We examine the impact of ambiguous and contested land rights on investment and productivity in agriculture in Akwapim, Ghana. We show that individuals who hold powerful positions in a local political hierarchy have more secure tenure rights and that as a consequence they invest more in land fertility and have substantially higher output. The intensity of investments on different plots cultivated by a given individual corresponds to that individual’s security of tenure over those specific plots and, in turn, to the individual’s position in the political hierarchy relevant to those specific plots.

The Profits of Power: Land Rights and Agricultural Investment in Ghana

The evolutionary theory of land rights can be considered the dominant framework of analysis used by mainstream economists to assess the land tenure situation in developing countries, and to make predictions about its evolution. A central tenet of this theoryis that under the joint impact of increasing population pressure and market integration, land rights spontaneously evolve towards rising individualization and that this evolutioneventually leads rightsholders to press for the creation of duly formalized private property rights — a demand to which the state will have an incentive to respond. This article looks critically at the relevance of the evolutionary theory of land rights as currently applied to Sub-Saharan Africa. In particular, the question of whether the establishmentof private property rights is an advisable structural reform in the present circumstancesis examined, in the light of evidence accumulated so far. It will be argued that most of the beneficial effects usually ascribed to such a reform are grossly over-estimated and that, given its high cost, it is generally advisable to look for more appropriate solutions that rely on existing informal mechanisms at community level.

The Evolutionary Theory of Land Rights as Applied to Sub‐Saharan Africa: A Critical Assessment

The current global land grab is causing radical changes in the use and ownership of land. The main process driving the land grab, or ‘foreignisation of space’, as highlighted in the media and the emerging literature is the production of food and biofuel for export in the aftermath of recent food and energy crises. However, there are several other processes driving the land rush. In this article I argue that an analytical framework that focuses on only one or two processes that drive the global land grab offers a narrow perspective on this complex process. It will be unable to take into account the full range and extent of agrarian and social changes that occur in light of the land grab and their strategic implications for poor people's livelihoods. Land Tenure Security and Investment Incentives: Puzzling Evidence from Burkina Faso

The paper proposes that reports of pervasive competition and conflict over land in sub-Saharan Africa belie a current image of negotiable and adaptive customary systems of landholding and land use but, instead, reveal processes of exclusion, deepening social divisions and class formation. Cases of ambiguous and indeterminate outcomes among claimants over land do occur, but the instances of intensifying conflict over land, deepening social rifts and expropriation of land beg for closer attention. More emphasis needs to be placed by analysts on who benefits and who loses from instances of ‘negotiability’ in access to land, an analysis that, in turn, needs to be situated in broader political economic and social changes taking place, particularly during the past thirty or so years. This requires a theoretical move away from privileging contingency, flexibility and negotiability that, willy-nilly, ends by suggesting an open field, to one that is able to identify those situations and processes (including commodification, structural adjustment, market liberalization and globalization) that limit or end negotiation and flexibility for certain social groups or categories.

Inequality and Social Conflict Over Land in Africa

The report is based on case studies in seven countries, and relies on new data to examine the relationship between land holding rights, and agricultural production. Land remains the most important source of economic livelihood, security, and social status in Sub-Saharan Africa. But the extent to which existing tenure rules, and practices influence agriculture, is unclear. The report further questions whether indigenous African land tenure systems, accord farmers sufficient security for long-term investment in agricultural production, and, examines as well the major effects of land registration and titling, on agricultural production. The study represent the first rigorous quantitative analysis of the relationship between land tenure security, and agricultural production in the context of contemporary political economies of African countries.

Security of tenure and land productivity in Kenya.

These Country Profiles represent a new edition of a continent-wide set of profiles prepared and published by the Land Tenure Center in 1986. This new volume reflects a decade of intensive work on the continent by LTC and a very considerable deepening of knowledge and understanding of land tenure issues in Africa. It addresses events of the past ten years, which have been substantial in many of the countries covered. Land tenure continues to be a volatile policy domain. The standard topics from the earlier profiles have been revised to take into account new development concerns. The following are examples of topics covered: national land policy and legal framework, replacement and adaptation of indigenous tenure systems, tenure constraints and opportunities, economic growth and food security strategies, agricultural development, natural resource management and conservation, democratization and governance, gender dimensions, present policy position and reform debates, and implications for policy reform and programming. Three regional syntheses have been prepared, for West Africa, the Greater Horn of Africa, and Southern Africa.

In 1984, the Land Tenure Center embarked on a project to evaluate the experiences with land registration and tenure reform in Africa. The goal was to determine is African states been able to use tenure reform and land registration to provide greater security of tenure than was available through customary tenure systems. Donor agencies focused attention on the creation of individual freehold title, emphasizing the heightened security of holding, marketability, and access to credit under such tenure. National governments, on the other hand, were more concerned to see that land was used productively rather than merely accumulated for purposes of prestige or inheritance or as a hedge against inflation, and for this reason have tended to favor granting more circumscribed rights, such as leaseholds or rights of occupancy. This literature review and synthesis was prepared as part of an effort to increase very substantially our knowledge, especially on a quantitative level, of tenure and development relationships in Africa. The literature review is an attempt to gather in one place data about the diverse efforts at land registration and to describe briefly for each country the various registration programs that have taken place (if any), why they were undertaken, and what subsequent studies of these programs have found. Among other things, it will be seen that the intended benefits, and beneficiaries, of land registration have changed over the century or so since the first systems were put in place. In addition to these variations over time, there are also differences among Anglophone, Francophone, and Lusophone countries, differences that not only influenced the structure of registration systems established during the colonial era, but also continue to inform the kinds of registration systems adopted today.
