오늘날 세계질서의 급격한 변동은 구질서의 희생자인 한국에게는 분단을 극복할 역사적 기회이다. 한국분단은 비교대상을 찾기 어려운 독특하고 고유한 사례이며, 통일헌법의 문제는 실정법 해석의 차원을 넘는 문제라는 점에서, 헌법적 상상력을 발휘하여야 한다. 분단과 통일의 견련관계를 고려할 때 ‘분단을 초래한 요인’ 뿐만 아니라 ‘분단을 지속시키고 있는 요인’도 함께 고려하여야 한다. 또한 통일과 통일헌법에의 접근은 동태적ㆍ과정적ㆍ미래지향적이어야 한다. 통일 방식과 통일헌법도 상관성이 있는데, 현재의 북한체제가 그대로 유지되는 경우 국가연합 이상은 달성하기 어렵고, 테크노크라트들로 북한의 정치엘리트들이 교체된다면 일국양제까지는 일단 가능할 것이다. 현실성은 낮지만 북한에 민주화혁명이 일어날 경우, 새로운 민주정부가 대한민국헌법을 수용하여 곧바로 ‘하나의 국가, 하나의 체제’로 통일이 될 수도 있다. 그러나 이 정부가 북한을 일정 기간 유지하길 원할 경우 남북정부간 단계적인 통일노력이 필요할 것이다. 통일헌법의 내용에 있어서는 대한민국헌법이 그동안 성취한 입헌주의원리들을 출발점으로 해야 한다. 민주주의, 법치주의, 사회국가원리를 강화하고, 국제평화주의, 특히 국제법규 존중주의를 구체화할 필요가 있다. 국가조직에 있어서는 연방제 도입 여부가 문제될 것인데, 남북 2개주 연방주는 위험할 것으로 보이고, 8∼10개 주로 하는 중위연방제를 고려해볼 만하다. 통일한국의 정부형태도 이론상으로는 회의 정부제>의원내각제>반대통령제>대통령제 순으로 통일과 통합에 유리할 것으로 보인다. 가장 큰 문제로서, 북한지역에 민주정치를 복원하기 위하여 정당의 조직과 선거제도의 정상화에 각별한 노력을 기울여야 한다. 통일한국의 의회 구성시 양원제, 특히 상원의 도입을 적극적으로 검토할 만하다. 기본권의 경우 특히 사회적 권리의 보장범위와 보장수준이 고려되어야 하고, 전통적인 자유권 가운데 통일 이후 여러 가지 문제의 처리를 위한 예외의 헌법적 근거를 마련할 필요가 있다. 무엇보다도 통일헌법의 논의는 헌법입법과정에 국민의 광범한 참여를 중시하고 가치합의를 위한 토론을 선행하게 하는 세계적인 추세를 반영하여야 한다. 근대 입헌주의 이후 헌법은 사회계약의 성격을 가지고 있어서 국가의 구성원인 국민이 모두 동등하게 참여하는 가운데 동의하는 절차를 밟아야 정당화된다. 따라서 통일헌법 역시 북한주민을 포함한 통일한국 국민 모두가 동등한 자격으로 참여하여 정당화하는 절차를 밟아야만, 통일헌법의 정당성과 더불어 규범력을 확보하고 국민대통합에도 이바지할 수 있게 될 것이다.

Radical Succession: Hagiography, Reform, and Franciscan Identity in the Convent of the Abbess Juana de la Cruz (1481–1534)

Catherine of Siena's rigorous penance was a religious and social expression of cultural sensibilities, which mixed ancient traditions with later medieval form and gendered perceptions with broader expectations concerning lay piety. This chapter examines Catherine's asceticism from two principal perspectives. The first of them places Catherine among other women mystics of her time. This approach, which looks at Catherine's ascetic and mystical experiences within the context of her gender, has produced a wealth of outstanding studies over the past three decades. The other approach - the study of Catherine's lay penance as a variant of ancient Christian ascetic tradition - has not attracted similar attention. The chapter concludes with a few remarks concerning the place of asceticism within Catherine's active life as a prophet, mystic, and reformer, for her deeds of denial receive their ultimate meaning only when set against the backdrop of her deeds of affirmation. Catherine of Siena belongs on the list of illustrious 14th-century Italians among whom Dante, Ptolemy of Lucca, and Petrarch are most prominent who viewed the papacy's absence as a matter of gravest import. Modern scholarship on Catherine's involvement with the papacy begins with Alfonso Capecelatro's elegant and erudite Storia di santa Caterina da Siena e del papato del suo tempo . Capecelatro's work has faced many scholarly challenges but continues to inform much of the received wisdom about Catherine's role in papal affairs. The roots of the Avignon papacy can be traced to the tumultuous pontificate of Boniface VIII, whose ignominious death at Anagni provoked explosive conflicts in Italy. Raymond of Capua's vita of Saint Catherine includes a memorable account of Catherine's first meeting with Gregory XI at the end of June 1376, shortly after she arrived in Avignon.
