Abstract: Alienation of land for public purposes in the case of building of transport infrastructure object is studied. Contradictory aspects of the coordination with the landowners are given. Building of the Great Ring Road around the Kyiv, which should solve the traffic problems in Kyiv, Boryspil, Brovary and unload the capital of Ukraine on the large flow of transit traffic, is considered. The structure and legal status of the land that are necessary for building of the road are analyzed. Project areas are investigated. Exchange of land as a form of compensation for the alienation of land for public purposes is considered. Possibility of introducing the exchange of land in the project areas is offered for example of the reconstruction of the Great Ring Road around the Kyiv. Areas that are fully subject to alienation or use of which is not possible for the following project are considered. Calculation of equivalent land in exchange for the traditional formula that allows to determine the size of equivalent land according to the values of ratios for soil quality. Improved formula for calculating the area of exchanged agricultural land taking into account configuration, brokenness of the boundaries, land relief is used for comparison.

Abstract: Дослідження присвячене актуальному питанню перерозподілу земель у складі заходів щодо консолідації земель. Виокремлена проблематика пошуку територіальних резервів, які можуть створити просторову основу перерозподілу земель. Метою дослідження є виокремлення та обґрунтування територіальних резервів, які можуть бути залучені до процесу консолідації земель. Розглянуто землі, які з’являються в результаті просторової оптимізації земельного масиву або землекористування, земельні ділянки, викуплені у землевласників за їх бажанням, землі резерву та запасу, земельні ділянки, які відносять до невитребуваних паїв та відумерлої спадщини.

Abstract: З метою вирішення проблеми недостатньої лісистості території дедалі частіше розглядаються самозаліснені земельні ділянки сільськогосподарського призначення. Проте, питання залучення таких земельних ділянок, якщо вони знаходяться у приватній власності, на своєму шляху має низку проблемних аспектів, зокрема, у випадку відчуження з наступною їх передачею до земель лісового фонду.

Abstract: The preconditions and general directions of inter economic land surveying in the modern conditions of Ukrainian in accordance to the perspectives of peer land exchange implementation have been analyzed. The measures, implementation of which is advisable based on peer land exchange as the key mechanism have been singled out and substantiated. According to the current legislation of Ukraine, the main types of documentation for land management, which may provide the peer land exchange are defined. Land exchange is a common way of streamlining existing land ownership and land use in domestic and foreign practice. In particular, an equivalent exchange is often aimed at regrouping a significant amount of land use in order to optimize their structure. At the present time, the coordination of the interests of landowners in the process of optimizing the multitude of land uses of settlements is of particular relevance. For example, there is a need to locate facilities that have environmental and social significance, improvement and changing boundaries of land management objects at different levels. In the context of certain tasks, given the legally defined issue of exchange agreements concluding, the settlement of the land exchange process requires a technical justification.

Abstract: The article formulates the problematic issues of determining the purchase price of land plots that are subject to alienation for public needs or for reasons of public necessity in Ukraine. It is possible to single out the main problems of a legal nature – the Law provides for two types of value that must be determined during the procedure of redemption for public needs: estimated purchase price and purchase price. The following stages of the procedure for the purchase of a plot of land for public needs in Ukraine are distinguished: planning and decision-making, notification of all interested parties, assessment and negotiations regarding compensation, purchase and sale agreement and payment of compensation, entry into ownership, return. The issues of buying or exchanging land plots from owners for public needs have always been problematic and conflictual. it was established that the legislation of Ukraine meets the international requirements for the regulation of relations in the field of forced purchase of land for public purposes, but it does not regulate: the type of value and methods of assessment of land plots (parts of them); calculation of damages related to environmental degradation and standard allowance. An expert study was conducted to determine the type of cost and compensation in case of forced expropriation, approaches to calculating possible damages. The total number of experts participating in the survey was 75. Estimated average work experience for experts is 10 years. The interviewees' awareness of the questions was conditionally considered equal. 97% of the respondents noted that there should be additional compensation and reimbursement for losses to the owners of real estate (except land plots) in case of redemption for public needs. Experts determined that additional compensation and compensation for losses to land plot owners should be within 30-50% of the value of the land plot and real estate objects located on it. Taking into account the expert opinion, the structure of damages is proposed, which should be included in the purchase price, which includes: costs of moving, preparation of documents, costs of arranging a new home, compensation for taxes and fees during the purchase of an alternative object of real estate, the cost of fruit and berries plantations and crops.
