Abstract: This paper presents an analysis of agricultural contracts using a transaction costs approach. We contend that in a context of modern agriculture, with well defined property rights, agricultural contracts must balance costs and benefits, aligning tenant and landlord incentives towards a similar objective. The study debates the potential effects of tenancy status and duration of contracts, over soil conservation and input use. We present empirical evidence about the effects over the soil and input use in tenant (fixed rent or sharecropping) and owner-operator farms using farm level data from the 2002 National Agricultural Census of Argentina. The empirical results show some differential effects but do not support a general and clear negative effect for tenancy arrangements. Our intuition is that the interaction among specific characteristics of farmers (education, experience, assets, etc.), the natural resources endowment (soil fertility) and the economic and institutional environment (labor markets, monitoring costs, property rights, rule of law etc.) are more important factors than the land tenancy or contract type itself.

Abstract: In light of widespread dissatisfaction regarding methods of dividing family property, this article considers the many reform proposals regarding classification of the family home. Recognizing that a majority of proposals call for some kind of joint ownership, it focuses on the often overlooked classification of tenancy by the entireties and compares it to tenancies in common and the favoured joint tenancy. It also examines how tenancies by the entirety satisfy the current reform objectives according to the doctrines of severability and partition, though this form of tenancy has received little serious consideration.

Abstract: The people and lands of Ethiopia partake in the global movement towards urbanization. However, the land-to-people interfaces in urban Ethiopia are considered far from sustainable. This paper explores this assumption through the analytical lens of land governance and land administration. It considered the implementation of the urban land leasehold law from 2002-2011. Empirical data were collected from three case study cities in Ethiopia. A SWOT analysis technique with an additional priority component was employed. The SWOT analysis results indicated that the land administration and land governance situation in the case study cities during 2002-2011 were deterred by the lack of: an underlying land policy, independent responsible institution, coordination between different institutions, societal participation, and weak enforcement of laws and spatial plans. Priority areas that should improve these shortcomings and support future strategic planning and land development are identified. Overall, this study provides lessons for the implementation of the 2011 urban land policy to achieve its desired outcomes such as sustainable urban development.
