Abstract: Copyright law is being applied to works in digital form. The special character of digital media will inevitably require some adjustments in the copyright model if digital libraries and hypertext publishing environments are to become as commercially viable as the print industries have been. An intellectual property system works only when it embodies a reasonably accurate model of how people are likely to behave, but it is hard to predict author and reader behavior in an environment that has yet to be built. By far the most ambitious proposal for a digital library and hypertext publishing environment is Ted Nelson’s Xamdu system. This paper reviews the intellectual property scheme in Xanadu and contrasts it with current copyright law. Xanadu’s predictions about reader and author behavior are examined in light of how people currently behave in computer conferencing, electronic mail, and similar existing systems. These analyses identify some respects in which intellectual property systems might have to be changed to make digital libraries and hypertext publishing systems viable.

Abstract: Over the past two years, I have written seven “Legally Speaking” columns and one feature article for Communications about legal issues affecting computing professionals. These writings have covered an array of legal topics including: criminal and civil liability for hackers who breach computer security systems; first amendment issues arising in computing or electronic publishing markets; intellectual property issues, such as patent protection for computer program algorithms; copyright protection for look and feel of user interfaces; what the user interface design field thinks about such protection, and various theories by which a firm might claim to own interface specification information for software systems.

Abstract: The author investigates creativity and intelligence in the process of computer-assisted image making. Exploring the meaning of creativity, he proposes the use of standard methods of symbolic computation to model the creative process. This conceptual approach is compared to other inclinations toward digital media that an artist might exhibit. Proceeding from a discussion of how the manipulation of symbols and processes often reveals new underlying concepts, he provides a few examples of machine-based art that have their roots in knowledge-based decision making.
