This book is a guide to the law that applies in the three international criminal tribunals, for the former Yugoslavia, Rwanda and Sierra Leone, set up by the UN during the period 1993 to 2002 to deal with atrocities and human rights abuses committed during conflict in those countries. La relation dialectique qui unit les traites bilateraux d’investissement et la jurisprudence du Centre International de Reglement des Differends relatifs aux Investissements (CIRDI) a fait emerger un droit international des investissements. La rencontre de ces deux dynamiques a permis de depasser leur caractere a priori isole et fragmente, pour aboutir a un veritable systeme juridique international, dote d’une structure, d’une logique et de principes propres. En effet, rien ne pouvait laisser envisager une telle evolution, le regime de l’investissement international se fondant sur une multitude de traites bilateraux et sur une instance arbitrale ne faisant qu’heberger des tribunaux ephemeres. The law of international responsibility plays a fundamental role in the modern system of international law, surpassed by none and paralleled only by the law of treaties. The volume seeks to cover the entirety of the field of international responsibility, with a particular focus on the work of the International Law Commission. It provides detailed discussion and analysis of the historically predominant topics of State responsibility, on which the ILC completed its work in 2001, and the specific sub-topic of diplomatic protection, work on which was completed by the ILC in 2006. However, it also covers both the topic of responsibility of international organizations, on which the ILC's work is ongoing (a set of draft Articles having been adopted on first reading in 2009), and that of liability for harmful activities not prohibited under international law on which the ILC adopted drafts in 2001 and 2006.

In their eagerness to justify the “United States perspective” on the Kampala definition of the crime of aggression and on the International Criminal Court (ICC), Koh and Buchwald tend to invent imaginary enemies and to ascribe to them views that they do not actually hold. In so doing, the authors weaken a thesis that, in some respects, is not devoid of interest. From at least two points of view, however, their article is paradoxical, if not pathetic—exactly like the U.S. position.
