Among the numerous works on international criminal procedure, there has been no study focusing on the international criminal trial as a socio-legal phenomenon and a phase of international criminal proceedings. This book seeks to cover this gap by systematically examining and analyzing the nature and organization of trials conducted by the historical and contemporary international and hybrid criminal tribunals from the Nuremberg International Military Tribunal to the Special Tribunal for Lebanon. The study posits international criminal trials as a distinct object of theoretical and legal inquiry. It combines the methodological, conceptual, comparative, and critical approaches to the subject-matter for the purpose of developing the 'normative theory' of international criminal trials.

On 30 June 2000, the Preparatory Commission for the International Criminal Court approved by consensus the Draft Rules of Procedure and Evidence (hereinafter ‘the Rules’). Their adoption followed months of extensive negotiations during which delegations struggled to supplement the Rome Statute of the International Criminal Court (hereinafter, ICC or the Court) while fulfilling the — sometimes somewhat contradictory — objectives of safeguarding the integrity of the Statute and ‘enhancing the effectiveness and acceptance of the Court’.

The Rules of Procedure and Evidence of the International Criminal Court

The tension between internationalism and state sovereignty permeates many of the decisions that were taken during the negotiations of the Rome Statute and supplementary instruments. It is clear that the articulation of a precise substantial and procedural regime that would govern the Court, and limit the discretion of the Prosecutor and the judges, was considered to be a prerogative of the legislative powers of sovereign States. The Statute, Rules and Regulations establish a fairly complete, although not exhaustive, procedural scheme for the Court. The Rules of Procedure and Evidence were prepared and negotiated by State representatives gathered at the Preparatory Commission of the International Criminal Court established at the Rome Conference. The Rules and the Regulations of the Court entail a number of supplementary provisions concerning institutional matters. The Rules further specify the conduct of the Plenary sessions and different solemn undertakings.
