Development of local systems in various European countries is characterized by the strong increase of regionalism along with a greater flexibility in the distribution of normative competencies at different levels. Development is not uniform. In the beginning at least, these systems are shaped in accordance with a national rationale. However, the development of European integration, and the principle of subsidiarity, tend to standardize development and thereby challenge if not the nation-state, then its traditional way of functioning.

While there is little new in recognizing that courts often make decisions with profound political consequences, this study considers recent transfers of power to judiciaries to be unprecedented in their breadth and scope, features of what the author describes as “the new constitutionalism.”

William Scheuerman's book aims to redress this lag in the discipline, taking up the theme of social acceleration from these and other authors and using it to frame a wide-ranging assessment of transformations to liberal democratic legal and political institutions.

Drawing upon Hannah Arendt’s and Carl Schmitt’s theories on the relationship between nomos and boundary, this paper revisits how constitutionalism and political power are reconciled as a constitutional ordering. It first analyzes constitutionalism in the light of political modernity. Indicating that political power grounded by a constitution is omnipotent, complementing and completing constitutionalism, this paper contends that an omnipotent constitutional ordering is anything but an unleashed Leviathan. It is argued that constitutional omnipotence is framed and thus constrained by a constitutional nomos, the matrix of which is a dual delimitation of boundaries, generational and jurisdictional.

Reconciling constitutionalism with power : towards a constitutional nomos of political ordering

I aim to shed theoretical light on the meaning of judicial dialogue by comparing its practice in different jurisdictions. I first examine the practice of dialogic judicial review in Westminster democracies and constitutional departmentalism in American constitutional theory, showing the tendency toward judicial supremacy in both cases. Turning finally to continental Europe, I argue that the practice of constitutional dialogue there is reconciled with its postwar tradition of judicial supremacy through the deployment of proportionality analysis-framed judicial admonition. I conclude that constitutional dialogue may take place amid the judicialization of constitutional politics, albeit in the shadow of judicial supremacy.
