Abstract: Out of the analysis of the relation between state practices of punishment, slaverist discipline and legal discourse in nineteenth-century Brasil, the article underlines the significance of the Foucaultian perspective to understand the practices of both the production of subjection and the legal discourse in contemporary societies. The text suggests the necessary articulation between the issues and methods proposed by Foucault, and the results of the historical research about the structural and cultural particularities of the Brazilian society.

Abstract: This paper explores the basis for a conceptual formulation on the role of human rights in democratic politics, having the changes in the 1990's as starting point. The human rights can't be restricted to the constitutional scope. In other words, the analysis of the human rights based on an analogy with the constitutional rights is well suited to criticism. On the one hand, the pyramidal model of Rights supposed by such analogy has been subject to theoretical and practical questioning in the past few years. On the other hand, the human rights have a much greater role due to their international nature and the way they are inserted in the democratic politic dynamics.

Abstract: O artigo analisa o debate academico sobre o ativismo judicial. Critica o seu enfoque no problema da autonomia individual do juiz na tomada de decisao e seu proposito normativo de definir o modelo apropriado para o Judiciario numa ordem constitucional democratica. O debate coloca em segundo plano o carater institucionalmente inserido dos tribunais e simplifica as relacoes entre a pratica judicial e o contexto politico. Em seguida, propoe um quadro para a analise das relacoes entre jurisprudencia e politica, baseado nos conceitos de regime governamental e regime jurisprudencial. Enfim, e apresentada uma analise preliminar das mudancas no controle da constitucionalidade pelo STF apos 1988.

Abstract: Este artigo retoma o debate sobre os argumentos que sustentam a existencia de um processo de judicializacao da politica no Brasil. O artigo foca-se em tres objetivos: revisitar os argumentos da judicializacao da politica no Brasil, avaliar os argumentos empiricos do processo de judicializacao e apontar novas abordagens sobre o tema. A literatura que se ocupa dessa questao tomou por emprestimo a definicao dada por Tate e Vallinder: judicializacao e a reacao do Judiciario frente a provocacao de um terceiro e tem por finalidade revisar a decisao de um poder politico tomando como base a Constituicao. Ao fazer essa revisao, o Judiciario estaria ampliando seu poder com relacao aos demais poderes. A nossa proposta aponta para a necessidade de estruturarem-se melhor os indicios de uma possivel judicializacao da politica no Brasil. Para demonstrar tal proposta, faremos uma revisita aos argumentos utilizados na coletânea The Global Expansion of Judicial Power, organizada por Neal Tate e T. Vallinder (1995). A ideia e demonstrar que a abordagem utilizada por esses autores nao esgota o assunto – ao contrario, apenas inicia o debate. Para tanto, faremos uma abordagem a respeito dos motivos da chamada expansao do poder judicial e, em seguida, realizaremos uma breve analise em que verificaremos se as condicoes para o surgimento da judicializacao da politica, observadas em outros paises, estao presentes no Brasil. Logo apos, discutiremos o conceito de judicializacao da politica e sua sustentacao empirica em nosso pais. Por fim, apontaremos, sinteticamente, outras abordagens possiveis a essa problematica. IN SEARCH OF JUDICIALIZATION OF POLITICS: NOTES FOR A NEW APPROACH Abstract This article takes up the debate on arguments that maintain that a process of judicialization of politics is currently underway in Brazil. It focuses on three goals: discussion of arguments on the judicialization of politics in Brazil, evaluation of empirical arguments on the process of judicialization and suggestions for new approaches to the topic. The literature on this issue borrows Tate and Vallinder’s definition of the term: judicialization is the reaction of the Judiciary to the provocations of a third party and has as its goal the revision of a decision made by a political power taking the Constitution as its bases. In carrying out this revision, the Judiciary would be widening its power in relation to that of the other spheres of power. Our view argues that it is necessary to come up with a better way to structure the indicators of a possible judicialization of politics in Brazil. In order to back up our argument, we will take another look at the arguments developed in Tate and Vallinder’s anthology, The Global Expansion of Judicial Power (1995). We intend to demonstrate that the arguments that these authors use do not exhaust the issue, but to the contrary: they just manage to initiate the debate. In this vein, we will develop an approach for understanding the reasons underlying the so-called expansion of judicial power. This will be followed by a brief analysis in which we will attempt to verify if the conditions for the emergence of a judicialization of politics, as observed in other countries, are also present in Brazil. Then we will go on to discuss the concept of the judicialization of politics and its empirical bases in our country. Finally, we will take a brief look at other possible approaches to this problem. A LA RECHERCHE DE LA JUDICIALISATION DE LA POLITIQUE: NOTES POUR UNE NOUVELLE APPROCHE Resume Cet article reprend le debat sur les arguments qui soutiennent l’existence d’un processus de judicialisation de la politique au Bresil. L’article est centre sur trois objectifs : repasser les arguments de la judicialisation de la politique au Bresil, evaluer les arguments empiriques du processus de judicialisation et presenter de nouvelles approches sur le theme. La litterature qui s´occupe de cette question a emprunte la definition donnee par Tate et Vallinder: judicalisation est la reaction du Judiciaire face a la provocation d’un tiers et a pour finalitie reviser la decision d’un pouvoir politique tout en s’appuyant sur la Constitution. Lorsque le Judiciaire entame cette revision, il elargit son pouvoir a l’egard des autres pouvoirs. Notre proposition va dans le sens de considerer la necessite de structurer mieux les indices d’une possible judicalisation de la politique au Bresil. Pour demontrer cette proposition, nous repasserons les arguments utilises dans le recueil The Global Expansion of Judicial Power, organise par Neal Tate et T. Vallinder (1995). L’idee est de montrer que l’approche utilisee par ces auteurs n’epuise pas le sujet – au contraire, il ne fait qu’introduire le debat. De ce fait, nous ferons une approche concernant les motifs de la soi-disant expansion du pouvoir judicial; ensuite, nous ferons une breve analyse ou nous verifierons si les conditions pour l’avenement de la judicalisation de la politique observees dans d’autres pays, sont presentes au Bresil. Et nous discuterons du concept de judicalisation de la politique et de sa maintenance empirique dans notre pays. Enfin, nous presenterons rapidemente d’autres approches possibles a l’egard de ce probleme.

Abstract: Over the past 30 years, democratic freedoms and competitive electoral processes have taken hold as never before in Latin America. How Democracy Works takes a detailed look, from an institutional perspective, at each of the main actors on the policymaking stage in Latin America, emphasizing the extent to which institutions facilitate or hinder intertemporal political cooperation and compromise. It analyzes official political actors and arenas, as well as a number of societal actors, and explores the (formal) roles of these players, their incentives, capabilities, and the way in which they actually engage in the policymaking game. The conclusion: these political institutions and actors matter for policymaking in Latin America and leave an indelible imprint on the policy process and the resulting policies.

Abstract: Este artigo propoe-se a apresentar analises de alguns elementos que contribuem para a constituicao da Educacao Especial brasileira como uma politica publica, dando especial foco a formulacao do que tem sido denominada de politica de educacao especial na perspectiva inclusiva ou educacao inclusiva. Para tanto, o texto e construido a partir da configuracao de dois aspectos distintos, mas intimamente interligados. O primeiro refere-se ao papel do Governo brasileiro na historia da educacao destinada as pessoas com deficiencias no Brasil. O segundo diz respeito as relacoes entre as politicas nacionais no campo da Educacao e os acordos e compromissos internacionais. Conclui ressaltando a importância dos diferentes setores da sociedade nos embates atuais para a formulacao de uma politica de educacao brasileira, que incorpore, de fato, toda a populacao.

Abstract: Based on an analysis of individual claims for provision of medicines brought by users of the Unified National Health System (SUS) against the State of Rio de Janeiro, Brazil, in the year 2005, this study aims to discuss the action and behavior of the court system in ruling on these suits. The study adopted a semi-qualitative exploratory documental research design, analyzing key aspects related to the claims, such as type of medication claimed by the plaintiff, wording of the court rulings, and the key elements used by judges in trying the cases. According to the analysis of the lawsuits and the concepts of judicialization and official standardization of medicines, the study concludes that when ruling on the provision of medicines, the court system grants the claims as submitted without considering the standardization of medicines adopted by the Ministry of Health, thus exercising excessive court intervention in health policy.

Abstract: Will Facebook and similar posting sites soon come to an end from hefty civil fines and consent decrees? Is Internet discourse at risk? That may be the case if lawmakers succeed in passing the Do Not Track Kids Act. As drafted, the law would require operators of children directed websites to include an eraser button to remove user posted content and would penalize mom and pop run sites unable to afford the financial and technological resources to comply with the mandate. This Note argues that if enacted, the law would constitute a presumptively impermissible burden on Free Speech under the First Amendment and should be subject to strict scrutiny.
