Results of introduction of the improved mechanism of economic security control of insurance companies

In the last few years, the cryptocurrency bitcoin has repeatedly made worldwide headlines with its fluctuations in value and the uncertainty regarding the legal framework under which it operates. While bitcoin has swiftly become the foremost example of a virtual currency, it is by no means the only one. In-game currencies and currencies used as part of a loyalty scheme are examples as of other forms of virtual currencies. Moreover, new forms of virtual currency used mainly for investment purposes—derived from cryptocurrencies such as bitcoin—are rapidly gaining hold. This book focuses on the legal aspects of virtual currencies from the perspective of financial and economic law. It establishes a typology of virtual currencies and assesses whether they can be considered as money. The author analyzes whether the EU legal frameworks on electronic money, payment services, anti-money laundering, and markets in financial instruments can be applied to virtual currencies. A functional comparison is made to the US, where more regulatory initiative has been identified. The book concludes by answering the question of whether—and how—virtual currencies should be regulated within the EU.

Virtual currencies : a legal framework

While the bitcoin is reaching all pockets and headlines, the regulatory debate is also at its peak. Following brief analysis of the blockchain
mechanism, this article focuses on the regulatory approaches taken in the EU as well as in single Member States and third countries around the
world. Regulatory intervention seems to be appropriate and could build on the points of convergence of national and international policy makers.

Bitcoin and Virtual Currencies Are Real: Are Regulators Still Virtual?

Objective The aim: The aim of the study is to examine the blockchain technology in the field of healthcare, to analyze the principles of the European Convention on Human Rights regarding respect for private and family life, home and correspondence, to analyze the key positions of the European Court of Human Rights (hereinafter - ECHR) in the field of human rights to privacy, to analyze the European Union (hereinafter - EU) secondary legislation regarding the supply of medicines, prospects for the blockchain usage in order to protect human rights to privacy and improve the quality of medicines. Patients and methods Materials and methods:Scientific works that are devoted to the outspread of digital technologies in healthcare, the provisions of the European Convention on Human Rights, the ECHR's practice on the protection of human rights to privacy, the provisions of the EU secondary legislation that regulate the supply of medicines are studied. The methodology of this article is based on comparative and legal analysis techniques and includes system-structural method, method of generalization, method of analysis and synthesis as well. Conclusion Conclusions:The blockchain technology in medicine and pharmacology will increase the level of protection of human rights to healthcare quality.

The article considers the complex issue of the existence of national cryptocurrency markets and their legal regulation and ethics of use. The article provides an analytical review of leading models of legal regulation of cryptocurrency circulation in different countries of the world. The study was carried out in the methodological field: the development of the national cryptocurrency market, the legal interpretation of the cryptocurrency, the legal basis of circulation, ethics and the cryptocurrency exchange platforms, the directions of development of the national model of legal regulation and support.

International Models of Legal Regulation and Ethics of Cryptocurrency Use: Country Review

The subject area of properties of an unmanned vehicle with an information and control system in conflict and uncertain operating conditions in two versions is considered. The first option is a physical model that reflects the material attributes of the ground adaptive robotic complex using the components of subsystems of generalized design with measuring system of sensors and adaptive control system, as well as materialized elements of technological interaction in the form of multisensor channels for receiving and processing signals. radiation. The second option - an analytical model that reflects the system of formalization of information interaction of the object with the operating environment with objects, which is represented by an ordered set (vector) of source data, logical and analytical expressions, algorithms or rules for their construction. Particular attention is paid to simulation methods of digital information processing in information and control systems of car control. A simulation model with a stabilizing measure for the processing of digital multisensory information in information and control systems of car control in the conditions of destabilizing influences is proposed. The presented joint solution of the problem of restoring the observed image involves determining the conditions of formation of the recovered image taking into account destabilizing factors by simulating them as a noise test useful signal, the coefficients of which are formed by addressing random number sensors (RNS) with uniform distribution law with its subsequent processing in a regularized adaptive system.

The problem of simulation of the functioning processes of a multi-sensor information-control system of a vehicle under stabilizing effects

The article examines the relationship between legal regulations of electronic commerce and electronic communications from the point of view of ensuring the information and communication component of electronic commerce. Changes in the legal status of intermediate service providers in e-commerce have been identified. A conclusion is made about the certain influence of the Law of Ukraine "On Electronic Communications" on the legal support of the information and communication component of electronic commerce. 
According to the Law on Electronic Communications, the configuration of subjects of such communications has undergone changes. In order to provide services of an intermediate nature in the context of the information and communication component of e-commerce, such entities have identified providers of electronic communication services. The terminological definitions of the Law "On Electronic Communications" suffer from tautology, and accordingly, weak legal certainty, as well as cumbersomeness. In connection with this, we consider it expedient, in parallel with the normative terms, to keep in scientific circulation, in particular, the term "providers" - to denote providers of electronic communication services. In our opinion, the removal of providers of electronic communication networks (operators) from the list of intermediate service providers in the Law on Electronic Commerce has a purely nominal value, because in the context of the legal regulation of electronic commerce, the functions of providers, not operators, but of providers of electronic communication services. And precisely in terms of providing these information and communication functions, the Law on Electronic Communications for the first time establishes for consumers quantitative and qualitative guarantees sufficient for the realization of the right to perform transactions in the field of electronic commerce in a fixed place. Today, merchants increasingly conduct their business electronic communications through various types of Internet messengers. The lack of normative regulation of this issue leads to numerous legal disputes, in which it is difficult for courts to develop a single universal approach. Therefore, the problem of using software applications such as Skype, Telegram, Viber, WhatsApp, etc. in electronic and commercial communications remains urgent and requires regulatory regulation.

The right to make a decision: human rights of patients with mental disabilities

Ще донедавна юридичні консультації, захист та представництво для багатьох громадян України були складно досяжною послугою. Багато українців, зокрема з числа вразливих верств населення, просто не мали змоги оплачувати послуги адвоката або ж були позбавлені доступу до правової допомоги, що зумовлювало неможливість фахового представництва в суді. Така ситуація створювала нерівні умови та не сприяла довірі громадян до державних установ загалом та, зокрема, вірі у справедливість системи правосуддя, що є важливим для розвитку ефективних механізмів реалізації демократії. У Резолюції 1466 (2005) Парламентської Асамблеї Ради Європи «Про виконання обов’язків та зобов’язань Україною» було закріплено зобов’язання щодо покращення доступу до правосуддя шляхом запровадження системи безоплатної правової допомоги (БПД) у відповідності до стандартів Ради Європи та практики Європейського Суду з прав людини. З ухваленням Закону України «Про безоплатну правову допомогу» в червні 2011 року Україна взяла на себе зобов’язання щодо правового захисту вразливих верств населення і покращення доступу до правосуддя шляхом надання безоплатної правової допомоги. Закон був реалізований поетапно: з моменту набрання ним чинності (8 липня 2011 року) усі особи, які перебувають під юрисдикцією України (включно з іноземцями та особами без громадянства), отримали можливість реалізувати право на безоплатну первинну правову допомогу, з 1 січня 2013 року доступ до безоплатної вторинної правової допомоги отримали затримані, арештовані, підозрювані та обвинувачені, а з жовтня 2014 року – деякі категорії осіб, засуджених до позбавлення чи обмеження волі. З 1 липня 2015 року безоплатну вторинну правову допомогу отримують всі суб’єкти відповідного права, визначені Законом. Не дивлячись на те, що система безоплатної правової допомоги функціонує близько семи років, практика свідчить, що вона перебуває на етапі становлення, зокрема не досягнуто рівня європейських стандартів забезпечення доступу особи до правосуддя та якості правових послуг. Відповідно описувана сфера в окресленому аспекті потребує удосконалення, а саме: 1)&nbsp;переорієнтації системи БПД з надання правової допомоги окремим фізичним особам на посилення правової спроможності та правових можливостей територіальних громад; 2) створення ефективної системи управління правовими знаннями та розвиток людського потенціалу правничої спільноти та партнерських мереж системи БПД; 3) децентралізації системи БПД у цивільних та адміністративних справах, а також пілотування моделі офісів громадського захисту у кримінальних провадженнях; 4) розбудови комплексної інформаційно-аналітичної системи забезпечення надання безоплатної правової допомоги тощо. Личко, Р.&nbsp;Г.&nbsp;Мельніченко, К.&nbsp;С.&nbsp;Пащенко, С.&nbsp;В. Прилуцький, М.&nbsp;І. Рішко, Н.&nbsp;Ю. Сакара, О.&nbsp;Д. Святоцький, Є.&nbsp;Г. Тарло, Л.&nbsp;В. Тацій, П.&nbsp;В. Хотенець, Ю.&nbsp;Т. Шрамко, О.&nbsp;Г.&nbsp;Яновська та інші науковці. В свою чергу представники адміністративно-правової науки майже не приділили увагу адміністративно-правовим засадам надання безоплатної правової допомоги, дослідження даного питання мають фрагментарний характер та переважно обмежуються сферою діяльності суб’єктів надання такої допомоги (публікації О. В. Анпілогова, О.&nbsp;М.&nbsp;Бандурки, А. О. Галая, О. Ю. Синявської, К. О. Струкової). Більше того, у зв’язку з прийняттям змін до Конституції України щодо правосуддя (Закон України від 2 червня 2016 року № 1401-VIII), особливого значення набула норма наступного змісту: «Виключно адвокат здійснює представництво іншої особи в суді, а також захист від кримінального обвинувачення». Очевидно, що названі зміни значним чином позначилися на організаційно-правових основах надання безоплатної правової допомоги. Таким чином, недостатня розробленість на теоретичному рівні, наявність практичних правових питань, а також необхідність проведення комплексного дослідження проблем адміністративно-правових засад надання безоплатної правової допомоги в Україні обумовили вибір теми дисертації. &nbsp;Отже, розробка проблематики адміністративно-правових засад надання безоплатної правової допомоги в Україні набуває нового теоретичного і прикладного змісту. Саме розкриттю сутності та особливостей адміністративно-правових засад надання безоплатної правової допомоги в Україні і присвячена дана робота. Монографія спрямована на виконання теми комплексної науково-дослідної роботи кафедри державно-правових дисциплін, кримінального права і процесу Харківського національного педагогічного університету імені Г. С. Сковороди «Правові проблеми європейської інтеграції держави і права України» (державний реєстраційний номер 0121U110256), що виконуються в межах тематичного плану фундаментальних наукових досліджень.
