The article deals with the historical development and current form of legal restrictions for confessors in the administration of the sacrament of penance in the Catholic Church, and specifically in relation to the indiction of the extraordinary jubilee of mercy (2015-2016) by Pope Francis. It summarizes the evolution of the canonical regulation in the Christian East and West, particularly with regard to (re)codification of canon law in the 20th century, and indicates the original version and Czech translation of fundamental texts which were only accessible with difficulties and little known. It emphasizes the clarification of the distinction reserved for sins because of their nature (ratione sui) and because of censures (ratione censurae). It analyzes, explains and evaluates upon this basis the extraordinary faculties granted to confessors in the Czech Republic decades ago. The author finally presents his personal reflections and suggestions for future legislation (de lege ferenda) and for Christian practice, with an emphasis on the social dimension of personal sins and on the reactions of the Church to them.

La facolta teologica e una istituzione di istruzione superiore scientifica, che puo operare autonomamente all’interno della Chiesa oppure e inserita nell’universita statale. A confronto delle altre facolta di diverse discipline la sua natura e particolare in quanto partecipa della missione evangelizzatrice della Chiesa. La teologia e la scienza in cui si riflette la dottrina cattolica. Da questa premessa si deduce che solo la competente autorita ecclesiastica puo istituirla o riconoscerla come tale, a prescindere dal fatto che operi solo all’interno della Chiesa o sia inserita nell’ambito dell’universita statale. I docenti delle discipline teologiche hanno bisogno del relativo mandato della Chiesa per insegnare, che assicuri loro che l’insegnamento e conforme alla dottrina cattolica e all’insegnamento del Magistero della Chiesa e che sono in piena comunione con la Chiesa. Nel caso in cui la facolta teologica sia inserita nell’universita statale, vale sia la legislazione ecclesiastica che quella civile in materia; l’attivita delle facolta e in questo caso regolata in modo piu precipuo dal Concordato o da altro accordo tra lo Stato e la Chiesa. Per l’istituzione e l’attivita di una istituzione superiore svolgono un ruolo privilegiato la Santa Sede, la Conferenza Episcopale e il Gran Cancelliere, che e l’anello di congiunzione tra la stessa Facolta e la Chiesa come ente che la erige.

T FIRST GLANCE, the modern Magisterium’s teaching in favor of “responsible parenthood” and the use of periodic abstinence seems a challenge to traditional ways of talking about marriage. The 1917 Code of Canon Law opened its discussion of marriage by stating, “The primary end of matrimony is the procreation and upbringing of the child; the secondary [end] is mutual help and the healing of concupiscence.” Gratian, summarizing canon law up till the twelfth century, and the central authority on the topic thereafter, said, “God joined male and female by nuptial chastity for the purpose of propagating the race,” and distinguished “the use of the marital act for the procreation of children” from “the use of promiscuous women, in the way of dogs.” And Vatican II’s Gaudium et Spes states,

Sepanjang sejarah keselamatan, Allah tak henti-hentinya mewartakaan pertobatan. Puncak karya keselamatan itu ada dalam diri Yesus yang datang dalam dunia. Yesus telah berkata, ”Waktunya telah genap; Kerajaan Allah sudah dekat. Bertobatlah dan percayalah kepada Injil!” (Mrk 1:15). Gereja terus-menerus menyerukan dan melayani pertobatan kepada semua orang supaya mereka memperoleh keselamatan kekal. Namun, kerapuhan seringkali menjadi alasan manusia jatuh dalam dosa, jauh dari Allah, dan berada dalam ketidakkudusan. Tetapi Allah tetap setia pada manusia dan menghendaki agar manusia menjadi kudus melalui pertobatan. Pertobatan merupakan sarana untuk memulihkan relasi antara manusia dengan Allah. Santo Paulus melalui pengalaman pertobatannya yang luar biasa menjadi teladan dan model bagi setiap orang Kristen untuk bertobat, berbalik kepada Allah, dan hidup baru yang sesuai dengan kehendak Allah
