The thesis is devoted to general theoretical research of the European Union Citizenship as a political and legal phenomenon, that reflects the specifics of the legal status of a person in terms of the European integration.
The preconditions of introduction of the Union citizenship are determined and periods of its development are provided. The legal nature of the EU citizenship as a multifaceted category is lied down. The peculiarities of this institute, which distinguish it from national citizenship of the state and allow characterizing it as a new type of citizenship (sui generis) are determined. The scope of certain rights of the European Union due to the principles of the EU citizenship, EU legal acts and their interpretation in the case law of the EU courts is established. The particularities of the mechanism of ensuring the rights of the EU citizens on the supranational and national levels are determined. General trends of the institute of the EU citizenship development due to the case law of the Court of Justice are ascertained.

This paper is a continuation of publication of the «Jurisprudence» textbook by Svetlana Vladimirovna Boshno. Law system is a key element of general theory of law. The major fundamentals of its construction are subject matter and method of legal regulation. Of great importance is the division of legal regulation methods into mandative and dispositive ones. The paper articulates the concepts of institute and branch of law demonstrated through various examples. An important classification of branches of law is separation of procedural and substantive, public and private branches of law. Law system and legislation system are considered as interrelated categories that correlate as content and form. A necessary tool for using voluminous legislation is systematization in the following forms: codification, consolidation, incorporation. Codification is considered as a type not only of systematization, but of law-making, too. The reason for this is that in the process of codification, a law-making body makes changes of legislation, as a result of which a new document – a statute, is adopted.

INTRODUCTION To date, the science of administrative law has not formed a consensus and has not developed a unified position regarding the concepts of “administrative procedure” and “administrative process”. The scientific discussion about the concept and content of these concepts has been going on for decades. To a greater extent, this dispute is more doctrinal, but in the context of the process of European integration and administrative reform, it acquires practical significance. The current situation is explained by the following reasons: firstly, emasculating the original meaning of the concept of “administrative process” as a judicial process based on a dispute about the law between a citizen and the state, which has generated a number of theoretical problems in science regarding the administrative process 1 , secondly, the differences among scientists are due to uncertainty about the relationship and scope of these concepts as a result of the “narrow” and “broad” concept of the administrative process, which leads to a mixed understanding and hinders the development of a unified approach, thirdly, the imperfection of the administrative and procedural legislation and the lack of legislation on the administrative procedure, and how consequence of the lack of fixing these concepts at the legislative level, which creates legal uncertainty. Bearing in mind that the legal science of “terminology” is attached great importance, since it is based on legislation and enforcement activities of public authorities, it is therefore important at the stage of the study to give due consideration to the question of the relationship between the concepts being studied. Each of them should have strictly defined “conceptually meaningful boundaries”, especially if the problem is at the stage of initial development at the legislative level (we mean the procedure), when the terminological confusion is especially unacceptable, which can lead to further endless discussions, and in practice ‒ additional difficulties.

The correlation of the concepts of administrative procedure and administrative process

In the article the author analyzes the Ukrainian model of administrative procedure, which is enshrined in the Law of Ukraine "On Administrative Procedure" in order to borrow foreign experience – provisions from various European models of administrative procedure and their implementation in the newly adopted law. Recourse to international law in the field of administrative procedure has always been and remains one of the priority ways to improve and develop its own administrative procedure. However, the simple reception of foreign experience will not give the desired result, as it is necessary to take into account national traditions, trends in rule-making and legal understanding. The author believes that you need to borrow ideas, not specific rules. The author chose the most effective and rational foreign models of administrative procedure, in particular the German, Polish and French models, as a reference point for comparison. Using the method fragmentary comparative analysis, attention was focused on the provisions that have already been borrowed and which should be noted in the process of applying the Law of Ukraine "On Administrative Procedure" and possibly amendments to it. The provisions of the following legislative acts are analyzed: the Law of Germany "On Administrative Procedure", the Code of Administrative Procedure of Poland and the Code of Relations between the Public and the Administration of France. The author came to the conclusion that it was the German model of administrative procedure that was adopted as a model and formed the basis for drafting the law. Confirmation is the provisions borrowed by the Ukrainian legislator on the principles of administrative procedure, administrative act, the external law enforcement nature of the procedure. The provisions of the Polish model of administrative procedure, in particular regarding the procedure for appealing an administrative act, are taken into account in fragments. In our opinion, the experience of the French model, which is the most progressive, especially in the application of information and telecommunication technologies in administrative proceedings, has not been taken into account in the Law of Ukraine.
