Abstract: Nos últimos trinta trinta anos, houve profundas mudanças na forma como compreendemos o crime e a justiça criminal. O crime tornou-se um evento simbólico, um verdadeiro teste para a ordem social e para as políticas governamentais, um desafio para a sociedade civil, para a democracia e para os direitos humanos. Segundo David Garland, professor da Faculdade de Direito da New York University, um dos principais autores no campo da Sociologia da Punição e com artigo publicado na Revista de Sociologia e Política , número 13, na modernidade tardia houve uma verdadeira obsessão securitária, direcionando as políticas criminais para um maior rigor em relação às penas e maior intolerância com o criminoso. Há trinta anos, nos EUA e na Inglaterra essa tendência era insuspeita. O livro mostra que os dois países compartilham intrigantes similaridades em suas práticas criminais, a despeito da divisão racial, das desigualdades econômicas e da letalidade violenta que marcam fortemente o cenário americano. Segundo David Garland, encontram-se nos dois países os “mesmos tipos de riscos e inseguranças, a mesma percepção a respeito dos problemas de um controle social não-efetivo, as mesmas críticas da justiça criminal tradicional, e as mesmas ansiedades recorrentes sobre mudança e ordem sociais”1 (GARLAND, 2001, p. 2). O argumento principal da obra é o seguinte: a modernidade tardia, esse distintivo padrão de relações sociais, econômicas e culturais, trouxe consigo um conjunto de riscos, inseguranças e problemas de controle social que deram uma configuração específica às nossas respostas ao crime, ao garantir os altos custos das políticas criminais, o grau máximo de duração das penas e a excessivas taxas de encarceramento.

Abstract: O renascimento da federacao brasileira com a redemocratizacao trouxe uma serie de aspectos alvissareiros, mas o Brasil tambem precisa enfrentar os crescentes dilemas de coordenacao intergovernamental constatados internacionalmente, de acordo com as especificidades historicas de nossa realidade. O presente artigo concentra-se basicamente no estudo dos problemas e acoes de coordenacao federativa ocorridas recentemente no Brasil, mais particularmente no periodo governamental do Presidente Fernando Henrique Cardoso. A partir desta analise, procura-se, ao final, apresentar resumidamente os desafios de coordenacao intergovernamental colocados para o governo Lula. FEDERATIVE COORDINATION IN BRAZIL: THE EXPERIENCE FROM THE FHC ADMINISTRATION TO THE CHALLENGES OF THE LULA GOVERNMENT Abstract With re-democratization, the rebirth of the Brazilian federation brought with it a series of auspicious aspects. Yet Brazil must also face up to the growing dilemas on inter-governmental coordination that have been ascertained internationally, as they pertain to Brazilian historical specificities. The present article concentrates primarily on the study of problems and actions of federative coordination that have arisen recently in Brazil, particularly during the administration of ex-president Fernando Henrique Cardoso. This analysis also aims to summarize the challenges of inter-governmental coordination that the Lula government must now face. LA COORDINATION FEDERATIVE AU BRESIL : L’EXPERIENCE DE LA PERIODE FERNANDO HENRIQUE CARDOSO (FHC) ET LES DEFIS SOUS LULA Resume La renaissance de la federation bresilienne, grâce a la redemocratisation, annonce de bonnes pespectives, mais il faut aussi que le Bresil fasse face a des difficultes de coordination entre les regions qui ont ete ressentis internationalement, d’apres les specificites historiques de notre realite. Cet article s’en tient a l’etude des problemes et actions de coordination federative survenues recemment au Bresil, particulierement dans la periode du gouvernement du president Fernando Henrique Cardoso. A partir de cette analyse, on presente, a la fin et brievement, les defis de coordination d’integration gouvernementale pour le president Lula.

Abstract: Within Political Theory, this speech presents Edmund Burke's conception of political representation, that is, the relations between elected representatives and their electors. Burke rejected the mandate of the imperative type in which representatives heed only local demands and proposals coming from electors, which they then reproduce within parliament. This would make them more akin to spokespersons with the right to vote than to politicians seeking the common good through rational debate with other politicians. In contrast to that model of representation, Burke proposes what today we refer to as "representative mandate" in which representatives are acquainted with local demands yet, without neglecting them, seek to join other representatives in composing general policies. The underlying rationale is that representatives together make up a parliament meant to serve the nation as a whole rather than one locale or another; thus, they should formulate policies that take the whole country into account.

Abstract: Este trabalho discute os movimentos contraditorios no sentido da descentralizacao e da centralizacao examinando dois conjuntos de politicas: as que trataram de regular as relacoes fiscais entre os governos nacional e subnacionais e aquelas que redefiniram as responsabilidades no tocante a provisao de alguns servicos sociais. Sustenta-se aqui que, do ponto de vista das relacoes intergovernamentais, a federacao brasileira e um arranjo complexo em que convivem tendencias centralizadoras e descentralizadoras, impulsionadas por diferentes forcas, com motivacoes diversas, produzindo resultados variados. RE-CENTRALIZING THE FEDERATION? Abstract This paper discusses contradictory movements in centralization and de-centralization by examining two groups of policies: those that are meant to regulate fiscal relations between national and subnational governments and those that have redefined responsibilities relating to the provision of certain social services. It is maintained here that, from the point of view of inter-governmental relations, the Brazilian federation is a complex arrangement within which centralizing and de-centralizing tendencies co-exist, impelled by different forces, responding to different motivations and producing a variety of results. RECENTRALISATION DE LA FEDERATION? Resume Ce travail discute des mouvements contradictoires concernant la decentralisation et la centralisation et examine deux ensembles de politiques: celles qui ont tâche de reglementer les relations fiscales entre les gouvernements national et sousnationaux et celles qui ont redefini les responsabilites en ce qui concerne la provision de certains services sociaux. On prone ici que, du point de vue des relations entre les gouvernements, la federation bresilienne est un arrangement complexe ou cohabitent des tendances centralisatrices et decentralisatrices, poussees par differents forces, aux motivations diverses et qui produisent des resultats varies.

Abstract: O artigo analisa os dispositivos constitucionais relativos ao federalismo ao longo da historia constitucional brasileira, buscando conciliar a analise sobre como o federalismo brasileiro funciona na pratica e os dispositivos constitucionais que se aplicam a essa instituicao. Sao descritos os diversos desenhos constitucionais da federacao brasileira, focalizando principalmente a Constituicao Federal de 1988 e suas emendas. O artigo argumenta que os principais constrangimentos enfrentados hoje pelo federalismo brasileiro decorrem mais da dificuldade dos governos de redirecionar o rumo de certas politicas publicas e de lidar com questoes macro-economicas nao-antecipadas pelos constituintes de 1988 do que de problemas decorrentes do desenho constitucional. FEDERALISM, CONSTITUTIONAL DESIGN, AND FEDERATIVE INSTITUTIONS IN BRAZIL AFTER 1988 Abstract This article analyzes constitutional mechanisms regarding federalism throughout the history of the Brazilian constitution. We seek to reconcile the analysis of how Brazilian federalism functions in practice with the constitutional mechanisms that, on paper, establish this institution. The Brazilian federation’s various constitutional designs are described, focusing primarily on the 1988 Federal Constitution and its amendments. We argue that the main constraints that Brazilian federalism must face today are more a consequence of governments’ difficulties in redirecting the route of certain public policies and in dealing with macro-economic issues that had not been anticipated by the 1988 constitutional congress than of problems related to constitutional design. FEDERALISME, DESSIN CONSTITUTIONNEL ET INSTITUTIONS FEDERATIVES DANS LE BRESIL APRES 1988 Resume Cet article analyse les dispositifs constitutionnels concernant le federalisme au long de l’histoire constitutionnelle bresilienne. Il cherche a concilier l’analyse sur comment le federalisme bresilien fonctionne reellement et les dispositifs constitutionnels qui sont attribues a cette institution. Sont decrits les divers dessins constitutionnels de la federation bresilienne et pour cela on s’appuie surtout sur la constitution federale de 1988 et ses amendes. L’article argumente que les principales contraintes auxquelles le federalisme bresilien doit aujourd’hui faire face decoulent plutot des difficultes des gouvernements de reorienter certaines politiques publiques et de traiter des questions macroeconomiques pas prevues par les constituants de 1988 que des problemes originaires du dessin constitutionnel.
