Abstract: En Espana no contamos con encuestas de victimizacion periodicas debido a que ningun organismo ha asumido esta relevante tarea. Para conocer el volumen y evolucion de la delincuencia en este pais ha habido que recurrir, hasta el momento, a las estadisticas oficiales como unico referente, siendo por todos conocidas las deficiencias que presentan estas fuentes por si solas para tales fines. La investigacion que presentamos en este articulo muestra un analisis de la realidad delictiva en Espana a partir de encuestas de victimizacion a nivel nacional. La comparacion longitudinal se ha realizado entre los dos pases internacionales de la ICVS (1989 y 2005) en los que Espana participo, y la encuesta realizada por el Observatorio de la Delincuencia (ODA) en 2009 con el mismo cuestionario ICVS. Con estas tres encuestas se ha podido realizar un analisis de la evolucion de la delincuencia en Espana en las ultimas dos decadas. Como comprobara el lector a lo largo de estas paginas, a pesar de que la opinion publica considera que la delincuencia en Espana ha aumentado en las decadas analizadas, los resultados de las encuestas de victimizacion muestran que en realidad ha descendido.

Abstract: According to some studies (ESS, 2010; Garcia Anon et al, 2013), police officers treat people of different races or ethnic groups worse, and they usually stop gipsy citizens 10 times more than the others, maghrebi citizens7.5 times more and afro-latin american citizens 6.5 times more. This kind of behaviors not only leads to institutional discrimination, but it also reduces legitimacy and trust in law enforcement. Studies of police legitimacy consider that it is related to the decision making quality (impartiality, equal treatment, transparency, etc.) as well as to personal treatment (dignified and respectful). The Program for the EffectivePolice Stop (PIPE) was created with the goal of decreasing ethnic bias in police stops and to narrow the distance between police and diverse society. The results confirm the existence of disproportionality in police practices with minority groups, and highlights the benefits of these programs to reduce them.

Abstract: ?A que nos referimos cuando hablamos de orden social? ?Que concepciones del ser humano y del mundo, que inmanencias ideologicas y que premisas etico-politicas sostienen la idea de orden dominante en nuestra sociedad? ?Cual es la base material de ese concepto y cual ha sido el recorrido historico de la construccion de ese orden? ?Bajo que formas de dominacion, legitimacion, reproduccion y control ? O mejor: ?que poderes castigan?, ?que se castiga, a quienes se castiga y como se castiga?, ?que informacion-poder dimana el castigo hacia el orden social? Todas esas preguntas apuntan al primero de los peajes a superar (el historico y epistemologico) como condicion necesaria para cualquier critica de la penalidad en el capitalismo. Podria decirse que, en primera instancia, cualquier tarea de esta indole exige "hacer historia", o mejor aun: hacer memoria. El analisis propuesto, que se pretende ?estructural no-estructuralista?, abordara las transformaciones institucionales, las tendencias politicas, la evolucion de los sectores economico y penal y los cambios sociales asociados a todos esos elementos ?cambios que darian verdadero sentido al estudio de la norma y sus funciones reales. El estudio de las condiciones en que el Estado espanol toco el techo de su crecimiento economico (para entrar con fuerza en la crisis de 2008) como lider del encarcelamiento en Europa occidental toma esa perspectiva. Se propone, pues, un estudio de la estructura y la superestructura en el neoliberalismo y de sus efectos sobre el gobierno de la penalidad. Es decir: un intento de comprender como se organiza y opera la gobernanza en un escenario globalizado y como repercute eso en las esferas interrelacionadas de lo penal y lo penitenciario, considerando para el caso espanol que, como apunta Bergalli, ?quiza sea el sistema penal el ambito donde los retrasos son mas patentes? . El economico, el juridico-politico y el sociologico son los tres principales enfoques en que se reparte este analisis del triangulo mercado-estado-carcel en el Reino de Espana. La pregunta que da origen a dicho analisis del auge punitivo en las ultimas tres decadas largas es, precisamente, ?como interpretarlo para cambiarlo?

Abstract: The contemporary convergence between immigration control and criminal justice, commonly referred to as crimmigration, entails a substantial reconfiguration of immigration control decision-making processes. One of the most significant features of this conversion is the increasing intervention of the criminal judiciary in matters related to immigration control. For instance, deportation can be in many cases a consequence of a criminal conviction for a considerable number of crimes, and bail or sentencing decisions can be influenced by the migratory status and the deportation likelihood of a defendant. Although empirical research upon the convergence between immigration and criminal law has rapidly grown in the last decade, there is still a gap in the literature regarding the judicial decision-making processes and determinants of immigration control within the realm of criminal courts. The present research purports to contribute to the scholarly research on such aspects by conducting an in-depth qualitative case-study analysis of a specific court setting. For that purpose, this dissertation focuses on Spain given that its legal migration regime shares many of the substantial aspects of the phenomenon described by the crimmigration concept. Despite irregular migration is not a criminal offence in that country, immigration detention is authorised by criminal judges and there is a series of expulsion (deportation) pathways available within criminal proceedings. Additionally, Spain is a relevant research location in this regard due to its crucial role at controlling the Southern border of the so-called ‘fortress Europe’. Drawing on 78 in-depth semi-structured interviews with judges, prosecutors, clerks, court personnel, defence attorneys and other legal professionals, as well as focused observation conducted for a period of eight months, this thesis seeks to ascertain the punitive meanings attributed by criminal court actors to immigration control. To do so, this research relies on organisational, social-psychological, and cultural frameworks for explaining judicial decision-making by criminal courts, focusing on immigration detention and expulsion throughout the criminal proceeding, which are in general administrative procedures under judicial supervision by criminal courts. Whilst assuming that the convergence between immigration control and criminal justice is a contemporary mechanism for the social construction of the ‘criminal immigrant’, the main findings of this study are structured in two parts. The first delves into the idiosyncratic features of immigration detention decision-making, and the second into the determinants and meanings ascribed by court actors to so called pre-trial, sentencing and post-sentence expulsion. This analysis evidences that immigration detention decision-making is substantially determined by the convergence of bureaucratically patterned decisional mechanics and the intrinsic criminal justice cultural identity of criminal courts. This embodies Kafkaesque dynamics characterised by automation, thoughtlessness and dehumanisation in decision-making. Furthermore, this research reveals that expulsion is a court’s culturally constructed punishment, defined more by the meanings produced and attributed to it by court actors than by its formal legal categorisation. Specifically, this thesis contends that expulsion is assessed by court actors in terms of its suitability for attaining such traditional purposes of punishment as incapacitation, deterrence and retribution. Therefore, this research concludes that immigration detention and expulsion are substantially traversed by the constitutive cultural identity of criminal courts, which in turn determines their key procedural traits and decisional outcomes. Die gegenwartige Annaherung zwischen Migrationskontrolle und Strafrecht, die auf allgemein als Crimmigration bezeichnet wird, fuhrt zu einer substanziellen Umgestaltung des Entscheidungsfindungsprozesses der Migrationskontrolle. Ein besonders bedeutsames Merkmal dieser Annaherung ist die steigende Einflussnahme von Strafgerichten auf die Migrationsrechtsverfolgung; wobei solche Gerichte wesentliche Fragen uber Migrationskontrolle beantworten mussen. Beispielweise kann Abschiebung in einem Prozess die Folge einer Verurteilung wegen krimineller Handlungen sein, gleichzeitig kann das Strafmas durch den Migrationsstatus und die Ruckfuhrungswahrscheinlichkeit des Angeklagten beeinflusst werden. Obwohl die Anzahl empirischer Forschung zu Crimmigration wahrend des letzten Jahrzehnts schnell gestiegen ist, bleibt eine Lucke in der spezialisierten Literatur bezuglich der Entscheidungsprozesse vor Gericht und der bestimmenden Faktoren von Migrationskontrolle im Bereich der Strafgerichtsbarkeit. Die vorliegende Forschungsarbeit tragt durch eine tiefgehende qualitative Fallstudie Analyse eines spezifischen juridischen Settings zu diesen genannten Aspekten der wissenschaftlichen Forschung bei. Zu diesem Zweck fokussiert sich diese Dissertation auf Spanien, da das spanische-juridische Migrationsregime teilt viele der wesentlichen Aspekte des Phanomens, das mit dem Crimmigration Konzept beschrieben wird. Zwar irregulare Migration nicht strafbar ist, wird Einwanderungshaft durch die Strafgerichte autorisiert, weshalb eine Reihe an Moglichkeiten fur eine Abschiebung den Strafprozessen inharent sind. Spanien besitzt auch deshalb eine hohe Relevanz als Fallstudie fur das vorliegende Forschungsfeld aufgrund der entscheidenden Rolle, es bei der Kontrolle der sudlichen Grenze der so genannten ‚Fortress Europe’ (Festung Europa) einnimmt. Basierend auf 78 ausfuhrlichen, semi-strukturierten Interviews mit Richtern, Staatsanwalten, Gerichtsbeamten, Rechtsanwalten, und anderweitigem Rechtspersonal, sowie aufmerksamen Beobachtungen wahrend eines achtmonatigen Zeitraumes, macht es sich die vorliegende Thesis zur Aufgabe die der Migrationskontrolle, seitens der Strafgerichtsbarkeitsakteure, attribuierte strafende Bedeutung festzustellen. Dafur bedient sich der hier vorliegende Forschungsansatz Erkenntnissen aus organisationstheoretischen, sozial-psychologischen und kulturwissenschaftlichen Perspektiven, um die juridische Entscheidungsfindung der Strafgerichte zu interpretieren. Ein besonderer Fokus wird hierbei auf die Praktiken der Abschiebung und Abschiebehaft gelegt, die generell als administrative Prozeduren der Gerichte unter richterlicher Anordnung gesehen werden. Der Annahme folgenden, dass durch die Uberschneidung zwischen Kontrolle von Einwanderung und Strafprozessrecht als ein kontemporarer Mechanismus fur die soziale Konstruktion des ‚criminal immigrant’ (Der kriminelle/verbrecherische Einwanderer) geschieht, konnen die Ergebnisse dieser Forschung in zwei Teile gegliedert betrachtet werden. Der erste Teil vertieft die idiosynkratrischen Besonderheiten der migrationshaft-bezogenen Entscheidungsfindung, und der zweite Teil handelt von den durch Strafgerichtsakteure beigemessenen Einflussfaktoren und Bedeutungen bezuglich vor-Verhandlung, Verurteilung und nach Urteil durchgefuhrten Abschiebungen. Diese Forschung macht deutlich, dass die Willensbildung im Falle der Einwanderungshaftgrundsatzlich durch die Konvergenz von burokratisch gepragten Entscheidungsmechanismen, und die den Strafprozessen intrinsische Kulturalidentitat von Verfassungsgerichten, determiniert wird. Dies verkorpert kafkaeske Dynamiken einer automatisierten, gedankenlosen und entmenschlichenden Willensbildung des Strafprozesses. Weiterhin zeigt die vorliegende Forschung, dass die Abschiebung eine kulturell-konstruierte Sanktion ist, die mehr durch die ihr von Strafgerichtsakteuren gegebene Bedeutung als durch formale legislative Inhalte abgegrenzt wird. Insbesondere argumentiert die vorliegende Dissertation, dass die Gerichtsakteure die Abschiebung im Rahmen einer Angemessenheit fur traditionelle Bestrafungs-, Entmundigungs-, Abschreckungs- und Vergeltungszwecke einschatzen. Letztendlich schlussfolgert diese Forschung, dass Einwanderung, Verhaftung, und Abschiebung im Wesentlichen von der konstituierenden Kulturalidentitat des Strafgerichtes gepragt sind, was wiederum deren Schlusselverfahrenscharakteristiken und Entscheidungsergebnisse bestimmt.

Abstract: Outcome assessment in the Spanish young offenders' law. Recidivism and associated factors. The present study aims to assess the impact of the Spanish young offenders law (LO/2000). Recidivism and its associated risk factors were used as indicators of impact. Data were collected from young offenders' reports opened after 2001 and closed before 2005. The final sample consisted of 382 young offenders (327 males and 55 females). Results indicated that 70% had not re-offended in an average period of 1.6 years. Most of the youngsters with fewer risk factors, usually start their criminal careers with less serious offences and the interventions seemed to be fairly effective. In the cases of young offenders with a higher number of risk factors, the interventions (custodial and non-custodial) were less effective, as recidivism rates were higher. Interventions must focus on family and community contexts in order to achieve adequate social integration of young delinquents.

Abstract: espanolEsta investigacion explora la percepcion que los turistas seniors tienen de la seguridad en la Playa de Palma (Mallorca) frente a la percepcion de la poblacion residente. La Playa de Palma es un destino turistico de sol y playa maduro en proceso de transformacion cuya imagen como destino se esta viendo afectada por actividades ilicitas y comportamientos incivicos que son difundidos por los medios de comunicacion, lo que contribuye a degradar la imagen del destino turistico, a la vez que crece la demanda de seguridad y de presencia policial en la zona por parte de los residentes. El marco teorico de la investigacion sigue tres ejes: las teorias criminologicas basadas en la prevencion situacional y las tecnicas comunitarias; la construccion social de la imagen del destino turistico como resultado de su evolucion territorial y socioeconomica; y, finalmente, la politica publica en materia de seguridad ciudadana y el papel de las Policias Locales como instrumento de la intervencion social comunitaria para la gobernabilidad. El trabajo de campo ha consistido en la realizacion de 1.334 cuestionarios recopilados en dos encuestas: una dirigida, contestada por 651 sujetos (412 turistas seniors y 239 residentes) entrevistados de forma aleatoria en la zona de estudio y otras no dirigida, contestada de forma voluntaria por 683 turistas seniors que asistieron a las charlas sobre seguridad impartidas por la Policia Local en 2016 y 2017. Los resultados proporcionan informacion sobre la victimizacion directa e indirecta de los turistas seniors y de los residentes, su valoracion de la seguridad percibida, la localizacion de los crime hotspots y las causas que estan en el origen de estas percepciones. La investigacion demuestra la existencia de una mala percepcion de seguridad entre los residentes en Playa de Palma, que es pesima entre los residentes en s’Arenal y que se produce de manera multicausal. El deterioro ambiental, los ruidos, las peleas y conflictos vecinales por actos incivicos, la diversidad etnica, unidos a la falta de servicios y equipamientos publicos y a la presencia en verano de grupos de turistas que alteran el orden publico, estan en la base de esta perdida de calidad de vida y de incremento de la inseguridad percibida. Sin embargo, frente a esta vision negativa de los residentes, la investigacion demuestra que el turismo senior percibe la Playa de Palma como un destino muy seguro, al que valora con un notable alto. La zona que genera mayor inseguridad entre los turistas seniors es la primera linea entre s’Arenal y el balneario 4 debido a la presencia de ciertos grupos que practican trile y venta ambulante principalmente. La asincronia con la que viaja el turismo senior respecto del maximo estival, en el que se producen mayor numero de incidentes, y las actividades diurnas y rutinarias que realiza en Playa de Palma determina un bajo nivel de exposicion al riesgo, lo que condiciona su percepcion favorable de seguridad. Turistas y residentes visualizan a la Policia Local como un elemento clave en la politica publica de seguridad y reclaman su presencia como elemento externo de control de la comunidad. EnglishThis research explores the safety perception of senior tourists in the Playa de Palma (Mallorca) in front of resident population. Playa de Palma is a mature sun and beach tourist destination under a transformation process whom appearance of the destiation is being affected by illicit activities and uncivil behaviors that are also disseminated by the media. At the same time, the demand of local residents for security and police presence is clearly incressing. The theoretical framework of this thesis is focused on the following: (a) criminological theories based on situational crime prevention and community techniques; (b) the social construction of the tourist destination appearance as a result of its territorial and socioeconomic evolution; and (c) the public policy on citizen security and the role of city police as a community social intervention tool for governance. The fieldwork approach was based on 1,334 questionnaires collected in two surveys. The first one was a directed interview, answered by 651 persons (412 tourists and 239 residents), randomly selected in the study area. The second one, non-directed, voluntarily answered by 683 senior tourists who attended the talks on safety conducted by the City Police in 2016 and 2017. The results provide information on the direct and indirect victimization of senior tourists as well as residents, their feedback on the perceived security, the crime hotspots location and reasons which are generating these perceptions. The research elucidates a bad perception of safety among the residents of Playa de Palma, which is very bad among the residents of S’Arenal under a multi-causal context. Environmental damage, noise, fights and neighborhood conflicts by incivilities, ethnic diversity, together with the lack of public services and facilities and the presence in summer of groups of tourists that disturb public order, are at the base of this loss of quality of life and increase in the perceived insecurity. However, against this negative view from residents, research demonstrates that senior tourism perceives Playa de Palma as a very safe destination, rating it with a very high average mark. The zone that generates greater insecurity among senior tourists is the shoreline between S’Arenal and Spa number 4 due to the presence of specific groups that mainly are practicing thimblerig and street sell. The asynchrony between senior tourism travels and the summer peak, when occurring more incidents, as well the daily and routine activities that these senior tourists develops in Playa de Palma determines a low level of risk exposure and a favourable perception of security. Tourists and residents perceive the City Police as a key element in public security policy and demand their presence as an external element of community control. The perception of security would be greatly improved if the businesses that attract drunken tourism disappear, a segment that is incompatible with the quality improvement strategy in which the private sector has clearly been implicated and which harms the [30] efficiency of the investment efforts, threatening the new tourist development model at the Playa de Palma. catalaAquesta investigacio explora la percepcio que els turistes seniors tenen de la seguretat a la Platja de Palma (Mallorca) front a la percepcio de la poblacio resident. La Platja de Palma es un desti turistic de sol i platja en proces de transformacio, la imatge del qual s’ha vist afectada per activitats il·licites i comportaments incivics que difonen els mitjans de comunicacio i que contribueixin a degradar la imatge del desti turistic, a la vegada que creix la demanda de seguretat i de presencia policial a la zona per part de los residents. El marc teoric de la investigacio te tres eixos: les teories criminologiques basades en la prevencio de la situacio i les tecniques comunitaries; la construccio social de la imatge del desti turistic com a resultat de la seva evolucio territorial i socioeconomica i, finalment, la politica publica en materia de seguretat ciutadana i el paper de la Policia Local com a instrument de la intervencio social comunitaria per a la governabilitat. Nogensmenys, davant d’aquesta visio negativa dels residents, la investigacio demostra que el turisme senior percep la Platja de Palma com un desti molt segur, la qual valora amb un notable alt. La zona que genera major inseguretat entre els turistes seniors es la primera linia entre s’Arenal i el balneari 4, a causa de la presencia de grups que practiquen «trile» i venda ambulant, principalment. La forma asincronica amb la que viatja el turisme senior respecte del maxim estival, durant el qual es produeixen gran nombre d’incidents, i les activitats diurnes i rutinaries que realitza a la platja de Palma determina un baix nivell d’exposicio al risc, la qual cosa condiciona una percepcio favorable de seguretat. Turistes i residents visualitzen la Politica Local com a un element clau en la politica publica de seguretat i reclamen de la seva presencia com a element extern de control de la comunitat. La percepcio de seguretat milloraria ampliament si desapareguessin els negocis que atreuen el turisme de gatera, un segment que resulta incompatible amb l'estrategia de millora de la qualitat amb la qual s’ha compromes clarament el sector privat i que [29] perjudica l’eficiencia de la inversio realitzada i compromet el nou model de desenvolupament turistic de la platja de Palma.
