Judicial institutions, as law enforcement agencies in the Criminal Justice System, are a foundation of hopes for justice seekers, as based on Article 2 section (4) of Law No. 48 of 2009, regulates that “the Court is done simply, quickly, and at a low cost”. Therefore, this study aims to determine the implementation of the Supervision and Observation Judge's role and the obstacles that affect the Supervision and Observation Judge's performance in implementing Court Decisions in the Penitentiary. This study uses two types of research, namely normative legal research and empirical legal research. This research was conducted at the Makassar Class I Penitentiary and the Makassar Class IA District Court. The types of data used in this study include primary data and secondary data. The data that has been collected is then processed descriptively qualitatively. The results of the study concluded that the implementation of the role of the Supervision and Observation Judge in the implementation of the decision of the Makassar Class IA District Court at the Makassar Class I Penitentiary has not run optimally, because between The Supervision and Observation Judge and the Head of the Penitentiary rarely meet and discuss guidance issues for Inmates at the Penitentiary. The obstacles in implementing the role of the Supervision and Observation Judge at the Penitentiary include the problem of insufficient funds available for operational supervision and observation and the absence of special staff to assist the Supervision and Observation Judge in recording their Inmates. Therefore, more specific implementing regulations are needed to certify that the judgment is being properly executed and under the laws and regulations in Indonesia. Furthermore, there is a need for effective cooperation between the Supervision and Observation Judge and the Penitentiary Officers, who must always coordinate as one unit in an integrated Criminal Justice System.

The Role of the Supervision and Observation Judge on Guidance for Inmates

The legal position of workers and entrepreneurs is equal. However, in practice, it tends to put employers in a more advantageous position. Based on this, this paper aims to analyze legal protection for workers from the aspect of state constitutional responsibility. The research method used is a type of research with Content Analysis. The results of the study show that legal protection for workers is intended to guarantee basic rights and guarantee equal opportunity and treatment without discrimination on any basis to realize the welfare of workers / laborers and their families.

Pertanggungjawaban Tindak Pidana Perbankan Terkait Dengan Informasi Kerahasiaan Bank

This research aims to uncover how Islamic criminal acts towards social media crimes. This study also elaborates on how Islam assesses Indonesian criminal prosecution against social media crimes. The approach used is a juridical normative to assess the criminal law system in force in Indonesia with the Islamic criminal perspective as grand theory. The results found that crime through social media was adapted with the crime in Islamic law namely Hudūd, qisas diyat and tazir. This research also found that the Indonesian legal system provides legal rewards for perpetrators of crimes through social media charged with the Information and Electronic Transactions (ITE) Law still needs to be expanded. Crimes through social media most often threatened by the ITE Law are insults to the government or symbols of the state, threatening and defamation of others, insults to others and violating SARA (ethnicity, religion, race and intergroup). Cybercrimes related to adultery, alcoholism and terrorism must be considered because they are a serious threat. Prison penalties and fines that are most often sentenced to perpetrators of social media crimes include part of criminal tazir which is following Islamic criminal law.

Shariah Assessment Toward the Prosecution of Cybercrime in Indonesia

The new spirit of human rights enforcement in Indonesia through the ratification of Law no. 26 of 2000 became the main pillar to accommodate issues that attracted international attention. Law No. 26 of 2000 has shown the importance of regulating human rights enforcement, the regulation is also the main instrument to protect and guarantee human rights enforcement mechanisms in Indonesia. The author takes a legal problem on the comparative law of Law no. 26 of 2000 concerning the Human Rights Court which was adopted from the provisions of the 1998 Rome Statute. Several human rights activists took action, this was because the 1998 Rome Statute provisions were adopted imperfectly in article 42 of Law no. 26 of 2000 which caused problems in the enforcement of the Human Rights Court. Some of the perpetrators of gross human rights violations in Indonesia are generally parties with power or position, who can escape the applicable legal sanctions and are free from responsibility for the actions that have been committed by them or their groups. So it is important for the development of human rights in Indonesia to improve the norms of command responsibility in Article 42 of Law no. 26 of 2000. Based on these issues, the author will integrate several comparative laws and principles to get a concrete solution. The purpose of this research is to build a legal framework to strengthen the enforcement of Indonesian human rights. The methodology that will be used is a normative method with a conceptual approach. The findings of this study reveal that several human rights violations by the Command in Indonesia have not yet been resolved properly and have attracted international attention. In theoretical studies, the existence of the principle of command responsibility is considered difficult to prove in court. The involvement of human rights violators by the TNI command in several cases is evidence that the implementation of the command responsibility mechanism in human rights violations is far from being expected.

Comparison of the Concept of Command Responsibility in Human Rights Court Provisions

Artikel ini membahas masalah penanggulangan kejahatan siber (cyber crime) melalui pendekatan teori-teori kriminologi. Hal tersebut penting untuk memahami kejahatan siber dari segi karakteristik kejahatan dan penjahat. Metode penelitian yang digunakan yakni metode penelitian yang bersifat yuridis-empiris. Hasil penelitian menunjukkan bahwa terdapat empat teori yang dapat digunakan menganalisis kejahatan siber (cyber crime), yaitu anomi, asosiasi diferensial, kontrol sosial, dan netralisasi. Teori tersebut dapat digunakan sebagai strategi pencegahan dan penindakan kejahatan siber (cyber crime) sebagai kejahatan yang dihasilkan melalui interaksi anggota mayarakat memerlukan penanganan serius baik oleh masyarakat, penegak hukum dan perumusan perundangan-undangan. Agar kebijakan memerangi kejahatan siber (cyber crime) tepat guna dan berhasil guna, maka para pihak perlu memperhatikan hasil kajian cyber crime dari perspektif kriminologi. This article discusses the problem of cyber crime through the approach of criminology theories. It is important to understand cyber crime in terms of the characteristics of crime and criminals. The research method used is research method that is juridical-empirical. The results show that there are four theories that can be used to analyze cyber crime, namely anomy, differential association, social control, and neutralization. The theory can be used as a cyber crime prevention and crime prevention strategy as a crime generated through the interaction of members of the community requires serious handling by the community, law enforcement and the formulation of legislation. In order for the policy to combat cyber crime to be effective and effective, the parties need to pay attention to the results of the cyber crime study from the perspective of criminology.

Artikel ini  menitiktekankan pada studi kepustakaan. Dari studi ini dapat disimpulkan bahwa ilmu hukum mempunyai bahasanya sendiri, yaitu bahasa hukum. Ilmu hukum dengan segala stratifikasi keilmuannya dan struktur atau klasifikasi hukumnya beserta segala elemen-elemen pendukung sistemnnya sarat dengan bahasa-bahasa hukum yang mengandung artikulasi karakteristik sebagai bahasa keilmuan hukum dan praksis, sehingga untuk memahami disiplin keilmuannya dengan baik, maka harus menggunakan bahasanya sendiri yaitu bahasa hukum.

This study aims to examine the effectiveness of law enforcement on the protection of children victims of cybercrime in Indonesia. The method used is empirical legal research, which examines the law on social phenomena. The collecting data were from primary and secondary data. The primary data was based on the related institutions in handling child victims of cybercrime, and secondary data were collected through questionnaires administered to 4 (Four) selected Provinces samples. The results showed that the form of cybercrime experienced by the child as a victim dramatically increases every year and still seems to be weak in law enforcement. Public response to law enforcement from the aspects of law Substance, law enforcement, infrastructure facilities, inter-agency coordination is ineffective, and public responses to the handling of victims of cybercrime must be quickly addressed. This is a form of state responsibility for the protection of children victims of cybercrime. Thus, children can live and grow up to avoid the crimes that occur through the cyber development.

Metode penelitian yang digunakan adalah penelitian hukum doktrinal atau normatif. Hasil penelitian menunjukkan bahwa: Sistem Hukum Penyelesaian Pelanggaran Hak Asasi Manusia (HAM) Berat melalui Mahkamah Pidana Internasional melalui tahapan Pra-Peradilan, Penyelidikan, Acara Pemeriksaan Sementara, Peradilan, Pembuktian, dan Putusan. Adapun saran penelitian: a) Perlu adanya definisi yang jelas dan tegas tentang Agresi yang diatur dalam Statuta Roma 1998; b) Pelaksanaan sistem hukum penyelesaian pelanggaran Hak Asasi Manusia (HAM) berat disarankan agar tetap menghargai kedaulatan suatu negara.
