The Politics of Justice in European Private Law intends to highlight the differences between the Member States' concepts of social justice, which have developed historically, and the distinct European concept of access justice. Contrary to the emerging critique of Europe's justice deficit in the aftermath of the Euro crisis, this book argues that beneath the larger picture of the Monetary Union, a more positive and more promising European concept of justice is developing. European access justice is thinner than national social justice, but access justice represents a distinct conception of justice nevertheless. Member States or nation states remain free to complement European access justice and bring to bear their own pattern of social justice.

We are entering into an era of new technological possibilities. Many benefits will be derived for consumers from the development of data and computer-driven innovation. We will have new products and services and new ways of making and supplying goods and services.Without wanting to inhibit innovation, this article calls for the legal system to remain committed to an ideology and legal framework that supports consumer protection. It will counsel against assuming that the law should give way unduly to the technology agenda, whilst accepting that adaptations should be made and also that there should be a critical review of whether traditional forms of regulation are needed in the Fourth Industrial Age.

Flexibility of residential lease relations from the tenant’s perspective: estonian law in a comparative context

This paper examines the challenge that the organisational models adopted by the gig economy platforms represent for labour law. Starting from the premise that platforms providing “crowdwork” and “work by platform” risk undermining the founding idea of labour law that “labour is not a commodity”, the contribution aims to analyse the different paths pursued by case law and legal literature in order to prevent platform workers from falling into an “empty space of law”. To this end, the contribution focuses on the attempts made to pursue the reclassification of platform workers as subordinate employees in order to provide them with full employment rights, and, in the second instance, it tries to verify whether it is useful and possible to search for some protective provisions even outside the field of statutory employment law.

Abstract The COVID-19 pandemic has shown once again that it is often the poor who suffer from economic downturn in times of crisis. As was the case in the financial crisis of 2008, we now have an opportunity to rethink the role of consumer credit in society and design and create a legal framework that adequately reflects that role. The following thought experiment hopes to give impetus to legal reforms.
