Abstract: Portuguese Abstract: Este livro, originalmente uma tese de doutorado em Filosofia do Direito da UFMG, apresenta a contribuicao de Jurgen Habermas para a discussao do direito na contemporaneidade. Partindo das mudancas profundas operadas na modernidade em relacao ao mundo-antigo-medieval, o livro analisa a tentativa de Habermas de, utilizando elementos da filosofia da linguagem e da etica kantiana, apresentar uma teoria do direito que corresponda as necessidades de uma sociedade pluralista. Em especial, estuda-se a natureza dos principios como normas adequadas para se resolver conflitos dessa sociedade, para se demonstrar ao final que o principio da igualdade nao e incompativel com a diferenca de tratamento, desde que produza maior inclusao social. (trata-se de livro esgotado e a editora nao mais existe)English Abstract: This book, originally a PhD dissertation in Philosophy of Law (UFMG – Brazil), studies the contribution of Jurgen Habermas to the contemporary concept of Law. Departing from the differences between ancient-medieval and modern societies, the book analysis Habermas's intent to conceive a contemporary theory of Law that fits to pluralistic societies, and how he connects Kantian ethics and Philosophy of Language. This work holds that legal principles are norms that are adequate (or inadequate) to solve conflicts in a pluralistic society, and that the Principle of equal protection under law doesn't curb variable treatment in different situations, since it enforces greater social inclusion.

Abstract: Portuguese Abstract: Este artigo pretende apresentar as diferencas entre o conceito de principio juridico de Robert Alexy e o conceito de Ronald Dworkin, para demonstrar que este ultimo e mais apto a compreender a natureza binaria do direito. Com base nisso, e na teoria da adequabilidade de Klaus Gunther, pretende-se definir os principios juridicos como principios que nao regulam as condicoes de sua propria aplicacao. English Abstract: This paper intends to present the difference between Robert Alexy’s and Ronald Dworkin’s conception of legal principles, holding that Dworkin’s one is more suitable to grasp Law’s binary nature. Thus, and using Klaus Gunther’s concept of Angemessenheit (adequacy), we understand that legal principles do not rule the conditions of their own applicability.

Abstract: Portuguese Abstract: Apesar de o libertarianismo defender uma concepção de justi- ça segundo a qual o Estado só pode atuar corretivamente, há dificuldade em colocar essa concepção em prática, pois, de acordo com estudos de análise econômica comportamental, o ordenamento jurídico influencia inevitavelmente o comportamento das pessoas, mesmo sem coerção. As conclusões apresentadas por esses estudos trazem problemas para a ideia do homo economicus, tão cara ao libertarianismo. Contudo, esse problema adquire outro contorno quando consideramos a ideia de um paternalismo libertário, que procura incitar as pessoas a se comporta- rem de maneira a melhorar seu bem-estar, conforme seus próprios cri- térios, garantindo-lhes, porém, a liberdade de escolha. O paternalismo libertário não destoa das premissas do libertarianismo porque, embora pretenda promover o bem-estar das pessoas, não lhes restringe a liber- dade de escolha. No contexto brasileiro, pensamos ser possível que o Es- tado intervenha de forma paternalista e libertária no campo econômico, agindo por meio de indução, nos moldes da proposta de Eros Grau. English Abstract: Although the Libertarian Theory provides a Justice conception in which the State can only act correctively, there is some difficulties to forward this theory in actual situations, since, according to behavioral economics analysis, the Law influences people behavior in such an unavoidable way, even without Law enforcement. The results presented by such researches criticize the notion of homo economicus itself, so important to Libertarianism. The trouble is however overruled when one takes in consideration the idea of Libertarian Paternalism, which lets the people behave in order to improve their welfare, according to their own standards, providing nevertheless their freedom to chose whatever they find to be the best for them. Thus, the Libertarian Paternalism doesn't seem to deviate from Libertarianism at all, since, on one hand, although it advances the people's welfare, on the other hand it doesn't restrict their free will. In Brazil, it seems to be possible that the State intervene in a paternalistic way according to libertarian economic standards if it nudges the citizens in such a way as suggested by Eros Grau in his work.

Abstract: NUDGE: IMPROVING DECISIONS ABOUT HEALTH, WEALTH, AND HAPPINESS by Richard H. Thaler and Cass R. Sunstein Penguin Books, 2009, 312 pp, ISBN 978-0-14-311526-7This book is best described formally as a general explanation of and advocacy for libertarian paternalism, a term coined by the authors in earlier publications. Informally, it is about how leaders, systems, organizations, and governments can nudge people to do the things the nudgers want and need done for the betterment of the nudgees, or of society. It is paternalism in the sense that "it is legitimate for choice architects to try to influence people's behavior in order to make their lives longer, healthier, and better", (p. 5) It is libertarian in that "people should be free to do what they like - and to opt out of undesirable arrangements if they want to do so", (p. 5) The built-in possibility of opting out or making a different choice preserves freedom of choice even though people's behavior has been influenced by the nature of the presentation of the information or by the structure of the decisionmaking system. I had never heard of libertarian paternalism before reading this book, and I now find it fascinating.Written for a general audience, this book contains mostly social and behavioral science theory and models, but there is considerable discussion of structure and process that has roots in mathematical and quantitative modeling. One of the main applications of this social system is economic choice in investing, selecting and purchasing products and services, systems of taxes, banking (mortgages, borrowing, savings), and retirement systems. Other quantitative social choice systems discussed include environmental effects, health care plans, gambling, and organ donations. Softer issues that are also subject to a nudge-based approach are marriage, education, eating, drinking, smoking, influence, spread of information, and politics. There is something in this book for everyone.The basis for this libertarian paternalism concept is in the social theory called "science of choice", the study of the design and implementation of influence systems on various kinds of people. The terms Econs and Humans, are used to refer to people with either considerable or little rational decision-making talent, respectively. The various libertarian paternalism concepts and systems presented are tested and compared in light of these two types of people. Two foundational issues that this book has in common with another book, Network of Echoes: Imitation, Innovation and Invisible Leaders, that was also reviewed for this issue of the Journal are that 1 ) there are two modes of thinking (or components of the brain) - an automatic (intuitive) process and a reflective (rational) process and 2) the need for conformity and the desire for imitation are powerful forces in human behavior. …

Abstract: This study has as objective researches the criteria of the evaluation of projects in the social entrepeneurship, for they be used by organizations of the third section. The evaluation of enterprising projects is an extensive theme, mainly when it is social projects, being rendered to several approaches, however so that the evaluation becomes an effective tool of administration, it is necessary that is analyzed in that context this is accomplished. So that we have an emphasis of professionalization of the nonprofit organizations, the efficiency of the results of the projects is of highest importance, and for that we have to treat these projects in an enterprising way, in other words, using criteria and subcriterios of the elaboration of appropriate methodologies of the projects for the formulation and evaluation of these, in the search of the efficiency so much in the allocation, as in the excellent of the resources. The change of paradigms and “mental models” of the nonprofit organizations is necessary for it is had effective conditions of implementing a planned evaluation model in a rationalized way, it compacts and it aims at, in relation to definition of the focus, the formation of the team, to the interested ones primary, to the rising and interpretation of information and to the reports and the spread of these, this everything with the mark of forming social managers capable to elevate the efficiency of the politics, programs and social projects, for the improvement of the quality of life of the population. Abstract: Partindo da indenizacao por abandono afetivo, analisam-se neste texto duas perspectivas sobre o afeto: o sentimento e o dever de cuidado. A revisao das duas correntes leva a necessidade de fundamentar uma nova perspectiva que acolha a complexidade das relacoes familiares contemporâneas: o afeto enquanto vinculo constitutivo e distintivo da entidade familiar. A afetividade passa a ser entendida como o elemento necessario a constituicao de familia e a distincao desse tipo de relacao frente a outras. Serao analisadas as teorias da causalidade adotadas no Brasil e na Italia, para avaliar a que melhor se aplica ao caso mencionado. Distinguem-se tambem os danos moral e existencial, para verificar qual deles e incidente em situacoes de abandono parental. Numa abordagem interdisciplinar, reavalia-se o principio da afetividade e sua abordagem no ordenamento juridico atual. Conclui-se que a subjetividade do afeto e inelidivel e, por si mesmo, nao pode constituir elemento gerador de direitos ou deveres. Postula-se entao que os componentes de um grupo social tem autonomia para reconhecer o afeto como constituinte de sua relacao, atribuindo-lhe constância tal, que se expresse no desejo mutuo de manter sua pertenca e fortalecer sua vinculacao reciproca. Esse ato de nomeacao pelo qual tal grupo, em razao de seu afeto, se percebe como familia e uma forma de objetivacao suficiente para que o direito recupere, no afeto autodeclarado, seu objeto de intervencao.

For this purpose, was used the methods’ response technique regarding two questions about interpretation of law: deontology x teleology and restriction x freedom of interpretation.

Abstract: RESUMO O presente artigo tem como objetivo geral analisar, primeiramente, o modo como se deu a regulacao juridica da inclusao social de pessoas com deficiencia no ensino regular, buscando, em seguida, especificar a problematizacao na questao do acesso ao ensino superior. Para tanto, um possivel conceito de inclusao sera estudado, em especial a partir de uma perspectiva habermasiana. Por fim, sera defendida a tese de que a inclusao de pessoas com deficiencia no ensino superior passa mais por novas politicas educacionais e praticas pedagogicas, do que propriamente pela ampliacao de um rol de documentos normativos. Metodologicamente, a pesquisa realiza um levantamento das legislacoes relativas ao tema no Brasil, a partir de uma metodologia analitico-descritiva, de modo a permitir que passemos a um metodo critico-hermeneutico quando da analise da ideia de inclusao no ensino superior. PALAVRAS-CHAVE : Direitos Fundamentais; Direito a educacao superior; Inclusao; Pessoas com deficiencia. ABSTRACT This article has as main objective to analyze, initially, how happened the legal regulation of social inclusion of people with disabilities in ordinary education, searching, then, to specify the questioning on the issue regarding the access to higher education. Therefore, a possible concept of inclusion will be studied, especially from a Habermasian perspective. Finally, there will be argued the thesis that the inclusion of people with disabilities in higher education demands more for new educational and pedagogical policies, than for new normative documents. Methodologically, the research makes a survey of the laws on the subject in Brazil, from an analytical-descriptive methodology, in a way to allow us to move to a critical-hermeneutic method when analyzing the idea of inclusion in higher education.
