Abstract: Post-conflict spaces are no transitory phenomena during the transition from war to peace but have to be understood as fields of power where sovereignty is constantly contested and negotiated among global, elite and local actors. Understanding these spaces necessitates breaking out of the ‘single sovereign’ framework and problematizing the assumptions behind the ‘post-conflict’ label. We propose that in this way it becomes possible to discern some of the logics that govern how power and space shape each other in post-conflict settings.

Divided conceptually into four broad themes of indigenous rights to land, subsistence, services, and sovereignty, the book offers a thorough and balanced analysis of the evolution of these rights. This edition brings the volume fully up to date, with consideration of the broader evolution of indigenous rights in international law.

Abstract: A State has the following characteristics: (1) a permanent population; (2) a defined territory; (3) a government; and (4) the capacity to enter into relations with other States. Some writers also argue that a State must be fully independent and be recognized as a State by other States. The international legal system is a horizontal system dominated by States which are, in principle, considered sovereign and equal. International law is predominately made and implemented by States. Only States can have sovereignty over territory. Only States can become members of the United Nations and other international organizations. Only States have access to the International Court of Justice. .
