Abstract: Statistical information and authoritative studies presently available substantiate the effectiveness of seat belts in reducing the number of injuries and deaths, and their attendant rising social and economic costs, caused by motor vehicle accidents. Reactions of courts and legislative bodies to suggestions of mandated use are explored as a preliminary to an analysis of the common law basis for adoption of the seat belt rule. An explanation is presented regarding introduction and application of the seat belt rule under the State of Washington's comparative negligence law.
