Une gouvernance globale du climat par la transparence depuis l’Accord de Paris : Le droit global de l’environnement comme solfège ?

Abstract: Les negociations internationales relatives aux changements climatiques ont revele une attente croissante de transparence sur la gouvernance de ce phenomene global, dans un contexte de prise de conscience affinee de son caractere multifactoriel et multiscalaire. Partant de ce constat, cette contribution entend illustrer la capacite du droit global, dans ces differentes declinaisons doctrinales, a permettre aux juristes de mieux apprecier les mutations du droit induites par l’exigence accrue de transparence en matiere climatique et consacree dans l’Accord de Paris. Tel est le cas, dans la mesure ou, le droit global tient compte des acteurs et des normes regulant la societe internationale, mais aussi des acteurs et des normes qui, dans les faits, exercent leur influence sur la societe globalisee. Les theories du droit global proposent donc avant tout une methode renouvelee d’analyse juridique. Elles offrent une approche du droit qui traduit la complexite des phenomenes que celui-ci contribue a reguler. Le droit global serait en quelques sorte un solfege, susceptible d’etre mobilise comme outil pour composer et orchestrer une musique juridique harmonieuse. Ainsi, le droit global permet-il de concevoir les interactions normatives induites par le caractere central de la transparence en matiere climatique, mais aussi de comprendre l’orchestration originale a l’oeuvre, en mettant egalement en evidence les interactions d’acteurs qui sont necessaires pour rendre cette transparence operationnelle.

Abstract: El proceso de agotamiento de los recursos naturales del planeta permanece evidente a respeto de las iniciativas de la comunidad cientifica internacional. En este sentido, basado en la investigacion bibliografica y a traves del metodo inductivo, el objetivo de este articulo es estimular reflexiones sobre el Derecho Ambiental Global como una alternativa reversa a la degradacion ambiental global. Para dar seguimiento a la investigacion propuesta, inicialmente la investigacion camino en el sentido de la necesidad de una Ley Ambiental Global; en seguida se dispuso a debatir las dificultades y posibilidades de establecerse una Ley Ambiental Global como objetivo. Este objeto surgio a partir de investigaciones que apuntaron la confluencia de acciones, particularmente aquellas involucrando derecho internacional, direccionada a la preservacion del medio-ambiente indicando la posibilidad de consolidacion e implementacion de una Ley Ambiental Global que responda a las cuestiones ambientales. Abstract: Is orchestration democratically legitimate? On one hand, debates concerning the legitimacy and democratic deficits of international politics continue unabated. On the other, the Secretariat of the United Nations Framework Convention on Climate Change (UNFCCC) has progressively engaged in processes of orchestration culminating in the 2015 Paris Agreement. Scholarship on orchestration has almost exclusively focused on how to ensure effectiveness while excluding normative questions. This lacuna is addressed by arguing that orchestration should be assessed according to its democratic credentials. The promises and pitfalls of orchestration can be usefully analyzed by applying a set of democratic values: participation, deliberation, accountability, and transparency. Two major orchestration efforts by the UNFCCC both pre- and post-Paris are shown to have substantive democratic shortfalls, not least with regard to participation and accountability. Abstract: High-Level Political Forum (HLPF) on sustainable development is a central element in the emerging governance architecture for sustainable development. Established at the 2012 United Nations (UN) Conference on Sustainable Development, the HLPF has a dauntingly expansive mandate - including setting the sustainable development agenda; enhancing integration, coordination and coherence across the UN system; and following up all sustainable develop- ment goals and commitments. Yet it has been granted limited authority and few material resources. In these circum- stances, the HLPF must rely on the governance strategy of 'orchestration': working indirectly through intermediary organizations, and using soft modes of influence to support and guide their actions. The forum's design suggests that states intended it to pursue this approach. We identify potential intermediaries and techniques of orchestration, and assess whether the HLPF can successfully act as an orchestrator.

Abstract: Transparency—openness, secured through greater availability of information—is increasingly seen as part of the solution to a complex array of economic, political, and ethical problems in an interconnected world. The “transparency turn” in global environmental governance in particular is seen in a range of international agreements, voluntary disclosure initiatives, and public-private partnerships. This is the first book to investigate whether transparency in global environmental governance is in fact a broadly transformative force or plays a more limited, instrumental role. After three conceptual, context-setting chapters, the book examines ten specific and diverse instances of “governance by disclosure.” These include state-led mandatory disclosure initiatives that rely on such tools as prior informed consent and monitoring, measuring, reporting and verification; and private (or private-public), largely voluntary efforts that include such corporate transparency initiatives as the Carbon Disclosure Project and such certification schemes as the Forest Stewardship Council. The cases, which focus on issue areas including climate change, biodiversity, biotechnology, natural resource exploitation, and chemicals, demonstrate that although transparency is ubiquitous, its effects are limited and often specific to particular contexts. The book explores in what circumstances transparency can offer the possibility of a new emancipatory politics in global environmental governance.
