Abstract: This paper constructs several objective indicators of regulatory intensity in the context of the Spanish decentralization since 1978. Our aim is to develop a quantitative measure of the levels of regulatory intensity set by different regions in Spain. The dynamic nature of the decentralization process requires that we take into account the initial institutional framework for decentralization and the successive transfers of powers to the regions. As a result, we obtain a series of variables that measure regulatory intensity across Spanish regions in the period 1978-2009.

Abstract: This paper estimates the average effect of regulatory intensity and administrative redtape on productivity and innovation. For this purpose we exploit the exogenous variation of the decentralization process that has taken place in Spain during the last three decades. Using objective proxies for legislative and regulatory activity such as the number of pages and number of new norms published in the regional legislative reporters we find a strong negative impact of regulatory intensity on regional innovation and productivity. This negative effect of regional regulation is not only statistically significant but also of large economic importance and can explain the absence of productivity growth of Spain in the last decades. Finally, we provide evidence that regulatory intensity has affected the size distribution of establishment reducing its skewness and therefore affecting asymmetrically more those establishments that are more likely to innovate.

Abstract: Inherent Defects Insurance (IDI) for new housing buildings is mandatory in Spain since May 2000 The instauration of this legal requirement prompted an upsurge in the IDI market Being confronted with wild competition, the major insurance carriers active in that market promoted a minimum price agreement involving also IDI reinsurers The role of reinsurers was key in propagating the effectiveness of the minimum price agreement all over the market This article examines the features of the Spanish IDI cartel, uncovered by the Spanish National Competition Commission in 2009 The companies involved were punished with the largest fine ever imposed by competition authorities in Spain However, potential damage claims by cartel victims may face several hurdles Some of them are related to some specific features of the cartel itself, others have to do with the reluctance to damage claims for competition violations in Spain
