A Legal Analysis of the Enforcement Dilemma of the Convention on the Protection and Promotion of the Diversity of Cultural Expressions

Abstract: Dilemmas of the implementation of Convention on the Protection and Promotion of the Diversity of Cultural Expressions stem from its internal defects and the conflicts between the Convention and WTO.The current trade liberalization mechanism fails to provide a good legal environment for the enforcement of the Convention.Consequently,the association of WTO and the Convention,the balance of various interests,the enhancement of civil society should be promoted and motivated.In China,domestic legislation will focus on the concrete policy of promoting the cultural diversity on the one hand,and on the other hand,efforts should be made on striving for the power of discourse by the Convention in the dispute settlement.

The Impact of Margin Purchasing and Short Selling on Liquidity and Volatility:Evidence from Shanghai Stock Market

Abstract: This paper analyzes the margin purchasing and short selling transactions status of Chinese stock market.Using Shanghai stock market data,we examine the impact of margin purchasing and short selling on liquidity and volatility of stock market with VAR model analysis method.This study indicates that margin purchasing and short-selling both Granger cause the market liquidity and volatility.Margin purchasing has reduced stock market liquidity but increased the volatility.Short selling has reduced both stock market liquidity and volatility.The impact of margin purchasing is much greater than short selling.

On the Right of Natural Person's Gender Transition after Marriage

Abstract: Nowadays the regulation on forbidding gender transition is not specified(including the married transgender),but natural person's right to gender transition is acknowledged and protected by the judicial practice.According to the principle "no crime without a law",the right to gender transition is supposed to be confirmed and protected on the condition that it conforms to the general medical condition.Meanwhile,sex reassignment surgery for married persons should not be based on dissolving marital relation.From the perspective of legislation,gender transition should be regarded as legal cause for the break-up.When dissolving marital relation,the person who precedes gender transition surgery should undertake the liability for faults due to the break-up of marital relation and the other enjoys the right to ask for compensation for the hurt resulted from marital faults.

Survey and Analysis of Happiness of College Students

Abstract: With the accelerated development of the society,college students are facing with more and more severe pressures such as learning,employment,emotion,interpersonal relationship.The pursuit of happiness also changes.Through investigation,the author found that the overall well-being of colleges is in good condition,but there are deviations.Based on the survey,this paper puts forward some proposals to enhance students' sense of happiness.

Evaluation on the Employment Competitiveness of Colleges and Universities Graduates Based on Social Need

Abstract: Social need is the touchstone to test the employment competitiveness of colleges and universities graduates.Based on literature review,by means of the questionnaire survey to social units,this paper develops the evaluation system of employment competitiveness of colleges and universities graduates;then figures out the index weight of employment competitiveness with the AHP method;Finally,takes one university as an example for empirical analysis with the fuzzy synthetic evaluation method,verifies the practicability and maneuverability of the evaluation system.

移动交通荷载下饱和沥青路面的水力耦合分析: Coupled hydro-mechanical analysis of saturated asphalt pavement under moving traffic loads

Abstract: In order to reveal the mechanism of water-induced damage to asphalt pavement, a three-layer surface course-base course-subgrade physical model is established based on the Biot's dynamic consolidation theory, and the governing equations of the three layers are deduced for the saturated asphalt pavement under moving traffic loads. Then, by utilizing the Fourier series expansion and the Fourier transform, the semi-analytical solution and the numerical solution are obtained for multiple physical fields in the surface course. Moreover, the dry pavement is compared with the saturated one in terms of stress distribution and pore water pressure distribution, and the effect of drainage boundary condition at the surface course bottom on the dynamic response of pavement as well as the effect of the shear modulus of pavement on the pore water pressure distribution is analyzed. It is found that, for the saturated asphalt pavement, higher tensile stress and larger tensile stress area are generated under moving traffic loads and that fully drained boundary greatly affects the distributions and values of pore water pressure and pore water velocity in the surface course with high permeability. However, it only has a slight effect on the surface course with low permeability, except for the small region near the surface course bottom. It is also found that the maximum pore water pressure decreases with the increase in the shear modulus of the surface course and the base course.

Study on the Index System of Hotel Low Carbonization

Abstract: With energy crisis and environmental deterioration,the increasing pressure our earth bore gets more and more attentions.To cope with the crisis,the low-carbon development in society will become a new challenge every walk of life faces.This paper constructs the hotel low carbonization index system,covering 26 indices.By the use of analytic hierarchy process method,it calculates the weight value of each index and discusses the objectivity of the whole system.The index system is intended to facilitate comparative analysis of hotel's low carbon level and promote the hotel low carbon renovation.
