Nos últimos trinta trinta anos, houve profundas mudanças na forma como compreendemos o crime e a justiça criminal. O crime tornou-se um evento simbólico, um verdadeiro teste para a ordem social e para as políticas governamentais, um desafio para a sociedade civil, para a democracia e para os direitos humanos. Segundo David Garland, professor da Faculdade de Direito da New York University, um dos principais autores no campo da Sociologia da Punição e com artigo publicado na Revista de Sociologia e Política , número 13, na modernidade tardia houve uma verdadeira obsessão securitária, direcionando as políticas criminais para um maior rigor em relação às penas e maior intolerância com o criminoso. Há trinta anos, nos EUA e na Inglaterra essa tendência era insuspeita. O livro mostra que os dois países compartilham intrigantes similaridades em suas práticas criminais, a despeito da divisão racial, das desigualdades econômicas e da letalidade violenta que marcam fortemente o cenário americano. Segundo David Garland, encontram-se nos dois países os “mesmos tipos de riscos e inseguranças, a mesma percepção a respeito dos problemas de um controle social não-efetivo, as mesmas críticas da justiça criminal tradicional, e as mesmas ansiedades recorrentes sobre mudança e ordem sociais”1 (GARLAND, 2001, p. 2). O argumento principal da obra é o seguinte: a modernidade tardia, esse distintivo padrão de relações sociais, econômicas e culturais, trouxe consigo um conjunto de riscos, inseguranças e problemas de controle social que deram uma configuração específica às nossas respostas ao crime, ao garantir os altos custos das políticas criminais, o grau máximo de duração das penas e a excessivas taxas de encarceramento.

The culture of control: crime and social order in contemporary, society

of distinguished and rather senior economists – makes at the end of the book. Their priorities tend to be quick-fixes of problems that might, at least partly, be caused by some other challenge. More importantly, the panellists tend to disregard some of the evidence assembled by the authors. The reactions to the excellent chapter on armed conflict by Collier & Hoeffler illustrate that Nobel awards are no protection against bias. One member of the panel dismisses the economic sources of war that the Oxford economists analyse and points out that free trade is the main pacifying force, while another famous panellist mentions ethnic or religious hatred as a source of conflict. Into the Sea: Capacity Building Innovations and the Maritime Security Challenge

Information Sharing and Maritime Domain Awareness (MDA) are at the heart of the contemporary maritime security agenda. The goal of MDA is to develop shared understandings of developments and threats at sea. It is one of the preconditions for coordination and cooperation between diverse maritime security agencies and has often been understood as “key enabler”. MDA is a major technical challenge in terms of collecting and fusing data and developing expert systems for the detection of anomalies. It is also a social, political and legal challenge. This study focuses on the latter. It asks how MDA can be organized and how the socio-political challenges can be addressed. The organization of MDA in Southeast Asia is discussed in-depth, with a focus on three major centres that are the backbone of the regional MDA structure. Although far from perfect, this regional system has become a role model for organizing MDA in other parts of the world. This article explores the functions that the three centres perform in the governance of maritime security in the region. I argue that each of the MDA centres has different strengths, and that their work should be seen as complimentary in an overarching system. The strength of the overall system is in enabling trust and being flexible and adaptable to the changing situation at sea. The conclusion outlines what lessons the system holds for the organization of MDA in other regions with a focus on the Western Indian Ocean.

Contemporary piracy is a complex and intricate problem. This article discusses different sources of complexity of the problem and suggests paying attention to ontological complexity. To unravel ontological complexity one has to ask the very fundamental question: Why is piracy actually considered to be problematic? Addressing this question leads to a set of different paradigms of piracy which underpin counter-piracy policy. Each of these paradigms works with different presumptions, foregrounds different dimensions and suggests other types of measures. Five paradigms of counter-piracy are outlined: Firstly, a security paradigm, which stresses that piracy is a threat; secondly, a legal paradigm, within which piracy is a crime; thirdly, an economic paradigm within which piracy is a business model; fourthly, a development paradigm that interprets piracy as a problem of structural root causes; and fifthly a humanitarian paradigm in which piracy is the source of suffering for individuals. These paradigms produce a range of tensions between each other. The article concludes in stressing the importance of paying attention to this complexity to increase reflexivity in drafting counter-piracy policies.
