Abstract: O presente trabalho consiste no estudo acerca da figura do magistrado no imaginário jurídico-literário, a partir do movimento do direito e literatura. O problema a que se pretende responder decorre de como a figura do juiz é percebida nas discussões e possibilidades existentes da aproximação da teoria do direito e da literatura. O objetivo estabelecido para esse estudo é analisar o personagem do juiz no imaginário jurídico-literário, em aspectos teóricos pertinentes, seus modelos e o poder discricionário na função de julgar. A metodologia adotada será a pesquisa qualitativa, de viés sócio-jurídico.

Abstract: This article aims to study the discussion on reproductive rights and people with disabilities in utilitarian bioethics. The problem is how the tradition of utilitarianism, represented in contemporary times by the philosopher Peter Singer, understands the lives of people with disabilities in the context of scientific and biotechnological advances. The objective is to reflect on the utilitarian positioning of the thinker Peter Singer and its implications on the bioethical discussion of reproductive rights in relation to the life and existence of people with disabilities. It will be adopted the adopted methodology of research will be methodology adopted will be the socio-legal research of qualitative bias.

For this purpose, the text will refer to human mythological constructions and their relations with rites as a way to diminish human anguish and uncertainty. The discussion will focus on the image of the judge and the play “The Wasps” by the Greek author, Aristophanes, written in 422 b.C., highlighting its “mythological” importance for the debate about the present legal system.Key words: myth, rite, judge, literature, conflict resolution.
