Twenty years ago, in the pages of the, Journal of Common Market Studies, Hedley Bull launched a searing critique of the European Community's "civilian power" in international affairs. Since that time the increasing role of the European Union (EU) in areas of security and defence policy has led to a seductiveness in adopting the notion of "military power Europe". In contrast, I will attempt to argue that by thinking beyond traditional conceptions of the EU's international role and examining the case study of its international pursuit of the abolition of the death penalty, we may best conceive of the EU as a "normative power Europe".

Indicators are rapidly multiplying as tools for assessing and promoting a variety of social justice and reform strategies around the world. There are indicators of rule of law, indicators of violence against women, and indicators of economic development, among many others. Indicators are widely used at the national level and are increasingly important in global governance. There are increasing demands for “evidence-based” funding for nongovernmental organizations and for the results of civil society organizations to be quantifiable and measurable. The reliance on simplified numerical representations of complex phenomena began in strategies of national governance and economic analysis and has recently migrated to the regulation of nongovernmental organizations and human rights. Measuring the World

The article focuses on the politicization of international authority as a thus far little understood development in world politics. We first define the concept and show that there is an empirical trend towards politicization of international institutions. We then argue that the increasing authority of international institutions has led to their politicization and we relate this hypothesis to alternative explanations. The validity of the authority–politicization nexus is illustrated by the rise of international authority in parallel to politicization. We go on to distinguish different policy functions such as rule definition, monitoring, interpretation, and enforcement in order to show that especially those international institutions with a high level of authority meet with strong contestation of their competencies. We conclude the article by exploring various avenues for future politicization research.

Ihr autoritativer Charakter ergibt sich insbesondere aus den damit verbundenen wirtschaftlichen Anpassungsprogrammen und deren Wirkungen auf die Burger des betroffenen Staats. Daruber hinaus beruhren sie die Interessen von Steuerzahlern in den Geberlandern sowie privater Glaubiger. Der offentliche und internationale Charakter von Restrukturierungen folgt aus ihrer Rechtsgrundlage im verbindlichen Volkerrecht bzw. Soft Law. Die Einstufung von Restrukturierungen als internationale offentliche Gewalt hat zur Folge, dass sie den Anforderungen an die Legitimitat offentlicher Gewalt genugen mussen, die in einem offentlich-rechtlichen Rahmenwerk festzuhalten sind. Dieser Aufsatz zeigt, welche Rolle die Rechtswissenschaft bei der Entwicklung eines solchen Rahmenwerks spielen kann. Die Autoren schlagen eine Reihe von Rechtsprinzipien fur Restrukturierungen vor. Manche davon existieren bereits de lege lata, wahrend andere de lege ferenda zu fordern oder im Entstehen begriffen sind. Besonderes Augenmerk verdienen verfahrensrechtliche Voraussetzungen von Restrukturierungen, wohingegen materiellrechtliche Bedingungen mit Ausnahme der Pflicht zur Beachtung fundamentaler Menschenrechte eine politische Entscheidung erfordern. Die Qualifikation von Restrukturierungen als internationale offentliche Gewalt hat weiterhin zur Folge, dass staatliche und uberstaatliche Gerichte ihnen Vorrang einraumen mussen vor der Vollstreckung von Urteilen gegen den Schuldnerstaat. Ein dahingehendes allgemeines Rechtsprinzip ist im Entstehen begriffen. Die Entscheidung uber ein Vollstreckungsverbot gibt staatlichen und uberstaatlichen Gerichten eine Handhabe gegen Restrukturierungen mit Legitimitatsdefiziten.

Die Restrukturierung von Staatsschulden als Ausübung internationaler öffentlicher Gewalt: Zur Möglichkeit der inkrementellen Entwicklung eins Staatenionsolvenzrechts

Die foderale Spannungslage bietet einen, wenn nicht gar den Schlussel zum Verstandnis der Spezifik der unionalen Verfassungsarchitektonik im Vergleich zu staatlichen Verfassungen. Unter dem Konzept des supranationalen Foderalismus entfaltet dieser Beitrag die einschlagigen Prinzipien des Unionsrechts, um damit das Verstandnis der Union in konstitutionalistischem Zugriff zu vertiefen. Er beruht auf der Annahme, dass die Union eine neue Form politischer und rechtlicher Herrschaft bildet. Entsprechend sollen ihre Grundprinzipien zwar in der Tradition des europaischen Konstitutionalismus verankert sein, jedoch zugleich der Spezifik der Union gerecht werden und so die „sui-generis“-Gestalt der Union konkretisieren.
