Abstract: Despues de mas de 10 anos de entrada en vigor de la Ley Organica 5/2000, de 12 de enero, de Responsabilidad Penal del Menor, se hace imprescindible realizar un estudio sobre la reincidencia juvenil en Extremadura, para conocer el impacto de dicho precepto. No cabe duda que uno de los problemas que mas alarma social genera en la poblacion es la delincuencia cometida por los menores con responsabilidad penal. Inicialmente se hace un repaso a la literatura criminologica actual sobre la reincidencia, programas de prevencion, tratamiento a menores delincuentes y la evaluacion de la eficacia de dichos programas. En el presente trabajo, siguiendo la metodologia de otros estudios nacionales como el de Catalunya, analizamos la reincidencia de la delincuencia juvenil en Extremadura, concretamente de las medidas privativas de libertad. Se analizan los expedientes judiciales cerrados de aquellos jovenes que hubieran finalizado una medida de este tipo en el ano 2007 y se realiza el seguimiento de los mismos hasta el ano 2010. En el ano 2007, 115 jovenes cumplieron o estaban cumpliendo una medida privativa de libertad en un Centro de Menores o Permanencia Fin de Semana, de los cuales 63 (57 varones y 7 mujeres) resultaron pertenecer a la muestra final objeto de analisis. Los resultados obtenidos revelan que la tasa de reincidencia es del 52,4%, similar a la de otras Comunidades Autonomas, como Pais Vasco o Catalunya, e inferior a la de Asturias. Otro dato relevante es que un 41,9% de los menores objeto de estudio presentaban antecedentes, por lo que se refleja un comienzo en carreras delictivas acorde con los estudios existentes. La presente investigacion ayuda a conocer la eficacia de los diferentes programas que se aplican a los menores delincuentes que cumplen medidas de internamiento, asi como tambien hace una critica de esta al situarla con una elevada tasa de reincidencia.

Abstract: Change in family relations that took place at the opening of the 21st comporting new paradigms in conceptions of minor is already in progress. These reflections are referred to understanding child legal status capacity that takes into consideration its legal ability from the perspective of dynamic participation in concrete legal relations according to his progressive ability and secures the protection of his rights at the same time. The present article demonstrate the legal concepts of individual, personality and ability are interpreted the legal ability of child individuals is evaluated following that viewpoint. The study outlines the necessity of harmonizing the notion of child and ability for “child’s best interest” in contemporary family low.

Abstract: In this article are analyzed real problems of minor’s vulnerability in Spain and solutions proposed by the Spanish doctrine and the civil and criminal jurisprudence. Some recent research about minor’s real situation in our country and the few effective measures which are contemplated from rules and living policies focused on this weak group are reviewed. Is intended to deepen in hermeneutical clues that should lead the neat and diverse interpretation of this interests connected to the specific facts. The concept is studied from many starting points and it is started from the key concept included in the 10 art. of the Spanish Constitution about the human self-respect and then proceed to point out main elements that should lead fair application of the law by the legal operator. It is also analyzed the auxiliary interpretation criteria to achieve the material justice. These criteria are not normative, are jurisprudential and doctrinal, and serve to make the work of subsumption of the standard in the case and successfully weigh the various circumstances that make a unique case. The superior minor’s interest is a indeterminated legal concept, but this doesn’t mean that must become into a concept with arbitrary valuation or legal insecurity generator. That is why the article is focused on main points that should guide the weighting, such as reasonableness, rationality and proportionality of means and purposes. Is not pretended to regulate the legal operator weighting task, usually the magistracy, but to rule that work and spill some clarity to reach to a fair and reasonable solution fitted to real circumstances of the case when minors are involved.

Abstract: One of the major issues currently being debated around young offenders is that if it is a social or legal problem, since this problem should be considered not from the legal point of view but from the social field, because is not possible that a child is able to be judged when is not an adult and when he or she commits an offense or crime that is nothing else but the product of a generality of problems and events not attributable to him or her. With the current applicable law, instead of helping them, they are repressed, confused and confined what it prevents them to have a proper development.

Abstract: In the present work the center of educational not top education of the art is analyzed on the responsibility by foreign fact or omission, in the cases in which it is necessary to answer. It is a question of the so called indirect responsibility centring on the responsibility of the parents, tutors and persons or titular entities of a Center of educational not top education. The civil responsibility and the minor is approached from a general perspective, then to analyze the civil solidary responsibility of the parents and his regulation, After the Organic Law 5/2000, of January 12, regulatory of the penal responsibility of the minors, to conclude, as final clasp, with the responsibility of the holders of teaching institutions. It has turned out specially interesting to rest on the jurisprudence, so much of the Supreme Court, as the minor jurisprudence called, detailing some concrete cases in which extracontractual has solved the civil responsibility in the area of the minors.

Abstract: Social Network Analysis (SNA) has been applied by the literature in different cases in which it is highlighted the need to create, in certain situations of complex management, stable relations among the stakeholders when these relations are not formal. Therefore, to analyze these relations could improve the management of those public organizations responsible for carrying out public policies for the integration of the Unaccompanied Foreign Minors (UFM). Thus, the objective of this study is to raise the possibility of applying social network analysis with the aim of improving the final integration of UFM in the Spanish society, through the study of all the stakeholders involved in the case of the Valencia Region.

Abstract: El presente ensayo trata sobre los derechos de los ninos y ninas a no ser maltratados y no ser abusados sexualmente en el Peru. A partir del estudio de un grupo de casos recogidos en los anos 90s de un distrito populoso de Lima, y la opinion de adultos que trabajan con ninos, los hechos de dichos problemas son interpretados. Posteriormente estos hechos son analizados de acuerdos a la legislacion internacional y nacional. Se comprueba los limites del derecho, particularmente desde una perspectiva penal o represiva, para abordar estos problemas de los ninos y ninas.
