Situating the Self

Israel's half-a-century long rule over the West Bank and Gaza Strip, and some of its surrounding legal issues, have been the subject of extensive academic literature. Yet, to date, there has been no comprehensive, theoretically-informed, and empirically-based academic study of the role of various legal mechanisms, norms, and concepts in shaping, legitimizing, and responding to the Israeli control regime. This book seeks to fill this gap, while shedding new light on the subject. Through the format of an A-Z legal lexicon, it critically reflects on, challenges, and redefines the language, knowledge, and practices surrounding the Israeli control regime. Taken together, the entries illuminate the relation between global and local forces - legal, political, and cultural - in Israel and Palestine. The study of the terms involved provides insights that are relevant to other situations elsewhere in the world, particularly with regard to belligerent occupation, the law's role in relation to state violence, and justice.

The looting and systematic deprivation of the property rights of the Jewish population in the Netherlands and France during the years of occupation brought about a deprivation of dignity, since these measures were intended to hit these people in their capacities as legal subjects, destroying their abilities to take part in economic and social life. In the immediate postwar period, the restitution of property rights in both countries was closely connected and limited to an abstract conception of dignity restoration, understood as the renewed recognition of the dispossessed owners as free and equal citizen before the law. In the late 1990s, a new phase in the restoration of property rights took place on a much more collective and political level. In this second round of restitution, dignity restoration was directly connected with an explicit recognition of the particular, concrete suffering of the groups of victims involved.

textIn dit boek kwamen ontrechting en rechtsherstel in Nederland en Frankrijk in 
de periode 1940-1956 aan de orde. Beschreven werd hoe in deze landen in het 
bijzonder de leden van de joodse bevolkingsgroepen, veelal door middel van 
door de Duitsers (en in Frankrijk ook door het Vichy-bewind) afgekondigde 
wetgeving, van hun goederen werden beroofd, en hoe derden daarvan profiteerden. 
Vervolgens werd uitgebreid ingegaan op het proces van rechtsherstel 
in beide landen: de grootschalige restitutie van goederen aan mensen die werden 
ontrecht; met naar verhouding de meeste aandacht voor het restitutieproces 
in Nederland. 

De rode draad door die analyse betrof de verhouding tussen rechtsherstel – 
de restitutie van goederen aan mensen die werden ontrecht – en de terugkeer 
naar de democratische rechtsstaat. In hoofdstuk 1 werd de algemene these geponeerd, 
dat rechtsherstel een noodzakelijk element is in het proces van terugkeer 
naar de rechtsstaat, na afloop van een periode waarin specifieke categorieen 
burgers werden ontrecht. Ontrechting werd omschreven als een proces 
waarbij mensen op discriminerende gronden uit de rechtsorde worden verwijderd 
door hen systematisch hun rechten te ontnemen en aldus aan te tasten in 
hun capaciteiten om aan het rechtsverkeer – en daarmee aan het economisch en 
publieke leven – deel te nemen. De rechtsstaat werd omschreven als een maatschappijvorm 
waarin de toegang tot het recht, en daarmee de mogelijkheid om 
aan het economisch en publieke leven deel te nemen, voor iedereen is gewaarborgd. 
In het kader van de terugkeer naar de rechtsstaat maakt het rechtsherstel 
het mogelijk om degenen die gedeeltelijk of volledig werden ontrecht weer als 
volwaardige burgers in de rechtsstaat op te nemen, door hen in staat te stellen 
om voor een onafhankelijke rechter op te komen voor de teruggave van hun 
rechten.

Ontrechting en rechtsherstel in Nederland en Frankrijk in de jaren van bezetting en wederopbouw

Human beings are cultural beings. This implies that being deprived of valuable cultural objects may directly affect them in their possibilities of being human. This predicament could explain the special attention given to cases of Nazi-looted cultural objects and, more recently, to collections of cultural objects looted or acquired under duress in territories of the former colonial empires. It may be one of the reasons why, in particular, the quest for restitution of specific cultural objects is deemed to be so important, despite efforts to also explore alternative 'fair and just solutions', as indicated in the Washington Principles on Nazi-Confiscated Art of 1998. With reference to ideas of the German-Jewish philosopher Walter Benjamin (1892-1940), this paper explores the value of restitution in more detail. How could these ideas be helpful in understanding and perhaps overcoming legal obstacles in the present on the road to restitution of objects from colonial collections?
