Abstract: The history of the genesis and institutionalization of the European Convention on Human Rights offers a striking account of the innovation of a new legal subject and practice—European human rights—that went along with, but also beyond, the political and legal genesis of Europe following World War II. The rise of the European human rights institutions shows not only how law and lawyers played key roles in the early politics of European integration but also how the subtle combination of law and politics—as both national and international strategies—continued to play a decisive part in the institutionalization of European human rights. The article generally argues that the interplay between law and diplomacy had a fundamental impact on the innovation of European law and that lawyers capable of playing an intermediary role between the two were particularly central to this development.

Abstract: Notre propos sera d’interroger le contraste entre la stabilite de la categorie juridique et politique d’egalite, en particulier appliquee a l’egalite entre les femmes et les hommes, et le « novlangue » du debat politique et economique autour de la diversite. Il s’agira de questionner la place de la diversite dans le champ juridique et politique pour tenter de comprendre ce qui se cache derriere la fascination exercee par ce terme. Nous nuancerons l’affirmation selon laquelle nous assistons a un remplacement des categories juridiques par des normes manageriales pour defendre l’hypothese d’une cohabitation normative source de tensions. Pour cela, dans la premiere partie intitulee « la diversite sans obligation », nous analyserons l’emergence de la diversite comme une alternative a la montee du droit de la non discrimination. Dans la seconde partie intitulee « la diversite sans droit », nous examinerons ses enjeux sur les contenus et l’usage des normes d’egalite et de non discrimination.

Abstract: As the European Union has become ever more powerful in terms of political output, it has also turned out to be a potential source of human rights violations. While national governments have disagreed on setting up consequential control mechanisms for several decades, the European Court of Justice and the European Court of Human Rights pre-empted intergovernmental choice. The European courts’ paths unexpectedly crossed when they were both impelled to work out a way to deal with a twofold human rights conundrum situated at the EU level. Turbulent interaction between Europe’s two supranational courts has not only led to a relative improvement of the protection of human rights, but has also deeply transformed the course of European integration. The courts’ increasingly nested linkage has given rise to new forms of supranational judicial diplomacy between European judges. As a result of their evolving relationship, which is simultaneously underpinned by competitive and cooperative logics, the traditional opposition between an “economic Europe” and a “human rights Europe” has been overcome and the EU’s accession to the European Convention on Human Rights is high on the political agenda. Yet, this process of integration through human rights remains a fragile and incomplete endeavour. Just as in co-operative binary puzzles where two players must solve the game together and where both lose as one of them tries to win over the other, solving Europe’s binary human rights puzzle has required of European judges a new way of thinking in which it’s not the institutions, but their linkage that matters. Tandis que le pouvoir politique de l’Union europeenne s’est considerablement renforce, l’Union est egalement devenue une source potentielle d’atteintes aux droits de l'homme. Alors que les gouvernements des Etats membres etaient en desaccord sur la mise en place de mecanismes de controle consequents au niveau europeen pendant plusieurs decennies, la Cour de Justice des Communautes europeennes et la Cour europeenne des droits de l'homme ont anticipe le choix intergouvernemental. Les chemins des deux cours europeennes se sont croises quand elles ont du faire face a une double discontinuite de la protection des droits de l’homme au niveau de l’Union europeenne. L’interaction turbulente entre les deux cours supranationales ne s’est pas seulement soldee par une amelioration relative de la protection des droits de l'homme, mais a aussi profondement transforme le cours de l’integration europeenne. Au fil du temps, l’enchevetrement des liens entre les deux cours a mene a la mise en place d’une nouvelle forme de diplomatie supranationale entre juges europeens. L’evolution de leur relation, qui se caracterise par la concomitance de logiques cooperatives et conflictuelles, a permis de surmonter la traditionnelle opposition entre "l'Europe des droits de l'homme" et "l’Europe marchande" et d’inscrire l’adhesion de l’Union europeenne sur l’agenda politique. Ce processus d’integration par les droits de l'homme demeure toutefois une entreprise fragile et incomplete. Comme dans un jeu cooperatif ou deux joueurs doivent resoudre conjointement une enigme et ou les deux perdent lorsque l’un d’entre eux tente de prendre les devants, les juges europeens ont ete amenes a trouver de nouvelles parades pour resoudre le probleme de la double discontinuite europeenne des droits de l'homme, en mettant l’accent non pas sur les institutions, mais sur leur relation.

Abstract: This article aims to evaluate legal aspects of the content and implementation of the ‘strategic partnership’ between the EU and the People's Republic of China In the absence of a category of ‘emerging countries’ in international economic law, the Union must adapt its foreign policy with regard to this major economic and commercial power Relations between the European Community and China are currently governed by a second‐generation agreement from 1985 However, a new dynamic has been set in motion since 2003, by the drawing up of preparatory documents by both parties and joint declarations at annual summits bearing on the ‘strategic partnership’ Seen in a long‐term perspective, this partnership helps provide a measure of predictability in relations between the two partners, through combining elements of ‘soft law’ and ‘hard law’ If the insertion of political dialogue into the strategic partnership seems to alter the coherence of the Union, notably with regard to the difficulties of implementing the dialogue on human rights, the added value of the partnership lies essentially in its economic and commercial aspects, through not only the putting into place of non‐binding ‘economic dialogues’ which cover a large spectrum of the relationship, but also by the multiplication of sector‐based accords in numerous areas (maritime transport, customs cooperation, etc) This constant development has thus allowed parties, at the last annual summit, to envisage the conclusion of a new framework agreement: this is the origin of the mandate given to the Commission in December 2005 to conclude a partnership and cooperation agreement This article will sketch out a forecast of the legal framework, measured against the yardsticks of Asiatic regional reconfigurations and the law of the World Trade Organisation (WTO) The commercial risks of the relationship could imply the integration of the domains known as ‘WTO plus’ into the future agreement, notably in the field of investments and intellectual property rights, which would introduce a greater variety into the agreement That being the case, the negotiations risk being equally fragile at the political level, in particular concerning the insertion of a clause of democratic conditionality in the future agreement Also, any clash between the values and the interests of the EU would be uncomfortably highlighted during negotiations
