Antes y después de la doctrina Parot: la refundición de condenas y sus consecuencias

TL;DR: In this paper, a pequeno repaso historico de the hitos fundamentales that condujeron a la elaboration of the "Doctrina Parot" and the rationale of the Spanish jurisprudence in order to create that Doctrine, along with judicial positions in Spain that already were contrary to its application and the Grand Chamber judgment of the European Court of Human Rights in the Del Rio Prada case.
Abstract: En las paginas que siguen se realiza un pequeno repaso historico de los hitos fundamentales que condujeron a la elaboracion de la “Doctrina Parot” y se analiza a continuacion la fundamentacion que uso la jurisprudencia espanola para dar lugar a dicha Doctrina, junto a las posiciones judiciales contrarias que ya se pronunciaron en nuestro pais en su momento y el contenido de la Sentencia del Tribunal Europeo de Derechos Humanos que la anula. Asimismo se analiza la regulacion legal de la refundicion de condenas y el criterio jurisprudencial con el que se aplica, que constituye un ejemplo palmario de creacion judicial del derecho al margen de lo dispuesto en la legislacion positiva. Abstract: The following pages go over some historical events that led to the development of "Parot Doctrine" and then analyze the rationale of the Spanish jurisprudence in order to create that Doctrine, along with judicial positions in Spain that already were contrary to its application and the Grand Chamber judgment of the European Court of Human Rights in the Del Rio Prada case. Spanish Law about combination of sentences is also analyzed, as well as the practice of the courts which constitutes a glaring example of judicial law making against legislation in force. Abstract: A characteristic that makes the democratic state under the rule of Law quite singular is how it confronts those who combat it. With an apparently suicidal strategy in any confrontation, it places limits on its means of defence. In a widely-used metaphor, it fights with one hand voluntarily tied behind its back. But it is victorious in the end, which shows that its apparently mistaken strategy in reality involves a wiser mobilization of ethical forces, which more than compensate for what has been lost by voluntary restriction. Extending the metaphor, for each hand that is freely tied behind its back, the state gains another more powerful one.

Abstract: The United Kingdom started its counterterrorism policies decades before 9/11 attacks. That, amongst other causes, explains its influence on the counter-terrorism European legislation. The legislation on the topic has experienced some changes during last years, due to several terrorist attacks in British territories and the prospect of a Brexit deal. Those changes follow classic trends on British counterterrorism but at the same time face directly the European Convention on Human Rights, especially its article 7. This paper makes a complete analysis on the British fight against terrorism, remarking the incidence on the European criminal policy, some judgements about counterterrorism legislation of the European Court of Human Rights vs. United Kingdom, a brief comparison with Spanish law, and the most recent legal texts of the post-Brexit era.
