Abstract: Intellectual Property (IP) is increasingly recognised as a paramount intangible asset influencing the value of companies, as well as their corporate strategies and management This paper focuses on the impact of implementing Industry 40 (I40) on the management of IP in collaborative inter-organisational interconnected networks Such interconnected networks will allow groups of companies, often competitors and/or customers, to share data and to collaborate in the design, development and manufacture of complex products and/or services, exchanging large amounts of proprietary technical data Furthermore, this paper explores how companies can benefit from the interconnected network capabilities, whilst protecting them from any risks regarding the vulnerability of IP assets to misappropriation, unauthorized use or leakage The focus of this study is the UK manufacturing industry, where formal contractual tools are being deployed to support IP management in collaborative projects It relies on an in-depth study of IP management practices in the UK manufacturing supply chain to critically assess the current state of practice in order to provide answers to the risks emanating from IP management in this new and complex collaborative setting This paper concludes that IP and contractual tools deployed in this new environment must be underpinned by the business strategy and the business model In addition, changes to organisational structures are necessary to bring together functions that typically operate in silos in many manufacturing businesses, namely: Engineering, Information Technology, Commercial and Legal Departments

Abstract: This article analyses the concept of economics applied to law in order to understand the school's analysis of legal phenomena by economic principles that emerged in 1960 in the United States of America, tracing the impacts on intellectual property law in the Common Law system. This study relies on the hypothetical-deductive method, with a focus on economic and legal literature, to conclude that intellectual property legislation is frequently modernized, especially at the time of major socio economic transformations such as an industrial revolution with the effect of boosting development and innovation, ensuring economic growth with the proper security and protection of industrial secrets and expertise.

Abstract: Based on the effectiveness of the guarantees of legal certainty, predictability and fairness, this article analyzes the main contributions of the Code of Civil Procedure (Law 13.105 / 2015). With this scope, we introduce initial considerations of some statistics on the increase of the litigation in Brazil and the phenomenon of judicial subjectivism; to explore some of the most relevant mechanisms brought by the CPC that contribute significantly to the construction of a legal environment based on the principles of legal certainty, stability and equality; with clear inspiration in the common law, especially in the English system. This study used the hypothetic-deductive method, based on the literature, the legal system and jurisprudence.

Abstract: As technology continues to evolve at an exponentially increasing pace, it transforms our lives and societies, thus shaping our perceptions of reality with high velocity and impacting the relationship between the individual, the society, and the legal system. The young area of law known as IT Law is attempting to explore the effects of new technologies in our relationships with the law, as well as, identify the best use new technologies to reduce the gap between new technology, new societal behaviours and various legal systems. Therefore, this article aims to make a contribution to the debate by introducing and describing the current use cases of wearable technology in Europe, legal issues that have been exacerbated by these emerging technologies. The article concludes that in order to mitigate the risk of erosion of personality rights new technology and innovation must to be integral components of the legal system in the future. Abstract: What makes organizations so similar? We contend that the engine of rationalization and bureaucratization has moved from the competitive marketplace to the state and the professions. Once a set of organizations emerges as a field, a paradox arises: rational actors make their organizations increasingly similar as they try to change them. We describe three isomorphic processes-coercive, mimetic, and normative—leading to this outcome. We then specify hypotheses about the impact of resource centralization and dependency, goal ambiguity and technical uncertainty, and professionalization and structuration on isomorphic change. Finally, we suggest implications for theories of organizations and social change.

Abstract: Code and Other Laws of Cyberspace. Lawrence Lessig. New York: Basic Books, 1999. 230 pp. $21 hbk. Lawrence Lessig's Code and Other Laws of Cyberspace is perhaps the most original book yet written about cyberspace law. With an accessible style that is rich in anecdotes and metaphors and surprisingly low on legal and technical jargon, Lessig, a constitutional law scholar at Harvard and a consultant on the Microsoft antitrust case, writes for a wide scholarly audience. Even more than the recent The Control Revolution (New York: Century Foundation, 1999) by Andrew Shapiro, Lessig has managed to write about a rapidly evolving subject at a level of abstraction and theoretical sophistication that ensures that his contribution will long remain relevant. Central to Lessig's theoretical framework is his breakdown of four modalities of regulation: law, economic markets, norms, and an intriguing category he calls "architecture." Architecture includes constraints that the natural world imposes or that people construct-for example, speed bumps on roads. The architecture in cyberspace is computer code: code constructs the cyber-world. Consider the example of pornography regulation. Lessig contrasts how these four modalities of regulation control access to pornography in "real space" and in cyberspace, vividly demonstrating why a simple translation of existing law from "real space" to cyberspace is often impossible. In real space, pornography is extensively regulated through all four modalities, in ways that limit children's access to it. Laws require that vendors sell pornography only to adults. Markets prevent children from accessing pornography because it costs money. Norms help limit children's access to pornography, both by stigmatizing pornography and stigmatizing dealers who would sell it to children. In the category of real space "architecture," there is the simple matter of how a child is: even if a child attempted to disguise himself as an adult, he would probably notbe successful at fooling a salesperson. These four kinds of constraints may be imperfect, but are reasonably effective in limiting children's access to pornography in real space, Lessig contends. In cyberspace, however, the modalities of regulation of pornography operate differently and less effectively. Law is unsettled. Markets are different in at least two ways: distribution of digital files is much cheaper than distribution of printed material or videos, and though there are plenty of commercial pornography sites, much pornography can be accessed at no cost through newsgroups. Differences in the "architecture" of cyberspace are crucial because they allow faceless transactions. Faceless transactions may make disguising identity and age simple, therefore allowing a child to avoid the restrictions of law and norms. Thus the "real space" regulatory regime is upset, making pornography generally more available to children in cyberspace. Ways of filtering content or zoning the Internet are now extensively debated, but no simple transfer of the offline constraints to cyberspace seems possible. Abstract: O direito a saude se configura entre os direitos mais importantes, na medida em que ele se faz necessario para a preservacao da propria vida humana, alem de encontrar intima ligacao com o principio da dignidade da pessoa humana. Todavia, o cenario atual demonstra um grande descaso estatal com relacao a efetivacao desse direito, que acaba gerando, entre outras consequencia, a ocorrencia da mistanasia, ou seja, a antecipacao da morte de uma forma miseravel e sofrida. Deste modo, o artigo tera como problematicas, os questionamentos sobre: qual a importância da efetivacao desse direito a todos? como a mistanasia ainda permanece invisivel nos debates juridicos e sem uma responsabilizacao ao agente violador? como esse fenomeno pode vigorar como forma de exclusao social institucionalizada das camadas pobres e extremamente pobres?. Assim, tem-se como objetivo geral fazer uma analise critica da eutanasia social como fruto da ineficiencia estatal e como fenomeno institucional de exclusao da camada populacional abarcada pela pobreza extrema, e de modo especifico, objetivara fazer uma analise acerca do direito a saude e da sua relacao com a dignidade da pessoa humana e com os direitos da personalidade e da necessidade de sua efetivacao por parte do Estado, para posteriormente ser possivel analisar a mistanasia de forma critica, e como tal fenomeno pode se mostrar como fator de exclusao social principalmente das camadas mais pobres da populacao. Para tanto, se utilizara o metodo hipotetico-dedutivo e a metodologia de revisao bibliografica.

Abstract: O presente ensaio trata do chamado “incidente de resolucao de demandas repetitivas”, que esta esculpido no substitutivo do proposto projeto do novo codigo de processo civil. Observa-se que foi pelo ato no 379, de 2009, do presidente do Senado Federal, que foi instituida a comis- sao de Juristas, sendo que o atual ministro do Supremo Tribunal Federal, Luiz Fux, foi intitulado como presidente, encarregada de elaborar o An- teprojeto do Novo codigo de Processo civil. Assim, em carta dirigida ao Senado, onde ha a exposicao dos motivos para criacao do proposto codigo de Processo Civil, se evidenciou a influencia tedesca no aludido incidente. No direito alemao, a figura se chama Musterverfahren e gera decisao que serve de modelo (= Muster) para a resolucao de uma quantidade expressiva de processos em que as partes estejam na mesma situacao, nao se tratan- do necessariamente, do mesmo autor nem do mesmo reu. com efeito, o proposto instituto brasileiro esta alimentando a esperanca de combater a massificacao de processos judiciais que assolam o pais (procura-se fazer a analise das concausas do elevado numero de processos que sao ajuizados diariamente no Brasil). Entretanto, atraves da analise procedimental se evi- denciou que o instituto nao pora fim a referida massificacao. Verifica-se, portanto, que o intuito da comissao elaboradora nao foi o de criar instru- mento capaz de impedir o ajuizamento de novas demandas repetitivas. Nao prospera o entendimento de que o incidente, de resolucao de demandas repetitivas “evitara a multiplicacao das demandas”. Por outro lado, o in- tuito primordial do incidente e de criar uma uniformizacao de entendimen- to entre os tribunais, para que se aplique, da mesma forma, em diversas demandas, a tese pacificada no julgamento do instituto. Por derradeiro, constata-se que, embora cada direito estrangeiro tenha especificidades pro- prias, e no direito comparado, mais especificamente no norteamericado, que se encontra notavel instituto (class action) que pode ser incorporado ao sistema brasileiro para aperfeicoamento da tutela coletiva de direitos.
