Abstract: In the aftermath of 9/11 several European countries intensified their counter-terrorism policy. This article refers to the Spanish response to the terrorist attacks in the USA and Madrid, with special attention paid to the consequences that (illegal) immigrants faced in relation to their rights. This collective is often depicted in public opinion as “folk devils” in the terminology of the Moral-Panics Theory. Using the latter as a model, this paper establishes that the connection between counter-terrorism policy and more restrictive legislation for foreigners is a construction, which is either insufficient or not satisfactorily explained by the social actors who propose it. The result is a policy that limits the immigrants’ liberty without necessarily making the rest safer.

Abstract: Este trabajo encuentra su origen primigenio en la discusion iniciada entre los expertos de nueve paises europeos en el marco de un Seminario internacional. En ese momento inicial se trato de analizar el funcionamiento de los sistemas de justicia de menores de los paises participantes en el debate. Esa primera toma de contacto pudo constatar que se trataba de una justicia de menores que comenzaba a filtrar el discurso general sobre la seguridad de las personas, la prevencion de la delincuencia, de la antisocialidad, la peligrosidad y los riesgos, o el interes por las victimas. De ahi surgio la idea de explorar la influencia creciente de la ideologia neoliberal tanto en el discurso legislativo, como en la practica diaria de la justicia de menores. La hipotesis de trabajo se formulo en los siguientes terminos: “La modificacion del contexto economico, social y cultural en los paises europeos desde los anos 70 y 80 por la influencia de la dominacion de las politicas economicas de corte neoliberal, ?nos permite dar cuenta de las transformaciones del modo de funcionamiento de la justicia de menores de los diversos paises europeos? Para comprobar la hipotesis se formularon ocho indicadores de fondo y cuatro de forma que permitirian, en su caso, identificar la configuracion de un nuevo modelo de justicia de menores, influido por el neoliberalismo y que podriamos denominar como modelo de “gestion de los riesgos”.

Abstract: En este articulo se aborda la discusion que, alrededor del humanismo, ha tenido lugar en el pensamiento penal contemporaneo. Se busca dar respuesta a las criticas de quienes critican al funcionalismo penal sistemico, para lo cual se analiza el contexto filosofico y cientifico que sirve de soporte al debate. Asi, se muestra como el humanismo negativo de corte luhmanniano permite despejar algunos obstaculos epistemologicos presentes en los cuestionamientos en contra del funcionalismo penal.

Abstract: In the last decades of the twentieth century there was an unprecedented surge of anxieties and alarm over erotic experiences involving minors and adults, which has continued as a social and scientific discourse in which these relationships invariably are seen as abusive, harmful, and criminal In this paper, the fundamental characteristics of this discourse, whose basis and pertinence are questioned, are analyzed for their possible iatrogenic effects; ie, those induced by professional intervention, in four key areas of social reality: the erotic dimension of human beings, individual responsibility, the use of penal law as a mechanism of social control, and fostering better relations between the sexes and generations Critical reflection on the social and professional handling of the problem includes the undesirable effects which such treatment may be producing
