Tanah merupakan suatu kebutuhan fundamental dari setiap warga negara saat ini. Kebutuhan akan tanah terlihat dari antusias setiap orang akan memperoleh dan mempertahankan tanah yang mereka inginkan dan mereka miliki. Tanah yang merupakan karunia dari Tuhan Yang Maha Esa, memiliki nilai yang sangat tinggi secara ekonomi, sosiologi, maupun secara derajat seseorang ditengah masyarakat. Seiring perkembangan akan kebutuhan tanah disaat ini, bersamaan dengan itu juga berkembang pula regulasi-regulasi atau aturan yang mengatur bagaimana cara memperoleh serta mempertahankan tanah tersebut. Pemerintah yang berwenang mengeluarkan segala jenis aturan tersebut merasa harus untuk mengeluarkan peraturan-peraturan tentang pertanahan, maka dibentuklah Undang-undang Pokok Agraria yaitu Undang-undang No. 5 Tahun 1960. Namun sayangnya peraturan-peraturan tersebut belum sepenuhnya melindungi para pemegang hak tanah. Tak jarang karena besarnya nilai tanah tersebut, sering menimbulkan konflik-konflik secara vertical maupun horizontal. Penulisan skripsi ini penulis menguraikan tentang apa itu sertifikat ganda, apa saja faktor yang mengakibatkan timbulnya sertifikat ganda serta penyelesaian pihak berwenang dalam hal ini Badan Pertanahan Nasional dalam menangani permasalahan sertifikat ganda. Penulis menggunakan metode penelitian yuridis sosiologis yaitu pendekatan melalui penelitian hukum dengan menggabungkan fakta-fakta yang terdapat dari bahan hukum kepustakaan maupun wawancara kepada pihak-pihak terkait. Hal yang paling penting dalam terjadinya sertifikat ganda adalah ketidakjujuran pemohon dalam hal ini pemilik tanah yang mengajukan permohonan pengukuran dan pembuatan sertifikat kepada pihak BPN, dengan memasukan data-data yang tidak sesuai dengan yang ada dilapangan. Serta kurangnya sumber daya manusia dan kurang modernnya teknologi yang dimiliki pihak BPN dimasa lampau juga merupakan faktor lain yang menimbulkan munculnya sertifikat ganda. Namun BPN bukannya tutup mata dalam menyelesaikan permasalahan sertifikat ganda ini. Melalui proses mediasi, BPN mencoba mencari jalan keluar dan menyelesaikan setiap permasalahan sertifikat ganda yang muncul. BPN juga mengizinkan pada pihak yang besengketa untuk membawa permasalahan sertifikat ganda ke pengadilan negeri jika tidak terdapat titik temu dalam proses mediasi. Penyelesaian terhadap sertifikat ganda oleh badan pertanahan nasional

The specific object in this research is Land Rights Dispute Settlement between PT. Karyadeka Alam Lestari with Farmers in Trisobo Village, Boja District, Kendal Regency through Agrarian Reforma with the formulation of the problem: (1) Why is there a dispute over tenure over land rights between PT. Karyadeka Alam Lestari with Farmers in Trisobo Village, Boja District, Kendal Regency? (2) What is the settlement of land rights tenure disputes between PT. Karyadeka Alam Lestari with farmers from Trisobo Village, Kendal Regency by the Regional Office of the National Land Agency of Central Java Province, is in accordance with the National Land Law? (3) What are the obstacles faced by the Regional Office of the National Land Agency of Central Java Province in resolving land tenure disputes between PT. Karyadeka Alam Lestari with farmers from Trisobo Village, Kendal Regency? (4) What is the follow-up to the settlement of land rights tenure disputes between PT. Karyadeka Alam Lestari with farmers from Trisobo Village, Kendal Regency through Agrarian Reforma ? This study uses an empirical juridical approach with explanatory analysis research specifications. Primary data of this study were obtained from interviews with Central Java Provincial Office, Kendal District Land Office, PT. Karyadeka Alam Lestari and the head of Trisobo village using the snowball sampling method. The data collection techniques used were library studies and field studies. The data analysis technique used descriptive qualitative. The results of the research are : (1) The occurrence of land rights tenure disputes between PT. Karyadeka Alam Lestari with Farmers in Trisobo Village, Boja District, Kendal Regency because of the social disparity between Trisobo Village farmers and PT. Karyadeka Alam Lestari. (2) Settlement of land rights tenure disputes between PT. Karyadeka Alam Lestari with farmers from Trisobo Village, Kendal Regency, by the Regional Office of the National Land Agency of Central Java Province, is in accordance with the National Land Law. (3) The obstacle faced by the mediator is in providing a correct legal understanding of land control to the disputing parties. (4) The follow-up action taken by the Regional Office of the National Land Agency of Central Java Province is to determine a portion of the land object of the dispute covering an area of 11. 5 Ha is state land released by PT. Karyadeka Alam Lestari to Trisobo village and used as land Reforma land objects which will be redistributed to 570 farmer families in Trisobo Village, Boja District, Kendal Regency through the Agrarian Reforma program.

Settlement Disputes on Land Right Between Factory and Farmers Through Agrarian Reforma

The purpose of this study was to: 1) Analyze the dispute resolution on dual certificates in the National Land Agency Indramayu district, 2) Barriers and Solutions Upon completion of Certificate Associate at the National Land Agency Indramayu district. The approach used in this paper is empirical sociological juridical with the help of primary data or empirical data as the main data. Sociological research empirical law is a legal research methods that identify and conceptualize law as a social institution rill and functional in a real life system. The data collection was obtained by interview and literature. The data were analyzed qualitatively normative. The research results are: 1). Settlement of disputes over double certificates in the National Land Agency Indramayu district that summons to the parties to the dispute to mediation. If mediation is not successful then the case was continued with the proceedings. The process of settlement is with the trial. Aspects that influence the judge determines the choice of action in the resolution of a dispute ie double certificate in terms of proof, because the facts and events as the principal case will be known judge from the evidence submitted by the parties to the dispute 2). Obstacles in solving the double certificate in Indramayu district that is party to the dispute does not come in mediation, data submitted on the land question is not clear, each party wants to win the case and the importance of their own interests. Solutions that can be done is the mediator to give some advice to the parties so that more can cooperate in following the legal process, so that the process can be completed justice and it takes a long time.
