Direito e mediação de conflitos: entre metamorfose da regulação social e administração plural da justiça

Abstract
Os ultimos trinta anos testemunharam um desenvolvimento exponencial da mediacao de conflitos. Diversas iniciativas, governamentais ou nao, apontam para esta pratica como uma maneira renovada de tratar tanto a questao do acesso a justica como da regulacao social. Neste cruzamento, a mediacao parece capaz de demonstrar uma transformacao flagrante do individuo, das sociedades e tambem dos poderes publicos no que toca a administracao da justica e o acesso ao “justo” como conceito alargado, uma vez considerada a dimensao cultural em que a construcao da nocao de justica se inscreve. Entre juridicizacao/judiciarizacao e contratualizacao, tendencias a principio contraditorias, individuos e sociedades parecem buscar novas tecnologias ou sabedorias sociais capazes de, ao aliar justica estatal e experiencias civis, fazer face a violencia. PALAVRAS-CHAVES: Mediacao. Regulacao social. Justica. Abstract The last thirty years witnessed an exponential development on the conflict mediation field. Several kinds of initiatives – besides governmental ones – point out this practice as a new way of addressing access to justice and social regulation issues. At this meeting point, mediation is capable to promote noticeable changes of the individual and also of society and state institutions with respect to adjudication and access to “justice” viewed as an expanded concept, once we consider the cultural dimension in which the construction of the notion of justice is inserted. Between legalization/judicialization and contractualization – contradictory trends in theory – individuals and societies try to seek for new technologies or social wisdoms which can face up to violence, by combining civil experience and state justice.
