Half Way to Freedom: The Role of Halfway Houses in Canada's Penal Landscape

RESUMO Trata-se acerca da significacao do crime, da culpa, pena e da dor no âmbito da justica criminal. Para tanto, percorrem-se alguns aspectos que caracterizam a historia da teoria do crime, da criminalizacao e das penalidades, buscando-se as bases epistemologicas da Justica Comunitaria e da Justica Estatal. Tal percurso associa-se a investigacao de fatores contemporâneos que retroalimentam os diferentes paradigmas da justica retributiva e da justica restaurativa. Ganha destaque a discussao acerca do papel da lei canonica, do direito romano; as dimensoes da revolucao juridica; e, finalmente, a mudanca de paradigma assentado em uma nova definicao de crime associada a violacao de pessoas e de relacionamentos. Por fim, assinala-se que a lei penal, uma aquisicao relativamente nova da sociedade ocidental, funciona sob pressupostos que, em muitos aspectos, estao em dissonância com os demais aspectos da vida. Restorative Justice (RJ) theory and corresponding practices have been promoted by transnational organizations and spread to many countries throughout the world (Groenhuijsen 2014; Hagemann 2018) Nevertheless, it is used only in a small percentage of suitable cases To many citizens RJ is still unknown and the majority of cases are referred by professionals within the criminal justice system In particular the reluctance of victims imposes a limiting factor to a wider use There seems to be little awareness of the benefits which RJ can offer for individual healing processes and the restoration of social peace This chapter analyzes victim-initiated RJ compared with other ways of referral based on practical experiences from pilot projects and RJ service provision The current challenge to further develop RJ is located in the consistent delivery of appropriate information to actual and potential victims and potential supporters as well as professionals working with both victims and offenders In short: mainstreaming the philosophy and procedures of RJ both within the community and the criminal justice system which serves it

The Society of Captives: A Study of a Maximum Security Prison.

CONFLICTS are seen as important elements in society. Highly industrialised societies do not have too much internal conflict, they have too little. We have to organise social systems so that conflicts are both nurtured and made visible and also see to it that professionals do not monopolise the handling of them. Victims of crime have in particular lost their rights to participate. A court procedure that restores the participants' rights to their own conflicts is outlined.
