Policy design,, whether conceptualized as a verb referring to the process of formulating policy ideas,, or as a noun describing the logic through which policy intends to achieve its objectives,, remains relatively uncharted territory.. This paper reviews what we know about how policy designs emerge,, and identifies the kinds of biases and weaknesses that are introduced into designs by the decision heuristics employed.. Theories of policy invention and expert decision--mmaking suggest that individuals search through large amounts of relevant information stored in memory,, reason by analogies,, make comparisons,, and either copy or simulate patterns of information.. Policy scholars may contribute to improved policy design by making more explicit the biases introduced through reliance on decision heuristics,, and by suggesting a more formal,, self conscious search and selection process that enables designers to be more discriminating when they pinch policy ideas from other contexts.. To perform this task,, comparative policy analysis is needed in which common elements that exist in virtually all policies are identified and the underlying structural logic of the policies is made explicit.. In this paperwe set forth generic elements found in policies,, describe and compare some of the more common design patterns,, and discuss the circumstances where these may be inappropriately copied or borrowed,, thereby thwarting the effectiveness of the policy.

Systematically Pinching Ideas: A Comparative Approach to Policy Design

Research into Public-Private Partnerships (PPPs) has proliferated since the mid-2000s (Cui et al., 2018; De Castro e Silva Neto et al., 2016; Ke et al., 2009; Shi et al., 2020; Tang et al., 2010; Wang et al., 2018), with publications about PPPs originating primarily from the United Kingdom, the United States, Canada, Australia, and, increasingly, China and Europe (Chen et al., 2016; Cui et al., 2018; De Castro e Silva Neto et al., 2016; Ke et al., 2009; Wang et al., 2018). A core theme in this literature on PPPs is their performance (i.e., questions about the extent to which performance is achieved, how it can be achieved, and how it can or should be measured; Chen et al., 2016; Cui et al., 2018; De Castro e Silva Neto et al., 2016; Wang et al., 2018). These are no small questions, and they require our constant attention. The performance question of PPPs is a lingering one (Hodge & Greve, 2007, 2009, 2017; Palcic et al., 2019). Different conceptions of PPP performance exist and they depend on, among other things,1 how the PPP phenomenon is defined and understood (Hodge & Greve, 2017; Wang et al., 2018). The definition of PPP as a Long-Term Infrastructure Contract partnership is today the most prominent one (Palcic et al., 2019). These contracts can be found in the development and management of both economic infrastructure (e.g., roads, bridges, ports, railways, airports, telecommunications, and power) and social infrastructure (e.g., schools, hospitals, water supply, housing, sewerage, sports facilities, and care; Grimsey & Lewis, 2004). In this definition, PPPs are commonly understood as a “single project” or as a “specific type of infrastructure delivery mechanism with a specific institutional and financial structure in place to initially fund and deliver construction works as well as operate the long-term facility” (Hodge & Greve,

Public-private partnership (PPP) renegotiations and their outcomes have been studied extensively in Latin America and Europe but not in the United States. Therefore, this study evaluates factors triggering U.S. PPP renegotiations by examining six highway PPPs located in California (2), Indiana (1), and Virginia (3). The findings suggest exogenous macroeconomic shocks, project and political complexity, and institutional inexperience are the most compelling triggers behind U.S. PPP renegotiations. These findings also highlight America’s distinct political and institutional environment – i.e. favourable to buy-outs as well as debt restructuring via bankruptcy – as a possible explanation for the absence of opportunism among U.S. PPP renegotiations.
