Abstract: This article has as general goal to find parameters in order to determine when the judicial activism leaves the field of legal argumentation and becomes an instrument of political decision. To this end, we started trying to define a possible concept of judicial activism and its origins in the United States juridical tradition. In this first moment, we use the historical analytical method to try to contextualize historically the conceptual categories under study and the conditions of emergence of this phenomenon in the United States. Following, on the basis of the critical comparative method, we began to study the fundamental elements that characterize political rationality and legal rationality. At the end, we discuss the prospects for an activist judge in Brazil, especially when acting in the protection of fundamental rights and ensuring the supremacy of the constitution. In general terms, our conclusions points to a set of criteria for the definition of what would be a so-called positive judicial activism, to the detriment of its other sort that is harmful to the wealth of the constitutional order.

Abstract: The fight against the COVID-19 pandemic put a series of emergency measures on the table of the governments of the States most affected by it, which, in the name of public health protection, raise serious doubts about its compatibility with the universal protection of human rights. Certain restrictive measures, by absolutely limiting very basic individual liberties, come to be interpreted as real constitutional exceptions. Trying to face the problem of an incompatibility from the point of view of social legitimacy between pandemic exceptional measures and the general protection of human rights, this research will seek to develop aspects related to the notion of democratic and deliberative glocal/global governance, above all as an instrument for the realization of a transnational constitutionalism in the creation of a ""common right of cooperation"" in Haberlesian terms. Methodologically, an analytical-descriptive approach, according to the deductive method and with the aid of bibliographic and documentary references, will be used when dealing with the notions of state of exception vs. human rights, risks and governance in the context of the current globalization, so that, in the end, the central hypothesis is developed through the articulation of such conceptual categories within a theoretical-constitutional and human rights transnational framework, aiming to outline the general characteristics of standardization of this democratic and deliberate glocal/global governance, concluding by its need to legitimately overcome, with the dromocratic resources of concertation together with the legal systems of each State, the pandemic challenges created by the contemporary risk and information society.

Abstract: RESUMO O presente artigo tem como objetivo geral analisar, primeiramente, o modo como se deu a regulacao juridica da inclusao social de pessoas com deficiencia no ensino regular, buscando, em seguida, especificar a problematizacao na questao do acesso ao ensino superior. Para tanto, um possivel conceito de inclusao sera estudado, em especial a partir de uma perspectiva habermasiana. Por fim, sera defendida a tese de que a inclusao de pessoas com deficiencia no ensino superior passa mais por novas politicas educacionais e praticas pedagogicas, do que propriamente pela ampliacao de um rol de documentos normativos. Metodologicamente, a pesquisa realiza um levantamento das legislacoes relativas ao tema no Brasil, a partir de uma metodologia analitico-descritiva, de modo a permitir que passemos a um metodo critico-hermeneutico quando da analise da ideia de inclusao no ensino superior. ABSTRACT This article has as main objective to analyze, initially, how happened the legal regulation of social inclusion of people with disabilities in ordinary education, searching, then, to specify the questioning on the issue regarding the access to higher education. Therefore, a possible concept of inclusion will be studied, especially from a Habermasian perspective. Finally, there will be argued the thesis that the inclusion of people with disabilities in higher education demands more for new educational and pedagogical policies, than for new normative documents. Methodologically, the research makes a survey of the laws on the subject in Brazil, from an analytical-descriptive methodology, in a way to allow us to move to a critical-hermeneutic method when analyzing the idea of inclusion in higher education. Abstract: No presente artigo analisa-se como o advento da democracia digital, em especial mediante o uso de aplicativos e outras ferramentas similares, pode viabilizar uma profunda reconfiguracao da avaliacao continuada das politicas publicas. Iniciando com a contextualizacao da democracia digital no âmbito do desenvolvimento historico da democracia liberal, a pesquisa busca concentrar o foco em aspectos concernentes aos novos possiveis mecanismos de participacao digital do cidadao-usuario de servicos publicos. Nesse sentido, mais do que usuario, o cidadao torna-se, de fato, um ativo codefinidor de politicas publicas. Quanto a metodologia, as categorias conceituais classicas da teoria democratica sao abordadas com base na metodologia analitico-descritiva. Ja a metodologia critico-hermeneutica e empregada na analise da relacao entreos individuos e as politicas publicas no âmbito da democracia digital.

Abstract: Will Facebook and similar posting sites soon come to an end from hefty civil fines and consent decrees? Is Internet discourse at risk? That may be the case if lawmakers succeed in passing the Do Not Track Kids Act. As drafted, the law would require operators of children directed websites to include an eraser button to remove user posted content and would penalize mom and pop run sites unable to afford the financial and technological resources to comply with the mandate. This Note argues that if enacted, the law would constitute a presumptively impermissible burden on Free Speech under the First Amendment and should be subject to strict scrutiny.

Abstract: The professional ethos of judges has undergone many changes in Brazil in recent years, generating conflicts about the role of these professionals in society. This article examines how Brazilian judges deal with those conflicts. The objective is to identify how judges perceive their social role and, based on that, what motivates them in their work. A series of twenty-five in-depth interviews was carried out with Brazilian state judges working in all regions of the country in different judicial specialties. The findings indicate that the judges interviewed can be classified into four different profiles according to the predominant social role: (1) social activist; (2) service provider; (3) judicial restraint; and (4) defender of the status quo. Each profile corresponds to a specific individual and social motivation.

Abstract: Este texto tem como objetivo contribuir com a aplicacao da equidade, enquanto marco etico, na reflexao bioetica em tematicas de saude publica. Foram seguidos os seguintes passos metodologicos: descricao da origem conceitual da equidade; sua aplicacao na esfera da saude publica e, por ultimo, analise da equidade como marco etico inserido na dimensao social da bioetica. A raiz conceitual de equidade fundamenta-se no pensamento aristotelico, o qual distingue equidade de justica no momento em que esta se divide em justo legal e justo natural, compreendidos na nocao de justica politica. Na esfera da saude publica, a nocao de equidade parte do pressuposto de que os individuos sao diferentes e, portanto, merecem tratamento diferenciado, consentâneo com as suas vulnerabilidades. A bioetica latino-americana tem como orientacao a reducao das iniquidades ou disparidades sociais, sendo um de seus frutos a inclusao da equidade entre um dos objetivos da Declaracao Universal sobre Bioetica e Direitos Humanos (DUBDH): "Promover o acesso equitativo aos desenvolvimentos medicos, cientificos e tecnologicos". Assim, a equidade ganha forca como marco etico no processo decisorio da alocacao de recursos publicos, associada a nocao de justica social.

Abstract: A ma gestao publica dos residuos solidos no Brasil tornou-se um de seus maiores problemas ambientais, resultando em uma atuacao que conspira contra o modelo de cidadania instituido pela Carta Constitucional de 1988 e pela inefetividade da politica nacional criada para o enfrentamento da questao. Neste estudo, analisou-se a atuacao do poder judiciario como instrumento de efetividade da implementacao da Politica Nacional de Residuos Solidos (PNRS) ao pressionar a gestao publica por meio de sancoes juridicas, a tornar-se eficiente, contribuindo para a minimizacao do problema de gerenciamento de residuos solidos no Brasil. Para isso, utilizou-se da analise de conteudo de dez decisoes do Superior Tribunal de Justica, selecionadas a partir da palavra chave “residuos solidos” no site do referido tribunal. Os resultados evidenciaram a dificuldade na implementacao da PNRS pelos gestores municipais e a necessidade de revisao da Lei n. 9.605/1998 (Lei de Crimes Ambientais), ajustando-a aos preceitos e diretrizes da PNRS, com o objetivo de instituir subsidios penais que instiguem a efetividade ambiental de uma administracao eficiente ou, como ultima ratio, fortalecer o judiciario em suas intervencoes para avalizar um meio ambiente equilibrado para todos, conforme preceitua a Constituicao Federal.
