Perlindungan hak asasi anak jalanan dalam bidang pendidikan menurut hukum nasional dan konvensi internasional

Abstract: Anak jalanan bagaimanapun telah menjadi fenomena yang menuntut perhatian semua pihak. Adanya hal tersebut penelitian ini mengangkat permasalahan, yaitu: Pertama, Bagaimanakah wujud dan kualifikasi pelanggaran HAM anak bidang pendidikan, Kedua, Bagaimanakah upaya dan perlindungan hak Asasi Anak jalanan dalam bidang pendidikan. Metode Kajian yaitu Metode yuridis-normatif dengan cara mengkaji perundang-undangan nasional dan konvensi Internasional yang berhubungan dengan hak asasi anak dalam bidang pendidikan. Hasil Penelitian menunjukkan wujud pelanggaran hak asasi anak jalanan dalam bidang pendidikan merupakan tindakan pengabaian oleh pemerintah dan termasuk kategori violence by omission yang dapat dipertanggung jawabkan secara yuridis kepada pemerintah sebagai pertanggungjawaban dalam bidang hukum.

Urgensi peran serta masyarakat dalam upaya pencegahan dan pemberantasan tindak pidana korupsi

Abstract: Kejahatan Korupsi telah mengakibatkan kehancuran bagi perekonomian bangsa. Artikel ini bertujuan untuk mengkaji peran serta masyarakat dalam upaya pencegahan dan pemberantasan Tindak Pidana Korupsi. Metode penelitian dalam artikel ini adalah penelitian hukum normatif yang bersifat preskriptif analitis, melalui conceptual approach, statute approach, dan case approach. Hasil penelitian menyimpulkan bahwa : pertama, peran masyarakat harus turut serta dalam upaya pencegahan dan pemberantasan tindak pidana korupsi dengan alasan bahwa masyarakat sebagai korban dan masyarakat sebagai komponen negara. Kedua, bentuk peran serta masyarakat dalam upaya pencegahan dan pemberantasan tindak pidana koruosi adalah dengan mempedomani ketentuan peran serta masyasrakat sebagaimana telah diatur pada perundang-undnagan dengan melakukan kontrol sosial yang direncanakan maupun yang tidak direncanakan untuk mendidik, mengajak atau bahkan memaksa para warga masyarakat agar menyesuaikan diri dengan kebiasaan dan nilai kehidupan masyarakat yang bersangkutan.

Penerapan Teori-Teori Kriminologi dalam Penanggulangan Kejahatan Siber (Cyber Crime)

Abstract: Artikel ini membahas masalah penanggulangan kejahatan siber (cyber crime) melalui pendekatan teori-teori kriminologi. Hal tersebut penting untuk memahami kejahatan siber dari segi karakteristik kejahatan dan penjahat. Metode penelitian yang digunakan yakni metode penelitian yang bersifat yuridis-empiris. Hasil penelitian menunjukkan bahwa terdapat empat teori yang dapat digunakan menganalisis kejahatan siber (cyber crime), yaitu anomi, asosiasi diferensial, kontrol sosial, dan netralisasi. Teori tersebut dapat digunakan sebagai strategi pencegahan dan penindakan kejahatan siber (cyber crime) sebagai kejahatan yang dihasilkan melalui interaksi anggota mayarakat memerlukan penanganan serius baik oleh masyarakat, penegak hukum dan perumusan perundangan-undangan. Agar kebijakan memerangi kejahatan siber (cyber crime) tepat guna dan berhasil guna, maka para pihak perlu memperhatikan hasil kajian cyber crime dari perspektif kriminologi. This article discusses the problem of cyber crime through the approach of criminology theories. It is important to understand cyber crime in terms of the characteristics of crime and criminals. The research method used is research method that is juridical-empirical. The results show that there are four theories that can be used to analyze cyber crime, namely anomy, differential association, social control, and neutralization. The theory can be used as a cyber crime prevention and crime prevention strategy as a crime generated through the interaction of members of the community requires serious handling by the community, law enforcement and the formulation of legislation. In order for the policy to combat cyber crime to be effective and effective, the parties need to pay attention to the results of the cyber crime study from the perspective of criminology.

Legal Implication of Black Campaigns on The Social Media in The General Election Process

Abstract: This study aims to examine the problems of black campaign on social media in the process of Regional Leader elections. The method used was a normative legal research with a qualitative approach to analyze the phenomena among the objects of the study with a conceptual and a case approach. The result indicates that the legal implication of the black campaign on the conduct of Regional Leader elections is that black campaign is not an option in politics. In addition to comprising detrimental things and violating the norm, black campaign also leads to poor political education for the society and can harm both the objects that are imposed and the black campaigners as this matter can be subject to criminal sanctions as stipulated in the Law of Election and Electronic Information and Transactions. For further research, there is a need for serious handling through criminal law and other facilities so that the implementation of elections to the regions as the actualization of democracy in Indonesia results in more valuable quality so as to create trustworthy Regional Leaders Keywords: Regional Head Election; Black Campaign; Social Media.

The Corruption Investigation In The Regional Police of Riau Islands, Indonesia

Abstract: This research aim to analyzes the authority of the Regional Police of Riau Islands in a criminal act of corruption investigation. The method used is normative-empirical research. The results found that investigation of criminal corruption in Regional Police of Riau Islands conducted according to the authority of police investigators. In addition to proving the deeds of perpetrator, criminal investigation of corruption is also a means of restoring the state's financial losses as much as possible. In its implementation, corruption criminal investigation is influenced by legal factors, law enforcement factors, supporting facilities or facilities supporting law enforcement, community factors, and cultural factor .

Pengaruh Work From Home Terhadap Kinerja Aparatur Sipil Negara Di Kantor Imigrasi Kelas I Khusus Tpi Medan

Abstract: Presiden Indonesia dalam konferensi persnya menginstruksikan kepada seluruh masyarakat agar menerapkan social distancing , yaitu kerja dari rumah, belajar di rumah, dan ibadah di rumah dalam rangka meningkatkan kewaspadaan terhadap penyebaran Covid-19. Terkait hal tersebut, penelitian ini memiliki beberapa fokus, yang pertama adalah untuk mengetahui bagaimana pelaksanaan Work from Home di Kantor Imigrasi Kelas I Khusus TPI Medan. Kedua, apakah ada faktor penghambat dalam pelaksanaan Work from Home di Kantor Imigrasi Kelas I Khusus TPI Medan dan apa pengaruh Work from Home terhadap kinerja Aparatur Sipil Negara. Data yang diperoleh dari hasil penelitian ini diolah dengan menggunakan analisis deskriptif kualitatif dengan mengambil data dari setiap laporan Bagian dan Bidang di Kantor Imigrasi Kelas I Khusus TPI Medan. Selain itu, studi pustaka terkait Work from Home itu sendiri juga dilakukan untuk mengetahui pengaruhnya terhadap kinerja Aparatur Sipil Negara. Hasil yang diperoleh adalah bahwa pelaksanaan Work from Home di Kantor Imigrasi Kelas I Khusus TPI Medan berjalan dengan baik, tidak ditemukan faktor penghambat yang terlalu berarti terhadap kinerja dan kinerja para pegawai tetap terjaga dengan tetap mengedepankan pelayanan prima dan tidak mengesampingkan protokol kesehatan yang ada.

Designing Website-Based Scholarship Management Application for Teaching of Analytical Hierarchy Process (AHP) in Decision Support Systems (DSS) Subjects

Abstract: Teaching Analytical Hierarchy Process (AHP) in Decision Support Systems (DSS) subjects encourages students to know how a good decision is taken. AHP itself in the field of education and teaching has been widely used as an effective and efficient method in solving educational problems. The purpose of this paper is to designing website-based scholarship management application for teaching of Analytical Hierarchy Process (AHP) in Decision Support Systems (DSS) subjects. Scholarship management using AHP is choosing the right criteria is very important. This system uses 5 criteria, namely academic value, academic achievement, non-academic achievement, parents 'income, and parents' dependents, as a basis for producing decision-supporting information. The scholarship management system is embodied in a website-based computer application. Utilizing this application provides more assistance to donors, so that the results of this learning are not only proven in theory but also in practice in real conditions. In addition, the Website-Based Scholarship Management Application can be run on a mobile basis and can be accessed wherever and whenever they are.

Decision support system for smartphone recommendation: the comparison of fuzzy ahp and fuzzy anp in multi-attribute decision making

Abstract: Previous researches outlined the advantages of the Analytical Hierarchy Process (AHP) and Analytic Network Process (ANP) methods in solving Multi-Attribute Decision Making (MADM) problems. The advancement of the above methods was continually developed as an effort to cover up various weaknesses. Mainly related to the consistency and linguistic variables in translating the expert opinions. Thus, it initialized the emergence of Fuzzy AHP (F-AHP) and Fuzzy ANP (F-ANP). Due to the restricted operation of these algorithms in smartphone selection, this research attempted to investigate the effectiveness of both methods in providing the analysis of criteria weight, the final recommendation weight, the product recommendation weight, and the execution time in DSS-SmartPhoneRec application development. A survey of one hundred respondents of University students identified the dominant criteria in selecting the smartphone, namely price, Random Access Memory (RAM), processor, internal memory, and camera. Hence, five alternative products were then chosen as the appropriate smartphones’ recommendations based on the respondent’s preferences. As an automatic tool, a DSS-SmartPhoneRec application was built to analyze and compare between F-AHP and F-ANP methods in resolving the smartphone selection cases. It revealed that the level of consistency of criteria weight, the final weight of recommendation, and the weight that the product-based F-ANP wa s 40% greater than F-AHP. In terms of execution time, F-AHP had a shorter time than F-ANP. Meanwhile, the comparison of products recommendation from DSS-SmartPhoneRec and a manual test showed that F-ANP was 16% more in line with the respondents’ predilection. In a nutshell, the DSS-SmartPhoneRec administered the devote smartphone recommendations based on the user’s expectation. The comparison analysis furnished a learning outcome for the users in determining the appropriate MADM method tailored to the type of cases.

Regional Autonomy in Realizing Good Governance

Abstract: Good Governance in regional autonomy is a phenomenon whose principle is talking about government or good government in terms of realizing good governance through the context of public services. The purpose of regional autonomy is solely to provide satisfaction to the community and prosperity of society in a government area. The purpose of this study is to determine the development of current regional autonomy in realizing Good Governance as intended. The research method used in the preparation of this study is a normative juridical method that is, in answering the problems of the realization of good governance, the legal point of view is based on the applicable legal regulations, henceforth it is connected with the reality in the field relating to the issues to be discussed. In terms of the development of regional autonomy, of course there are several things that are the main indicators, namely Equalization and Improvement of Development in the Regions, Improvement of Services for Communities, Optimization of Natural Resources and Human Resources in the Regions.n

Tantangan globalisasi, peran negara, dan implikasinya terhadap aktualisasi nilai-nilai ideologi negara

Abstract: Artikel ini bertujuan untuk menganalisis pengaruh globalisasi, peran negara, dan implikasinya terhadap aktualisasi nilai-nilai ideologi negara bagi Warga Negara Indonesia. Pendekatan yang digunakan dalam menjawab permasalahan adalah dengan studi literatur, observasi, dan wawancara. Dari hasil data ditemukan bahwa terdapat nilai-nilai globalisasi yang mempengaruhi pola pikir, sikap, dan perilaku sebagian warga negara yang didukung dengan konsistensi, ketegasan, dan penguatan peran pemerintah dalam merawat nilai-nilai kebersamaan. Selain itu juga berimplikasi untuk meredam eskalasi dan kegiatan yang menjurus pada perilaku yang menonjolkan sentiment primordial serta berimplikasi memantapkan persepsi warga negara tentang pentingnya ideologi negara, walaupun tidak langsung mengakselerasi masyarakat mengaktualisasikan nilai-nilai ideology negara secara signifikan. ----- This article aims to analyze the effect of globalization, the role of the state, and its implications for the actualization of state ideology values for Indonesian citizens. The approach used in answering problems is through literature study, observation, and interview. From the results of the data, it found that there are values of globalization that affect the mindset, attitudes, and behavior of some citizens supported by consistency, decisiveness, and strengthening the role of government in caring for the values of togetherness. It also has implications to reduce escalation and activities that lead to behaviors that highlight primordial sentiments and has implications for strengthening citizens' perceptions about the importance of state ideology. However, it does not directly accelerate the community to actualize state ideology values significantly.
