La transparencia en la actividad publica esta hoy vinculada con todos los valores de la buena gobernanza, constituyendo un elemento transversal irrenunciable que debe permear el funcionamiento del gobierno y la administracion, a todos los niveles y en cualesquiera ambitos. La presente tesis doctoral persigue conocer como se ha llevado a cabo el proceso de implantacion de la transparencia en los municipios espanoles, a partir de la aparicion de la Ley espanola en 2013, en que momento nos encontramos y cuales son los retos y posibilidades de futuro. Un desafio que tiene en este ambito perfiles propios, como nivel mas cercano a los vecinos, de mayor sensibilidad y potencial capacidad de respuesta a sus expectativas y problemas. Las tecnicas de investigacion empleadas, mas alla del estudio de numerosas fuentes documentales, han sido una encuesta respondida por 339 ayuntamientos de tamanos diversos, encuadrados en todas las provincias y CCAA, asi como entrevistas en profundidad a expertos responsables de la transparencia municipal.
La tesis comienza con una revision academica sobre los diversos estudios de la transparencia en el ambito local, presentando asimismo su marco conceptual como valor central en las actuales sociedades democraticas.
El analisis del marco juridico se realiza en dos capitulos, el primero centrado en la regulacion de la publicidad activa y el derecho de acceso a la informacion en la normativa estatal ?antecedentes, caracteristicas y contenido de la Ley 19/2013, de Transparencia, Acceso a la Informacion Publica y Buen gobierno-, asi como de su desarrollo reglamentario, actualmente en tramitacion-. La regulacion de la transparencia en la Administracion local focaliza el siguiente capitulo, que parte de las obligaciones de transparencia ya existentes para los municipios cuando aparece la ley estatal y aborda las cuestiones mas relevantes planteadas en el debate parlamentario desde el prisma autonomico y municipal. Las leyes autonomicas de desarrollo que resultan aplicables a los municipios, los Reglamentos y Ordenanzas e importantes iniciativas de refuerzo y colaboracion interadministrativa, facilitadoras de la efectiva implantacion de la normativa de transparencia en los ayuntamientos, completan el analisis.
La investigacion ha procurado interesantes resultados en tres ordenes de cuestiones. En primer lugar, se analizan los elementos estructurales de la ley para el desarrollo de una Administracion local transparente, revisando la planificacion y puesta en marcha de todos los factores clave para instrumentar la transparencia, como la preparacion de la informacion, la organizacion de los recursos humanos, su formacion y sensibilizacion hacia una cultura administrativa novedosa, la puesta en marcha de un procedimiento de acceso a la informacion, o los cambios en los procesos de gestion municipales.
El trabajo tambien explora el grado de observancia de la normativa, asi como los aspectos cuyo cumplimiento se encuentra pendiente y el nivel de dificultad de ese iter complejo que es la puesta en marcha de una administracion local transparente, concluyendo con una evaluacion general del cumplimiento de las obligaciones legales de transparencia por parte de la Administracion municipal.

La implantación de la transparencia en los municipios españoles

“Every power comes through crisis” has long been a motif of European integration. The financial and sovereign debt crises, which have shaken the European Union (EU) in recent years, are at first glance no different. Treaty reforms, intergovernmental treaties such as the Fiscal Compact and the Treaty Establishing a European Stability Mechanism (ESM Treaty) have significantly altered the constitutional landscape of the EU and its Member States. The crisis has also inspired many European legal scholars to critically analyse the EU’s system of economic governance, as have other events throughout the history of the European Union, from the Empty Chair Crisis to the referenda in the aftermath of the Treaty of Maastricht and the failure of the Constitution for the European Union. What does seem to be different is the way in which scholars approach the issue of the Eurozone crisis. Instead of a purely legal perspective on economic governance, European legal scholars have realised that in order to understand and analyse the euro crisis, interdisciplinarity is the word of the moment.

This article deals with the elaboration and use of the concept of a basic structure of the constitution in different jurisdiction, especially from Europe and Latin America. Through this comparative analysis, it aims to prove that the yardstick employed for constitutional adjudication on amendments has a specific scope and content, and that both scope and content are mainly decided by courts. After explaining the arguments courts have employed in order to justify their role, it focuses on the different denominations of the “basic structure” in the set of the selected case studies, finally concentrating on the role of constitutional and supreme courts.

The “Basic Structure” of the Constitution as an Enforceable Yardstick in Comparative Constitutional Adjudication

This Article analyses, through the lens of comparative law, the Oliari and others v. Italy judgment, which was issued by the European Court of Human Rights (ECtHR) in July 2015. The Oliari case is important for being the first judgment in which the ECtHR established the granting of legal “recognition and protection” to same-sex couples as a positive obligation for the Member States of the Council of Europe on the basis of Article 8 of the European Convention on Human Rights. In order to understand the role of judicial bodies in the progressive protection of homosexual rights, this Article combines an analysis of European case law with the national perspective. As it concerns the supranational facet, the authors illustrate Oliari's reasoning and situate the case in the jurisprudence of the ECtHR. Elements of both continuity and innovation emerge from the analysis, as well as a relevant dimension of judicial dialogue supporting the incremental recognition of gay rights in Europe. As it concerns the national facet, this specific case was initially dealt with at the domestic level and was the object of judgment 138/2010 by the Italian Constitutional Court. The judgment is critically put into perspective through the examination of the jurisprudence of other European Constitutional Courts (France, Portugal and Spain) that were called on to decide similar cases in the same period. Therefore, the Article offers a comparative analysis of the Oliari judgment clarifying its relevance and speculating on the potential value of this case for the future recognition of the right to a “gay” family life in Europe.

Este articulo analiza el tema de la secesion en el derecho constitucional comparado, a traves del prisma de la jurisprudencia constitucional. Tiene como eje principal la mayor o menor apertura a la secesion como aspiracion politica, y por ello los dos casos fundamentales resultan Espana (mayor apertura) y Alemania (menor apertura). Enmarcados en el contexto de la jurisprudencia italiana y canadiense tambien, estos casos se usan para sacar conclusiones acerca de las razones constitucionales y politicas de las distintas posturas jurisprudenciales.

A finales de 2016 el Tribunal Constitucional federal aleman tuvo que decidir un recurso individual que reivindicaba, para los ciudadanos de Baviera, la posibilidad de un referendum independentista. Este articulo analiza la decision del Tribunal, contextualizandola a la luz de la jurisprudencia previa, del contexto politico y de la doctrina. Finalmente, propone unas reflexiones criticas en perspectiva comparada. At the end of 2016, the German Federal Constitutional Court issued a decision concerning an individual appeal claiming the possibility of an independentist referendum for the Bavarian population. This article analyzes the Court’s decision, contextualizing it in the light of previous jurisprudence, political context and scholarship. Finally, it offers critical reflections from a comparative perspective.
