America Latina, no Brasil nao ha uma lei especifica que regulamente essa modalidade de contratar. Nesse vacuo, o Tribunal Superior do Trabalho, TST, em 1993, editou a Sumula 331, revisitada nos ultimos tempos. Este artigo, que compreende a Terceirizacao como uma das expressoes da dinâmica capitalista contemporânea, analisa: a dinâmica do processo de elaboracao dessa Sumula e suas modificacoes posteriores; procede a um balanco dos principais projetos de lei sobre terceirizacao em andamento no Parlamento brasileiro; analisa as propostas de lei sobre terceirizacao, elaboradas no âmbito dos Ministerios brasileiros, bem como reacao dos atores sociais a respeito e seus impactos; e, aborda alguns aspectos mais recentes da atuacao do Supremo Tribunal, STF, em acoes envolvendo terceirizacao. Abstract Despite the recent positive indicators of Brazilian labour market, it has been increasing the precarious forms of employing people, such as outsourcing, which exacerbates inequalities and breaks up the workers organization. Unlike other countries in Latin America, in Brazil there is no specific legislation to regulate this form of hiring. In this vacuum, in 1993, the Superior Labor Court edited Docket 331, which has been revisited in the past few years. In this article we understand processes of regulation like outsourcing as some of the expressions of the contemporary dynamics of capitalism, and so we analyze the process of elaboration of the referred docket and later modifications, and, make a balance of the main bills in Brazilian Parliament, and of regulation proposals elaborated in the ambit of Ministries, and also the reaction of social actors about the proposals and their impacts. We also discuss some of the more recent aspects of Federal Supreme Court actions, in demands involving outsourcing. Keywords: Regulation; Outsourcing; Labor Law; Superior Labor Court dockets.

Abstract: RESUMO: O artigo discute alguns aspectos da Lei no 13.467/2017, a lei da “reforma trabalhista” brasileira, com foco na modalidade de extincao do contrato de emprego por “comum acordo”. A partir de uma analise dos pressupostos da “reforma”, por meio de dados extraidos do Cadastro Geral de Empregados e Desempregados e dos relatorios do Tribunal Superior do Trabalho, procede a um balanco de seus primeiros 16 meses de vigencia, buscando evidenciar seus impactos e mostrando como essa forma de extincao contratual pode trazer prejuizos aos trabalhadores. Em linhas gerais, o texto aprofunda os estudos sobre as consequencias dessa alteracao, trazendo elementos para o debate sobre a relevância de se ter um arcabouco juridico com a caracteristica da universalidade e que contribua para assegurar o patamar minimo civilizatorio de direitos. ABSTRACT: This article examines some aspects of Law N. 13467/2017, the Brazilian “labor reform” law, focusing on the modality of employment contract termination by “mutual agreement”. Based on an analysis of the “reform” assumptions and on data extracted from the General Registry of Employed and Unemployed and the Superior Labor Court reports, the article evaluates the reform’s first 16 months of validity, seeking to evidence its impacts and demonstrate how this form of contractual extinction can bring losses to the workers. In general terms, the article analyzes the consequences of this change, bringing to the debate the relevance of having a legal framework with the principle of universality and that contributes to ensure the minimal civilizatory threshold level of rights.

Abstract: What is the effect of social distancing policies on the spread of the new coronavirus? Social distancing policies rose to prominence as most capable of containing contagion and saving lives. Our purpose in this paper is to identify the causal effect of social distancing policies on the number of confirmed cases of COVID-19 and on contagion velocity. We align our main argument with the existing scientific consensus: social distancing policies negatively affect the number of cases. To test this hypothesis, we construct a dataset with daily information on 78 affected countries in the world. We compute several relevant measures from publicly available information on the number of cases and deaths to estimate causal effects for short-term and cumulative effects of social distancing policies. We use a time-series cross-sectional matching approach to match countries’ observable histories. Causal effects (ATTs and ATEs) can be extracted via a dif-in-dif estimator. Results show that social distancing policies reduce the aggregated number of cases by 4,832 on average (or 17.5/100 thousand), but only when strict measures are adopted. This effect seems to manifest from the third week onwards.

Abstract: Em gestacao ha quatro anos, a cidade de Sao Paulo aguarda as novas licitacoes dos servicos de onibus. Nesse periodo, movimentacoes tem problematizado os graus de concentracao desse mercado, tanto fora quando dentro da Prefeitura. Ate o momento, todavia, sabe-se muito pouco sobre a composicao e as transformacoes do conjunto das empresas privadas de transportes. A partir de dados primarios sobre a propriedade e as caracteristicas das empresas, este artigo procura contribuir para essa tarefa, tratando da composicao do mercado privado de transporte publico no municipio nas ultimas quatro decadas. Inicialmente, sao apresentadas, a partir de contribuicoes recentes advindas da literatura especifica, as principais caracteristicas da economia politica urbana dos servicos de onibus em Sao Paulo. Em seguida, e feita a analise da composicao do mercado a partir da distribuicao das frotas e dos vinculos de propriedade nas ultimas quatro decadas. Os dados exibidos sugerem um mercado mais complexo e competitivo diante da narrativa consolidada no debate publico e na academia, na qual se afirmou que as mesmas poucas familias tem governado o mercado ha decadas. Isso e especialmente critico quando a atencao e voltada para a transformacao politica dos atores mais novos no mercado nas decadas de 1990 e 2010.

Abstract: Aims to analyze costs and legal uncertainty related to outsourcing in Brazil after the enactment of Laws 13.429/2017 and 13.467/2017 (Labor Reform), which disciplined this institute in the country. In particular, we analyze the perception of the companies contracted by the Caixa Economica Federal (CEF). The analysis is based on i) the cost composition sheets of 121 contracts maintained by the CEF between 2013 and 2018; and ii) semi-structured interviews with ten managers of companies contracted by CEF. We show that both the cost and the legal uncertainty reductions have not yet been observed and that the impact of the legislative innovations shall be verified after the period for the consolidation of jurisprudential understandings about outsourcing in Brazil (possibly after 2020). We conclude that the legislative innovations shall create incentives for outsourcing in Brazil, although in a deferred way diferida.

Abstract: O artigo analisa a problematica da negociacao coletiva de trabalho no contexto da Reforma Trabalhista de 2017 em seu foco principal, que e a prevalencia do negociado sobre o legislado. A Reforma visa reduzir os custos do capital, desestruturando as relacoes de trabalho e o Sistema de Protecao do Trabalho no Brasil junto com outras medidas, como a Lei da Terceirizacao de 2017 e a decisao do STF de 2016 sobre a ultratividade dos acordos e convencoes coletivas de trabalho, todas de matriz flexibilizante, causando prejuizos aos sujeitos do labor. A metodologia utilizada contemplou pesquisa bibliografica e documental cujos resultados apontam que a reforma e fruto dos interesses do capital em coesao com o Estado, desafiando sindicatos laborais como protagonistas necessarios a manutencao da dignidade humana no mundo do trabalho a assumir em novos enfrentamentos o protagonismo de um “novissimo” sindicalismo. ABSTRACT The article analyses the labor reform of 2017 in its main focus, which is the deal prevails over the legislated. Such reform has as purpose to reduce capital’s cost, destructuring the working relations and the work’s protection system in Brazil, combined with other measures such as the Outsourcing Law (2017) and the decision of the Supreme Federal Court (2016), on the ultra-effectiveness of the agreements and collective bargaining agreements, all of them with a flexibilizing nature, causing losses to the subjects of labor. The used methodology in the documentation’s analysis was bibliographic researches and documentary research, whose results point out that the above-mentioned reform is the result of the interests of capital in cohesion with the State, and is up to the labor unions, as necessary protagonists for the maintenance of the human dignities in the work, to assume new challenges and the protagonism of a brand-new syndicalism. Abstract: Purpose This paper aims to propose guidelines for public sector managers in assessing the impact of outsourcing on business continuity (BC) strategies. This paper evaluated how public managers from the state of Pernambuco, Brazil, perceive outsourcing, considering BC and how it relates to the outsourcing of services and activities. Design/methodology/approach Theoretical lenses of outsourcing and BC were used to derive the study hypotheses. A questionnaire was drawn up to collect information to test the hypotheses. To test the proposed hypotheses, binary logistic regression was used through an empirical analysis of a sample of 51 Brazilian public managers. Findings This study found that when the public sector suffers from negative impacts of financial restrictions, outsourced services are the first ones to receive the negative impacts. This has had an adverse impact on BC in the public sphere. On the other hand, the authors verified that the public sphere’s capacity for resilience and the existence of specific methodologies to support public managers in outsourcing decision-making can contribute to BC. Research limitations/implications This study assists public organizations to take advantage of internal outsourced services in the best possible way, making better use of public resources, gaining social legitimacy and legitimacy also in the provision of public services. However, each public sector can present different risks of non-continuity, and this aspect could not be considered in this research as well. Originality/value This study is a pioneer in highlighting the relationships between outsourcing strategies and BC in public services in Brazil. Through the guidelines discussed in this study, public managers could develop a more effective response to the implications of post-outsourcing budget constraints. In addition, the findings of this paper add to an understanding of the importance of business strategies for public services continuity and seek to help reduce uncertainties and better inform the government decision-making process.
