Abstract: The legal and regulatory considerations that must be accounted for in implementing interstate tele-ICU programs are robust and, in many cases, state-specific. These idiosyncratic state requirements cover topics including professional licensure, credentialing, technology platform restrictions, prescribing prohibitions, informed consent requirements, non-physician supervision requirements, business arrangement restrictions, and more. Furthermore, the legal and regulatory environment governing the provision of telemedicine services is rapidly changing as new laws and regulations are proposed and adopted in numerous states every year. Thus, entities wishing to engage in tele-ICU programming must ensure a full review of, compliance with, and ongoing monitoring of both federal and state-specific laws and regulations affecting the provision of telemedicine services prior to implementing such programming. This chapter serves as a framework for understanding the legal and regulatory environment governing the provision of telemedicine services across state lines in the USA with a brief overview of international tele-ICU outlays. There are useful checklists of common pitfalls and summary recommendations provided at the end of the chapter.
