Abstract: El objetivo de este articulo reside en efectuar un analisis del primer grado penitenciario. La aparicion de este trabajo se justifica, entre otros motivos, por la efemeride que supone el 40 aniversario de la LOGP que se produce en 2019. Asi pues, en este marco, se intenta mapear las razones que impulsaron la creacion del primer grado penitenciario, los argumentos que justificaron su procedencia y que permiten afirmar que sigue siendo un grado clasificatorio vigente.

Abstract: This article discusses the main characteristics of the phenomenon known as «criminal Law of the Enemy». Likewise, with the purpose of identifying the elements for which the Spanish lifetime imprisonment must be rejected, given that it is a response incompatible with the democratic political-criminal model, are described the most relevant elements of this new penalty. Finally, it is concluded that this penalty constitutes the paradigmatic example of criminal Law of the Enemy because it is a punitive reaction aimed at intensifying in perpetuity the selective and discriminatory treatment that terrorists and murderers were already receiving, the most characteristic enemies from public opinion, the media and the legislator.

Abstract: The author explore a situated environmental scenario: Huelva, a town in southern Spain, heavily polluted by a huge industrial and chemical plant. He examine this case of environmental crime through a "green criminological perspective", scrutinizing, observing and analysing the interactions between humans and the environment they inhabit just when such interactions become more dissatisfying, frustrating and increasingly fraught with risks, dangers and destruction. From this perspective also, a possible approach to social harm implies a change of the destructive social and environmental relations.

Abstract: Spurred by the huge changes affecting modern border regime, political theory and contemporary social sciences have begun to think borders beyond our classic geopolitical imagery by illustrating their complex nature of biopolitical “dispositifs” called for the production of subjectivity, the management of mobility and the government of populations. Despite their common foucauldian theoretical matrix, there were profound differences in the type of diagnosis proposed to analyze border control practices, so that the literature seems to oscillate between two different readings of the biopolitical performance played by borders. This paper aims at reconstructing the debate on migration securitization by critically discussing the different theoretical perspectives on the biopolitical function played by borders that can be found in the existing literature. Once completed this preliminary attempt at conceptual clarification, the paper’s final section concludes with a description of the role played by borders as security “dispositifs” that represents an attempt at a synthesis of the different theoretical perspectives critically discussed in the previous sections.

Abstract: Desde comienzos de los anos setenta, las logicas penales basadas en la inclusion han sido paulatinamente eclipsadas por otras en las que la exclusion y la expulsion se constituyen como sus notas centrales. Ahora bien, a diferencia de aquellas interpretaciones que visualizan este proceso desde la propia prision y sus proximidades, la crisis de la resocializacion y el consiguiente redimensionamiento de la prision contemporanea son aqui relacionados con la emergencia de una «sociedad excluyente» -que, lejos de ser el resultado natural del orden de las cosas, seria la consecuencia deseada de un proyecto neoliberal que ha estado orientado a imponer el mercado sobre la ciudadania- en la que el principal elemento de inclusion social -esto es, el trabajo- es cada vez mas escaso y restringido, lo que genera grandes cotas de exclusion e inseguridad social que deben ser gobernadas a traves de las diferentes politicas estatales. Partiendo de esta premisa y a traves de la enunciacion de tres tesis diferentes, este articulo examina las potencialidades de la Renta Basica Universal para transformar la prision neoliberal desde fuera de la misma, argumentandose que su implementacion no solo posibilitaria revertir los fundamentos materiales sobre los que esta se asienta y enfrentar la inseguridad social que nutre los efectos simbolicos de la penalidad, sino tambien pensar mas alla de la prision y el significado actual de la pretension resocializadora.
