Abstract: The article has as a starting point a characterization of the risk society and the impacts that as a consequence of this reality have occurred in criminal law, criminology and criminal politics, with important re-definitions of central principles and categories of these science, that happens in today’s world, with the pandemic generated by the COVID-19 Situation that internally from the countries, has provoked to declare the states of emergencies or alarms, which at the legal level of questions: how can human rights affect? What rights can be limited? How does criminal law intervene? And is that crime an adequate way to protect the legal health of collective health? Giving answers to all these questions constitutes our conductive thread

Abstract: El presente trabajo aborda el problema juridico sobre la dificultad de la delimitacion de la responsabilidad del delegante por actos realizados por el delegatario. Tambien se plantea la necesidad de crear un modelo que evite que la delegacion se convierta en un instrumento que fomente la corrupcion o la ineptitud de los directores de las entidades publicas. Igualmente, en materia penal existe una figura muy util para delimitar la responsabilidad del delegante por actos del delegatario en ambitos de division de funciones: el principio de confianza, segun el cual quien cumple con las reglas de la actividad que esta realizando tiene derecho a confiar en que los demas que participan en la misma tambien lo hagan.

Abstract: This article defines the legal dogmatic figure of command liability in its third category, which is applicable to organized power structures with a strict hierarchical, to delimit its scope and propose alternatives for the resolution of problems of imputation of crimes committed by subordinates of the organization's commanders, such as the superior's responsibility for omission derived from the rules of war.
