The theory of combinations for land plot exchange modelling in the course of land consolidation

Abstract: The paper is aimed at the promotion of voluntary land consolidation through the improvement of land plots exchange. The issue of the existing land plots boundaries adjustment in the course of voluntary land consolidation has been singled out. Possibilities, advantages and risks of land plots exchange without changing the existing boundaries as a constituent of land consolidation measures have been substantiated. The improvement of approaches to land plots exchange modelling without the existing boundaries adjustment has been suggested. Demands to the formation of consolidated land tenures as the result of exchange have been singled out. Theory of combinations has been applied to specify land plots exchange options. Calculation formulas for the number of the optimal consolidated agricultural land tenure placement options have been suggested. The calculations can be applied in the optimization and heuristic approaches to land reallocation and at land consolidation performance evaluation. Suggested approaches facilitate the implementation of heuristic methods especially in non-standard conditions, allow to increase the number of developers, especially involving experts with little experience. The results can be used for land plots lease optimization.

Abstract: The article scrutinizes the problem of land plots exchange with the aim of the spatial land improvement. At the current stage, the problem of the removal of overlapping of agricultural lands in agricultural land masses, elaboration and improvement of land consolidation mechanisms; the implementation of compulsory complex land consolidation is under discussion; there are preconditions of the improvement of the technical substantiation of land plot alienation for public needs. In this context, the problem of the identification of the peerness of land plots is scrutinized, i.e. the recognition of land plots to be peer provided the difference of their values is less than 10%. The study aims at the improvement of approaches to the definition of the affordable difference of land plots values which can be considered peer at the exchange. The provisions of legislation have been analysed which precondition the peer land plots exchange and specify the affordable difference of values of such land plots. It has been revealed that due to the vague definition of the affordable difference of land plot value, there is the uncertainty of 1/110 (≈0,9%) to 13/220 (≈5,9%) of the value of land plot. The existence of such mistake is firstly the reason for the disputes of the equal land plots exchange in the court, secondly, it is a hurdle for the voluntary involvement of landowners to land exchange. The specification of the definition of the affordable difference of land plots values which can be considered to be equal has been suggested. The results gained can be used at the definition of land plots as the equal at exchange and sublease; at the implementation of complex land consolidation; at the alteration of legal acts on land consolidation; at the modeling of land reallotment based on the heuristic or optimizational approach.

Abstract: Дослідження присвячене актуальному питанню перерозподілу земель у складі заходів щодо консолідації земель. Виокремлена проблематика пошуку територіальних резервів, які можуть створити просторову основу перерозподілу земель. Метою дослідження є виокремлення та обґрунтування територіальних резервів, які можуть бути залучені до процесу консолідації земель. Розглянуто землі, які з’являються в результаті просторової оптимізації земельного масиву або землекористування, земельні ділянки, викуплені у землевласників за їх бажанням, землі резерву та запасу, земельні ділянки, які відносять до невитребуваних паїв та відумерлої спадщини.

Abstract: The problem of land reallotment modeling in agricultural land masses aiming at land consolidation is scrutinized in the article. The topicality of the research is predefined by the need for the optimization of the structure of land tenure within an agricultural land mass, the implementation of measures on land consolidation. The research is aimed at the substantiation of the theory of combinations aiming at the improvement of the exchange of land plots, i.e. the choosing of alternative land plots within an agricultural land mass. The calculations are based on choosing the land plots to be exchanged to provide the optimal for agricultural activities spatial characteristics of land plots. The calculation of the variants of the formation of the consolidated land tenure by a land owner who has the right to own the prevailing share of a typical agricultural land mass has been suggested. The results of the research can be used at the realization of complex and individual land consolidation projects; at the optimization of land tenure by the sublease of land plots; as a material for the substantiation of the decision making on the land tenure optimization by territorial communities; in the following research on spatial land tenure and land ownership spatial improvement.

Abstract: З метою вирішення проблеми недостатньої лісистості території дедалі частіше розглядаються самозаліснені земельні ділянки сільськогосподарського призначення. Проте, питання залучення таких земельних ділянок, якщо вони знаходяться у приватній власності, на своєму шляху має низку проблемних аспектів, зокрема, у випадку відчуження з наступною їх передачею до земель лісового фонду.

Abstract: Large-scale infrastructure projects require the acquisition of appropriate land for their construction and maintenance, while they often cause extensive fragmentations of the affected landscape and land plots as well as significant land loss of the immediately affected land owners. A good practice in this field comes from Germany. In Germany, the so-called “land consolidation for large-scale projects” is used to distribute the land loss among a larger group of land owners and to reduce the damages caused by land dissection. In this article, the results of detailed analyses of the land consolidation for large-scale projects’ procedures in Germany are presented. The procedure is coordinated by the land consolidation authority, which has to check several formal and content requirements before implementing a land consolidation procedure. The needed land for the large-scale infrastructure project has to be provided by the owners of the land plots in the land consolidation area by selling it to the developer, by balanced land-loss following the land consolidation plan or relinquishment of re-allocation of particular land owners. The main objective of this article is to introduce and analyse the aims, requirements and procedure of German land consolidation for the purpose of land acquisition by large-scale infrastructure projects associated with remarkable spatial interventions.

Abstract: The issue of the effectiveness of agricultural land consolidation in the environment of land relations being reshaped, with Ukraine as the example has been scrutinized in the research. Land reallocation as the key constituent of land consolidation has been considered according to the existing approaches. Necessity for substantiation of the peerness of land plots to be reallocated has been singled out. Key factors influencing the peer agricultural land exchange in the process of reallocation have been defined. It is offered to define the peerness of agricultural land plots by a set of qualitative and spatial and technological characteristics. The improvement of the existing approaches to land reallocation by limiting for the reallocated land plots peerness by the preset characteristics has been suggested. The gist of the modelling is the minimization of distance from land plot to the farmhouse. Technical data characterizing the qualitative and spatial and technological characteristics of land plots at the reallotment have been defined. The assessment of the provided reallocation model with the example of the agricultural land mass has been provided. Land reallocation is accomplished by the voluntary land plot exchange. The analysis of the reallocation results using the provided model has been executed.

Abstract: Unapređenje sela i poljoprivredne proizvodnje neophodan je proces u ocuvanju ruralnog prostora za koji se deklarativno u Republici Hrvatskoj svi zalažu. Postojece stanje sela i ruralnog prostora nije privlacno za mlade ljude i oni uglavnom napustaju ta podrucja. Na selu prevladavaju staracka domacinstva koja sigurno nisu u stanju unaprijediti poljoprivrednu proizvodnju, a povratak onih koji su ga napustili, u sadasnjim uvjetima, nije za ocekivati. Stoga je neophodno mladim ljudima koji se jos uvijek bave poljoprivredom i žele se njome i dalje baviti, omoguciti takve uvjete da od svoga rada mogu sigurno i pristojno živjeti. Određena tijela državne, odnosno lokalne vlasti dužna su organizirati i realizirati konkretne projekte za unapređenje razlicitih vidova poljoprivredne proizvodnje u svakoj regiji, županiji i opcini. U nasoj državi u ruralnim sredinama prevladavaju veoma mali obiteljski posjedi koji ne mogu osigurati njihovim vlasnicima pristojna primanja, odnosno standard života kakav mladi ljudi ocekuju ili bolje reci zaslužuju. Osim toga, sve su ucestalije pojave susa, a poplave su cesta pojava u podrucjima uz brojne rijecne tokove, sto dodatno ugrožava i tako skromna primanja seoskih obitelji. Mjera kojom bi se smanjili ili potpuno eliminirali ti problemi je komasacija zemljista. Komasacija zemljista se intenzivno provodila na teritoriju Republike Hrvatske u periodu nakon 2. svjetskog rata pa sve do njenog osamostaljenja 1991. godine. Razlozi zbog kojih se vec tako dugi niz godina ne provodi komasacija zemljista nisu poznati, a jedan koji se može cuti je nedostatak zakonske regulative. Međutim, cinjenica je da bi se stari Zakon o komasaciji zemljista vrlo lako mogao prilagoditi novim drustveno-politickim prilikama, a to ujedno znaci da za njegovu izradu i donosenje, zasigurno, ne trebaju proci desetci godina. Ukoliko ovakvo stanje potraje, u sadasnjim okolnostima, nasa ruralna podrucja bit ce sve zapustenija i siromasnija, a poljoprivredna proizvodnja ce sve vise zaostajati za onom u zemljama Europske Unije.

Abstract: The preconditions and general directions of inter economic land surveying in the modern conditions of Ukrainian in accordance to the perspectives of peer land exchange implementation have been analyzed. The measures, implementation of which is advisable based on peer land exchange as the key mechanism have been singled out and substantiated. According to the current legislation of Ukraine, the main types of documentation for land management, which may provide the peer land exchange are defined. Land exchange is a common way of streamlining existing land ownership and land use in domestic and foreign practice. In particular, an equivalent exchange is often aimed at regrouping a significant amount of land use in order to optimize their structure. At the present time, the coordination of the interests of landowners in the process of optimizing the multitude of land uses of settlements is of particular relevance. For example, there is a need to locate facilities that have environmental and social significance, improvement and changing boundaries of land management objects at different levels. In the context of certain tasks, given the legally defined issue of exchange agreements concluding, the settlement of the land exchange process requires a technical justification.
