TL;DR: In this area, criminal law is the paradigm of a regulation at the limit of constitutional legitimacy because of the anticipation of barriers to incrimination, the infringement of the principle of legality in the writing of many categories of offenses, the exacerbation of sentences or the absence of any preventive purpose to the sentences of securing the incapacitation of the criminal as the only objective as mentioned in this paper.

TL;DR: In this article, the authors employ a theoretical research methodology and a collection, review and analysis of doctrinal works to demonstrate that, after looking for an alternative to the apparently feeble sanction that the Competition Court (Tribunal de Defensa de la Libre Competencia or TDLC in Spanish) imposes to those responsible of collusion, the legislator incurred in imprecisions that might compromise the institutionality that regulates and sanctions it.
