TL;DR: In this article, the authors show that if, as supporters of the forbidden preserve, we understand that one of our rights is to participate on equal terms in collective decision-making, then an adequate balance between procedural and substantive values recommends, in my opinion, the adoption of the kind of institutional design that we can call "weak constitutionalism."

The Province of Jurisprudence Underdetermined

TL;DR: In the context of the discussion about the methodology of jurisprudence, both "descriptive" and "normative" labels turn out to be crude and potentially misleading labels which mistakenly suggest that there is a single divide between two clearly defined and internally homogeneous positions that are at any rate antagonistic as discussed by the authors.
