There are a number of inchoate forms of global law, none of which are the creations of states. In relation to them I wish to develop three arguments:1. Global law can only be adequately explained by a theory of legal pluralism which turned from the law of colonial societies to the laws of diverse ethnic, cultural and religious communities in modern nation-states. It needs to make another turn - from groups to discourses. It should focus its attention on a new body of law that emerges from various globalization processes in multiple sectors of civil society independently of the laws of the nation states.2. The emerging global (not inter-national!) law is a legal order in its own right which should not be measured against the standards of national legal systems. It is not - as is usually understood - an underdeveloped body of law which has certain structural deficiencies in comparison to national law. Rather, its peculiar characteristics as fully fledged law distinguishes it from the traditional law of the nation states. These characteristics can be explained by differentiation within world society itself. While global law lacks political and institutional support on the global level, it is closely coupled with globalized socio-economic processes.3. Its relative distance from international politics will not protect global law from its re-politicization. On the contrary, the very reconstruction of social and economic (transactions as a global legal process undermines its non-political character and is the basis of its repoliticization. Yet this will occur in new and unexpected ways. We can expect global law to become politicized not via traditional political institutions but within the various processes under which law engages in 'structural coupling' with highly specialized discourses.

Menee pour la premiere fois, l’etude des differentes dimensions de la prevention jusque-la etudiees de maniere disjointe (la precaution, la cessation et la dissuasion) est rendue possible par la decouverte des sanctions preventives en droit de la responsabilite civile. Les sanctions preventives sont nombreuses en jurisprudence en vue de prevenir le dommage a differents stades : avant la realisation du fait dommageable (mesure de prevention et de precaution), au cours de sa realisation (mesure de cessation), apres sa realisation (dommages et interets provisionnels) et apres sa qualification en fait generateur (dommages et interets punitifs). Ces sanctions preventives bouleversent les trois conditions d’engagement de l’action en responsabilite civile. Or, en presentant la responsabilite civile par ses effets, la notion de sanction preventive apporte une nouvelle coherence au droit positif. En effet, l’existence des sanctions preventives met en lumiere une mise en effet judiciaire des normes de la responsabilite civile dans une finalite preventive. Ce temps de la mise en effet est celui durant lequel le juge choisit l’effet de droit apte a resoudre le litige. Afin de prendre en compte cette operation qui est effectuee sous l’influence du contexte social, il est alors propose de nouvelles actions en justice : une par type de sanction. Une double action preventive en anticipation et en cessation pour les sanctions preventives, une action en compensation stricte pour les sanctions reparatrices et une action en compensation dissuasive pour les sanctions repressives permettent de recouvrer la coherence du droit positif de la responsabilite civile. L’emergence sociale d’un besoin securitaire emancipe la responsabilite du modele du "tout indemnitaire" ; son integration par la sanction preventive marque le passage du droit de la responsabilite civile dans le XXIe siecle.

La sanction préventive en droit de la responsabilité civile : contribution à la théorie de l'interprétation et de la mise en effet des normes

Connu de tous, employe dans toutes les disciplines, abondam-ment utilise, le concept de crime contre l'humanite n'en reste pas moins un objet obscur. Il peut paraitre deroutant en ce qu'il est a la fois simple – il renvoie a des actions qui revoltent la conscience – et complexe, tant sa signification est empreinte d'inconstance. De nombreux travaux scientifiques temoignent de cette ambiva-lence, au travers de l'etude de la notion de crime contre l'huma-nite et de son regime juridique ; des travaux dont l'apport majeur est de repondre au comment. Sevane Garibian propose ici de joindre a ce comment un pourquoi – en d'autres termes, de re-construire l'histoire du concept a partir des sources primaires et de l'abondante doctrine preexistante en adoptant un nouvel angle de vue. Cette approche inedite exige, au-dela du travail compilatif relatif a la definition a proprement parler du crime et a l'analyse de l'incrimination, de rendre visibles les facteurs juri-diques commandant l'evolution du concept. Pour ce faire, l'ana-lyse de l'auteure trouve egalement appui sur les ecrits dedies, plus generalement, aux questions classiques et incontournables soulevees par l'internationalisation du droit penal et l'emergence d'un ordre penal international, indissociable de celle du concept, et d'une actualite sans cesse renouvelee.
