The Civil Law

The work examines aspects of how deprivation of a civil right forms when such rights can determine a possible decrease in quality of life. Authors explore this problem in accordance with provisions of the civil legislation and form practical means for application of the right deprivation mechanism based on the analysis of international legislations. In particular, possibilities of estate seizures and gradual transformation of formalised law space into doctrinal subsystem are analysed. The work investigates the possibility to use measures of both state and private influence in this field and presents prognostic components that can affect regulation variations of estate seizure of estates based on an agreed-upon procedure between states. A different procedure is proposed for joint ownership and realisation of a provision on managing land and ecological legislations as a field of civil relations. The practical aim of the work can be applied to solving disputes regarding the need for joint regulation of civil property relations in international and local civil law. Measures that determine the possibility for structural and comprehensive informing of certain forms and structures of legal science are implemented.

Right deprivation in the legal regulation mechanism of civil property relations: Comparative analysis of international legislation

The article deals with the methodological approach and practical aspects of the development of the corporate financial security system for forecasting the investment activity of the subjects of tourist services and modeling of their tourist flows for restoration of the natural and recreational potential of the state (region) of the world level. It is proved that the multiplicative effect regulates the economic and social indicators of the tourist services and under the influence of financial policy, sets the vector of their state support, suspends the information asymmetry of the financial market in the corporate financial security system, forms a stable inflow of financial resources from tourism sector, diversifies the model of financing the investment costs of the tourism industry on the basis of public-private partnership. The dynamics of changing the time trend of the integral multiplier effect of investment expenditures of the tourism sector is substantiated. A methodological approach to estimating the multiplicative effect of investment is proposed, which defines the interdependent relationship between the differential “input-output” of the tourist services industry of the meso-level using information technologies of the money generation model. The contribution of the multiplier effect of investment costs of tourism services to the country's GDP has been determined as a complex budgetary system of financing investment projects in the regions, taking into account the conditions of employment growth and job creation. The structure of the subsidized distribution of financial resources for the investment costs and service of the tourist services industry in countries and regions of the world is analysed. The marginal criterion for effective consumption of investments for all world countries, which ensures the movement of tourist flows in the financial resources market and shapes the investment attractiveness of the regions is 3.9%. It is proved that the contractual and institutional model of public-private partnership allows to support private investors, to regulate and fill budgets of all levels, to increase the social responsibility of subjects of tourist activity and to accelerate the economic growth of the country.

Financial Provision of Investment Activities of the Subjects of the World Industry of Tourist Services

This study is an attempt to analyse economic discourse metaphors and stable expressions. Significant attention is paid to metaphor creative potential in the field of terms formation as well as representation of certain aspects of economic reality events. Some rhetoric models are especially studied from the point of view of their rhetoric impact on the potential audience. The market of goods and services began to develop rapidly in the modern consumer society, and as a result, the corpus of language tools began to expand to attract the attention of potential recipients of goods and services. Economics and linguistics are two spheres of science that are united by humans – acting and thinking/ speaking. Modern consumer society requires members of society equipped with economic knowledge that facilitate the process of acquiring something. Today, advertising with economic terminology is becoming more diverse, and it can be targeted at professionals and the broadest segments of the population. Recently, not only linguistic but also paralinguistic levels of advertising discourse realisation have become more and more relevant. The authors consider the phenomenon of linguistic metaphors in economic advertising discourse. The complexity of understanding the material is due to the use of linguistic and cultural stereotypes of the local type. The authors propose to pay attention to the fact of using metaphors of a language culture to attract potential consumers of economic services and create an image of an attractive product of economic discourse in one of the primary mechanisms for managing economic interests in the consumer society. Hence, there is a need to study economic terminology and its functioning in modern economic discourse. This study considers the metaphors of economic discourse as a manifestation of his interdiscursive nature. We analyse the compatibility of economic metaphors with national and cultural symbols and possibilities to influence the audience.

Right Deprivation in the Legal Regulation Mechanism of Civil Property Relations

Individual and corporate responsibility is the basis for sustainable development of society and the world. Environmental responsibility of business entities is a prerequisite for the survival of people, which is why it is an important aspect of corporate responsibility. The purpose of the paper is to determine the content of corporate and social responsibility of business entities in the field of environmental protection in terms of its interaction with the state on the basis of public-private partnership. The general scientific method of comparison made it possible to compare the Ukrainian legislative base on environmental protection with the legal framework of regulation and practice in foreign countries. Through the structural and functional analysis, it was possible to consider the features of the interaction between the state and business structures and between other institutions the activities of which are related to environmental protection. The analysis revealed the necessity to consider and include elements of environmental and social responsibility of business in the mechanisms of public-private partnership. The study shows that public-private partnership is an imperative element in the composition of social responsibility. The author proposes a definition of environmental responsibility that encompasses three factors: legal, economic and social. In the future, this research area will be of interest as a comparison of the legislative support of the types of responsibility for foreign and international standards in the context of implementing the relevant standards in the Ukrainian legislative framework and their implementation on practice.

espanolEl deporte es un area unica de las relaciones sociales, que es oficialmente autonoma y se rige no solo y no tanto por la legislacion nacional, sino en mayor medida, por las reglas de las organizaciones deportivas. Debido a que el deporte tiene un caracter autonomo, que, en particular, se caracteriza por la presencia de diversas fuentes regulatorias que inciden de manera integral en las relaciones sociales relevantes, comienza a tomar forma el concepto de un «orden juridico deportivo» unico. El estudio tiene como objetivo analizar las relaciones sociales en el ambito del deporte y las peculiaridades de su regulacion. Ademas, la metodologia de investigacion incluye un conjunto de metodos de cognicion cientifica, entre los que se encuentran los metodos de analisis, sintesis, induccion, deduccion, metodo logico-formal, metodo historico y metodo juridico comparado. La regulacion de las relaciones en el campo del deporte es significativamente diferente de la regulacion de otras relaciones sociales. La presencia de tales caracteristicas da motivos para que los oficiales deportivos declaren el estatus especial del campo de los deportes y la necesidad de eliminarlo del orden legal general. Como resultado del estudio, los autores del articulo llegaron a la conclusion de que el deporte moderno tiene un estatus autonomo y es un area especial de regulacion legal y no legal, que tiene las caracteristicas de un orden legal independiente. Al mismo tiempo, es demasiado pronto para afirmar la existencia de un «orden juridico deportivo» en toda regla. EnglishSport is a unique area of social relations, which is officially autonomous and ruled not only and not so much by national law, but to a greater extent – by the rules of sports organizations. Due to the fact that sport has an autonomous character, which, in particular, is characterized by the presence of various regulatory sources that comprehensively affect the relevant social relations, the concept of a unique «sports legal order» is now beginning to take shape. The study aims to analyze social relations in the field of sport and the peculiarities of their regulation. Moreover, the research methodology includes a set of methods of scientific cognition, among which are the methods of analysis, synthesis, induction, deduction, formallogical method, historical method and comparative legal method. Regulation of relations in the field of sports is significantly different from the regulation of other social relations. The presence of such features gives grounds for sports officials to declare the special status of the field of sports and the need to remove it from the general legal order. As a result of the study, the authors of the article came to the conclusion that modern sport has an autonomous status and is a special area of legal and non-legal regulation, which has the characteristics of an independent legal order.
