Abstract: Editor's note: Over the past decade, two developments have greatly affected the conduct of affairs in academic institutions in the United States: the increasing role of the courts and the growth of collective bargaining. Both have had major impact on the AAUP, and the AAUP has had some impact on them. We print here the first two of four parts of an article that explores these developments and some of their major implications. The article is reprinted, with abridged footnotes, from the Iowa Law Review, July, 1980, volume 65, number 5, by permission of the editors. Part III, dealing with collective bargaining, will appear in the April issue, and Part IV, offering an alternative proposal to judicial and collective-bargaining approaches, will appear in May. Matthew W. Finkin is professor of law at Southern Methodist University and is currently visiting professor of law at the University of Michigan Ann Arbor. He served on the national staff of the AAUP as staff counsel and as director of the Northeast Regional Office. He has served as a member of Committee N and is at present chairman of Committee A. As associate general counsel of the AAUP in 1974-76 and as general counsel in 1976-78, he participated on behalf of the AAUP in several of the cases discussed in Part II of this article.
