Abstract: Although much criticized, the concept of “sovereignty” is still central to most thinking about international relations and particularly international law. The old “Westphalian” concept in the context of a nation-state’s “right” to monopolize certain exercises of power with respect to its territory and citizens has been discredited in many ways (as discussed below), but it is still prized and harbored by those who maintain certain “realist” views or who otherwise wish to prevent (sometimes withjustification) foreign or international powers and authorities from interfering in a national government’s decisions and activities. Furthermore, when one begins to analyze and disaggregate the concept of sovereignty, it quickly becomes apparent that it has many dimensions. Often, however, the term “sovereignty” is invoked in a context or manner designed to avoid and prevent analysis, sometimes with an advocate’s intent to fend off criticism orjustifications for international “infringements” on the activities of a nation-state or its internal stakeholders and power operators.

Abstract: This book outlines the importance of political institutions in achieving good governance within a democratic polity and sets forth an argument to explore what sorts of institutions do the job best. By focusing on 'centripetal institutions', which maximize both representation and authority by bringing political energy and actors toward the centre of a polity, the authors set forth a relatively novel theory of democratic governance, applicable to all political settings in which multi-party competition obtains. Basing their theory on national-level political institutions, the authors argue that there are three types of political institutions that are fundamental in securing a centripetal style of democratic governance: unitary (rather than federal) sovereignty, a parliamentary (rather than presidential) executive, and a closed-list PR electoral system (rather than a single-member district or preferential-vote system).

Abstract: This article argues that in the present era of globalisation, control over the movement of people has become the last bastion of sovereignty. This is important both to theoretical accounts of globalisation and to policy decisions by governments. Nation states threatened with loss of control in other realms are implementing a variety of 'crackdown' measures in questions of immigration. Issues of refugee law, illegal migration and skilled migration each challenge sovereignty in specific ways. While international human rights standards have made few inroads in questions of migration, recent decisions in England and Australia suggest that the rule of law may be emerging as a counter to traditional executive free reign in matters of migration law.
